Abstract

In Indonesia, the preamble and body of the 1945 Constitution is a strong ideological basis that this country adheres to the welfare state. So that the legal basis for providing social security (health) for every citizen, Both those who are in the country and abroad should have the same opportunity to get social security, especially when we talk about Indonesian Migrant Workers who contribute large amounts of foreign exchange to Indonesia, we should no longer hear about Indonesian Migrant Workers who do not get Health Insurance. The responsibility for protecting and fulfilling these constitutional rights rests with the state and should be guaranteed by law as a consequence of the realization of a welfare state. This is as mandated by Article 28 I paragraph (4) and paragraph (5) of the 1945 Constitution of the Republic of Indonesia which states that, protection, promotion, enforcement and fulfillment of human rights is the responsibility of the state, especially the government and to uphold and protect human rights in accordance with the principles of a democratic rule of law

Abstract

Pada tahun 1983, Indonesia melakukan reformasi pajak dengan mengeluarkan UU Pajak Nasional baru yang menggantikan UU Pajak warisan kolonial, yang menganut system self-assessment. Prinsip ini memberi kepercayaan kepada Wajib Pajak untuk menghitung, menyetor, dan melaporkan pajak terutang mereka sendiri. UU KUP telah mengalami empat kali perubahan, termasuk perubahan pada ketentuan dan tata cara pemberian imbalan bunga yang menyebabkan inkonsistensi dalam penerapan prinsip self-assessment. Konflik antar norma hukum ditemukan dalam Peraturan Pemerintah Nomor 74 Tahun 2011, khususnya antara Pasal 27A ayat (1) UU KUP dengan Pasal 43 ayat (5) PP Nomor 74 Tahun 2011. Konsep imbalan bunga dalam UU KUP yang berlaku saat ini tidak berbasis pada asas kesederhanaan, kesetaraan dan keseimbangan. Kedepan, ketentuan dan tata cara pemberian bunga harus diatur kembali sesuai dengan prinsip self-assessment dan berbasis kesetaraan antara Wajib Pajak dan pemerintah untuk mencapai keseimbangan hak dan kewajiban.

Abstract

Human rights are natural that have been attached to individuals since birth and given directly by God Almighty and as a gift, World Health Organization has the right to education, health rights, employment rights, and so on. As is known, the dense population of Indonesia, increasing competition, and narrow employment and income are not as expected in addition to the growing daily needs of living, encouraging people to prefer to work abroad commonly referred to as Indonesian Migrant Workers (PMI). This fact, in fact, is not balanced by the government's ability to provide jobs that are able to absorb them. The narrowness of employment in the country has caused the lower society to turn to wider and more economically promising job opportunities abroad. On the other hand, the state is the party that is obliged to guarantee economic rights. This right is a human right today. This article discusses the concept of Employment Agreements as an Effort to Protect and Fulfill Human Rights for Indonesia Migran Workers.
