Abstract

Indonesian law, including the Constitution and international treaties such as the ICCPR and ICERD, strictly prohibits racial discrimination and violence against minority communities. This legal protection ensures that the rights of minority groups are upheld and respected. Even though there is legal protection, cases of discrimination against Papuan students are often ignored by the government and ignore their human rights. This study will take a normative legal perspective in examining the validity of laws and regulations through comprehensive presentation and analysis. The purpose of this research is to investigate the social science paradigm by analyzing the effectiveness of law enforcement policies, the enforcement of those regulations, and the ability of law enforcement agencies and government entities to protect citizens from discrimination. This study highlights the root causes of discrimination against Papuans, which originate from racial bias in various aspects such as economics, politics, education and law enforcement. This emphasizes the importance of enforcing anti-discrimination laws with the highest professionalism among law enforcement officials to prevent the continuation of discriminatory practices in the legal system. In this study, it is recommended that the Indonesian Government increase its commitment to enforcing laws against discrimination and violence, especially in terms of protecting the rights of the Papuan ethnic community. This includes taking firm action if discrimination or violence occurs, in order to uphold justice and equality for all citizens.

Abstract

International crimes, such as genocide and crimes against humanity, require effective law enforcement to prevent impunity and ensure justice. The International Criminal Court (ICC) was established as a permanent court to prosecute individuals responsible for such serious crimes. This study uses a qualitative approach with documentary analysis of international legal sources, ICC reports, and case studies. Data were collected through literature reviews and interviews with international law experts to gain an in-depth understanding of the functions and challenges faced by the ICC. The results show that although the ICC has an important role in upholding international justice, its effectiveness is often hampered by jurisdictional limitations, state non-compliance, and political factors. Diplomatic steps are needed to encourage more countries to ratify the Rome Statute and increase international cooperation in enforcing ICC decisions so that justice can be achieved more effectively at the global level.

Abstract

Medical malpractice, which refers to errors or negligence committed by doctors and medical personnel when treating patients. This malpractice can have serious consequences, such as worsening the patient's health condition or even causing death. This act of malpractice has legal consequences, and therefore, it is important to have a clear legal system in the health sector. The research conducted is of a normative juridical nature, using various approaches to understand this problem. The results of the study indicate that the criminal law governing medical malpractice is contained in the Criminal Code, which includes elements of negligence. To increase legal certainty for patients who are harmed, there are special laws, namely Law No. 36 of 2009 concerning Health and Law No. 36 of 2014 concerning Health Workers, which regulate law enforcement related to malpractice. Overall, this text emphasizes the importance of legal protection for patients and the responsibility of doctors in medical practice.

Abstract

Following the peace agreement in Aceh in 2005, Indonesia through Law Number 11 of 2006 established the legal basis for the establishment of the Aceh Truth and Reconciliation Commission (TRC), with the aim of addressing human rights violations that occurred during the conflict. The TRC was mandated to formulate recommendations for reparations for victims, but although these recommendations have been formulated, their implementation has not been fully implemented. This study reveals that although reparation recommendations have been made, their implementation is highly dependent on the policies and decisions of the Aceh Government, which can then delegate implementation to related institutions based on the urgency and needs of the victims.

Abstract

Studi ini menyelidiki dunia kejahatan dunia maya dan konsekuensi hukumnya, dengan fokus khusus pada peretasan bank BSI yang terkenal di Indonesia. Tujuan utama dari penelitian ini adalah untuk mendapatkan wawasan mengenai respons sistem peradilan pidana terhadap insiden peretasan Bank BSI dan mengidentifikasi strategi potensial untuk meningkatkan perlindungan hukum bagi sektor perbankan terhadap ancaman dunia maya di tahun-tahun mendatang. Bentuk penelitian ini melibatkan penelitian hukum normatif, suatu pendekatan sistematis untuk mengungkap aturan, prinsip, dan doktrin hukum untuk mengatasi tantangan hukum yang ada. Ini adalah proses metodis dalam mengeksplorasi dan menafsirkan hukum untuk memberikan solusi terhadap masalah hukum. Hasil penelitian ini menerangkan Aktivitas peretasan yang melanggar hukum dituangkan dalam Pasal 30 ayat (1), (2), dan (3) UU ITE, yang menyatakan bahwa akses tidak sah terhadap sistem elektronik orang lain merupakan pelanggaran hukum. Ketentuan ini terkait erat dengan Pasal 46 ayat (1), (2), dan (3) UU ITE yang mengatur mengenai sanksi bagi pelaku kejahatan siber. Pembentukan Badan Siber dan Sandi Negara (BSSN) melalui Peraturan Presiden Nomor 53 Tahun 2017 dan perubahan selanjutnya melalui Peraturan Presiden Nomor 133 Tahun 2017 menegaskan komitmen pemerintah dalam meningkatkan keamanan siber melalui koordinasi berbagai pemangku kepentingan nasional. BSSN bertanggung jawab melaksanakan upaya keamanan siber secara efektif dan efisien melalui pemanfaatan, pengembangan, dan koordinasi seluruh aspek yang terkait dengan keamanan siber nasional.
