Abstract

At this time, there is a stagnation of thought among Muslims regarding whether the concept of an Islamic state is still being debated or not. Islamic socio-political movements are divided into two streams, namely Substantive Islam and Symbolic Islam. Nurcholish Madjid firmly rejects the politicization of Islam in the interests of political groups that are members of Islamic parties. With the motto: "Islam Yes, Islamic Party No!". According to Nurcholish Madjid, Islamic political power is not always related to Islamic parties. He tries to convey a more substantial view of Islam, not just symbolism. Seeing the current situation, the criticism conveyed by Nurcholish Madjid is still very relevant. This research was conducted to explore the relevance of Nurcholish Madjid's thoughts on state politics in Indonesia by considering the current situation. Based on the results of this research, it was revealed that Nurcholish Madjid chose Islam which is more substantial than just symbolism. This has its roots in the universal values of Islam, not just the symbol of the "Islamic party" itself. If we look at the current situation, the criticism raised by Nurcholish Madjid is still relevant because, at this time, the politicization of religion is generally used to attack political opponents or increase party electability. Instead of using Islam as a moral guide for politics, political elites tend to use Muslims for individual interests.

Abstract

Purpose – This study aims to develop and evaluate an entrepreneurship-based curriculum aligned with the Freedom to Learn (Merdeka Belajar) initiative at State Madrasah Aliyah in Bukittinggi, Indonesia. Recognizing the necessity of equipping students with entrepreneurial skills, creativity, and self-reliance, this research addresses the critical gap between traditional Islamic education and modern labor market demands Design/methods/approach – A qualitative case-study approach, complemented by quantitative analysis, was utilized. Data collection involved purposive sampling, participatory observation, semi-structured interviews, document analysis, and closed-ended questionnaires. Participants included school leaders, teachers, students, alumni, and parents. Qualitative data were analyzed thematically, while quantitative data provided descriptive statistics to strengthen findings. Findings – The integration of experiential learning and project-based entrepreneurship significantly enhanced students’ practical business skills, creativity, problem-solving ability, and interpersonal competencies. The curriculum explicitly incorporates principles of student autonomy and flexible learning, central to Indonesia’s Freedom to Learn (Merdeka Belajar) initiative. However, substantial challenges were identified, including inadequate infrastructure, limited funding, a shortage of qualified teachers, and societal resistance rooted in traditional perceptions of madrasahs as purely religious institutions. Student questionnaire results indicated positive perceptions of the curriculum’s effectiveness (mean score > 4.2 out of 5). Research implications – Findings provide actionable insights for policymakers, educators, and administrators seeking to implement effective entrepreneurship curricula. Strategic interventions such as enhanced teacher training, structured mentoring, and robust industry collaboration are recommended to address implementation barriers, preparing students for real-world economic challenges and ultimately fostering socio-economic growth and community development.

Abstract

This study examines the role of Tulou as a customary criminal sanction in the Mentawai Islands, particularly in cases of sexual harassment, and its relevance to Islamic criminal law. The research problem arises from the tension between the persistence of indigenous customary practices and the formal state legal system, as well as the possibility of their convergence with Islamic law in achieving justice. The central questions addressed are: How is Tulou applied as a mechanism of sanction in Mentawai society, and to what extent can its principles be aligned with Islamic criminal law? Methodologically, this study adopts a normative legal research approach combined with a socio-legal perspective, utilizing document analysis, court decisions, and in-depth interviews with customary leaders, community figures, victims’ families, and religious leaders. The findings indicate that Tulou functions as a restorative justice mechanism by prioritizing reconciliation, acknowledgment of wrongdoing, apology, and compensation, thereby restoring social harmony and protecting communal dignity. When analyzed through the lens of Islamic criminal law (fiqh jināyah), Tulou resonates with the principles of ta‘zīr and the objectives of maqāṣid al-sharī‘ah, particularly the protection of dignity (‘ird), justice (‘adl), and public welfare (maṣlaḥah). This study is novel in its exploration of Tulou as a customary sanction within a predominantly non-Muslim society through the lens of Islamic criminal law. Unlike previous works that separate customary and Islamic law, this research highlights their convergence in achieving maqāṣid al-sharī‘ah objectives such as dignity, justice, and public welfare. In doing so, the study contributes a new perspective to the discourse on restorative justice in plural legal contexts.

Abstract

Islamic political power is not always related to Islamic parties. Nurcholish Madjid tried to convey a more substantial view of Islam, not just symbolism. This research uses the library research method. Research carried out using literature, both in the form of primary sources, namely research data sources obtained from original sources that contain this information and secondary sources, namely data sources obtained from books and other literature that discuss the topic of the problem. The data processing techniques in this study using content analysis techniques, namely after the data is collected, the next step is to describe the data completely, sequentially, and regularly, and after that the analysis is carried out by looking at each discussion of the themes discussed. Based on the results of this research, it is revealed that Nurcholish Madjid chose Islam that is more substantial than just symbolism. This is rooted in the universal values of Islam, not just the symbol of the "Islamic party" itself. If we look at the current situation, Nurcholish Madjid's criticism is still relevant because currently the politicisation of religion is generally used to attack political opponents or increase party electability.

Abstract

This research focuses on discrimination against religious minorities in Indonesia, Malaysia and Brunei Darussalam, three countries with strong religious traditions and legal systems. As a result of this diversity, different religious backgrounds often raise significant legal and social issues when they want to register their marriages, resulting in unpredictable events and difficulties when settling serious matters. This research utilises a qualitative methodology to examine legal texts, court judgements, court decisions, and data from case studies and interviews, which illustrate the complex interaction between religious and sectarian law. Through a comparative analysis of laws in Indonesia, Malaysia and Brunei Darussalam, this study explains how religious and sectarian norms in the legal system impact discriminatory practices. The research findings of legal and administrative challenges faced by interfaith couples, such as denial of marriage registration and the risk of social stigma, suggest a broader tension between religious authorities and state governance. With comprehensive legal reforms that not only address religious issues but also protect the rights of all individuals, and provide valuable insights and recommendations that can be implemented globally by those responsible for the practice of law, particularly in Indonesia, Malaysia and Brunei Darussalam

Abstract

Buy Now Pay Later (BNPL) services have gained significant popularity among Indonesian customers, particularly within the younger demographic that values convenience and flexibility in online shopping. This research uses a qualitative approach to examine the applications of Islamic law on the utilization of BNPL inside digital transactions in Indonesia, while also assessing its effects on consumer behavior and economic stability. The findings indicate that although Buy Now Pay Later (BNPL) provides ease and accessibility for consumers, substantial obstacles exist in aligning this practice with maqāṣid sharia principles, especially with usury and consumer protection issues. Factors such as financial literacy, governmental laws, and product transparency significantly impact the adoption of BNPL, shaping customer comprehension and utilization of these services. Islamic financial institutions bear a significant obligation to deliver several itemsthat not only meet the demands of consumers but also sharia compliance. As such, this research contributes to strengthening the integration between digital technology and the financial system, as well as supporting sustainable economic growth that is compliant with Shariah principles.
