Abstract

The purpose of this writing is to find out the principle of freedom of religion in order to be able to realize a form of Islamic respect for other religions. The theory used in this research is a theory that views the implementation of religious freedom from the perspective of the Al-Qur'an in the interpretation of Al-Misbah Qs. Al-Baqarah Verse 256 and Hadith. This research is qualitative research with several interpretation methods, one of which is the Quraish Shihab interpretation method. The data in this research is through tolerance verses in the tafsir al-Misbah and hadith which explain tolerance starting from various explanations about the principles, attitudes or ethics of the Koran towards non-Muslims in terms of tolerance towards religious freedom. The results of this research show an understanding of the principle of freedom of religion. This is an illustration of religious communities implementing the principles of religious freedom, especially in Indonesia. Because basically freedom of religion is sunatullah, but when we have chosen a religion, then religious freedom is bound by the rules of that religion, and has been regulated by the state in the constitution. Meanwhile, respecting other religions, especially Islam towards other religions, is a must, even obligatory, because Islamic teachings allow its followers to collaborate with non-Muslims, as long as it does not involve matters of faith or at a theological level.

Abstract

This article examines the rejection of a polygamous marriage legalization request at the West Jakarta Religious Court through Decision Number 1548/Pdt.G/2019/PA.JB, utilizing a critical legal studies perspective. The research is grounded in a multidimensional theoretical framework, incorporating elements of critical legal studies and statutory interpretation to scrutinize the judges’ legal interpretations. Methodologically, the study employs a rigorous approach, combining qualitative analysis of judicial decisions with theoretical insights from legal studies. The findings reveal the judges’ systematic interpretation of relevant legal provisions and highlight the tension between legal certainty, justice, and utility. The theoretical implications suggest a need for legal scholars and practitioners to reexamine prevailing paradigms and consider alternative frameworks that prioritize justice and social utility

Abstract

Penelitian ini bertujuan untuk menganalisis problematika hukum dalam bingkai pemikiran Muhammad Shahrur, seorang pemikir Islam kontemporer yang memiliki pandangan unik tentang hukum Islam. Penelitian ini menggunakan pendekatan penelitian kualitatif dengan metode analisis tekstual dan kontekstual. Hasil penelitian menunjukkan bahwa pemikiran Shahrur tentang hukum Islam memiliki beberapa problematika, antara lain kritik terhadap pandangan tradisional ulama, penekanan pada akal dan logika, dan konsep hukum yang dinamis. Penelitian ini juga menunjukkan bahwa pemikiran Shahrur tentang hukum Islam memiliki implikasi yang signifikan terhadap otoritas ulama dan lembaga keagamaan tradisional. Pemikiran studi Islam telah mengalami banyak perkembangan. Beberapa tokoh dari latar akademik yang beragam muncul menawarkan format pemikiran yang mengakibatkan semaraknya nuansa intelektual Islam. Distingsi antara produk pemikiran tokoh yang satu dengan lainnya acapkali terlihat, namun tak jarang pula ditemukan kesamaannya. tterbuka terhadap beragam pemaknaan dan penafsiran.

Abstract

One aspect of law in the Quran is criminal act (jinayat). This law aims to protect, prevent, and avoid criminal acts (jinayat) that may threaten a person's life, property, and honor. Muslims have acknowledged and accepted Islamic law as an absolute truth that must be implemented with the principle of sami‘na wa ata‘na (we hear and we obey), as part of religious practice aimed at achieving well-being in this world and the hereafter. To implement Islamic law properly, a careful understanding and observation of the objectives of sharia, both explicit and implicit, is necessary. This study has two goals: (a) to identify, categorize, and describe the linguistic styles of al-amr (command) and al-nahyu (prohibition) in jinayat verses and their legal implications; and (b) to map and elaborate on the implications of jinayat verses in determining legal status. The styles used in conveying commands and prohibitions in jinayat verses include: (1) commands; a) passive past tense verbs (fi‘il madhi majhul) that contain obligatory demands; b) verbal nouns (masdar), such as "let the one who forgives follow," where the previous imperative form is replaced with compensation; c) imperative sentences using commands verb (fi‘il amr); (2) prohibitions; a) forms that mean “do not”; b) declarative sentences (khabariyah); c) commands (al-amr) that require abstaining from self-harming acts; d) negating expressions. If the divinely prescribed commands and prohibitions are not enforced, perpetrators of crimes will never be deterred, as human-made laws have many weaknesses. Furthermore, if murderers and thieves are merely imprisoned, it could lead to increased hatred.
