Abstract

Cases over land disputes will be increasingly widespread. News of clashes during executions between the apparatus and the community in land cases every day color the reports in both print and electronic media. Land disputes cover a fairly large number. The continuing increase in land conflicts today, is a combination of the lack of efforts to resolve these conflicts systematically. Especially in the context of fulfilling the sense of justice and human rights of the victims on the one hand. There are several main causes that cause conflicts over land to increase, first, the existence of land mafias playing in land registration. This means that someone is trying to find the slightest opportunity by entering the official's signature. Second, the lack of knowledge of the apparatus, in this case someone who wants to register his land in order to get a certificate of his rights must really know how the process must be carried out or passed to register the land. The procedure used to collect data in this study is documentation, namely the guidelines used in the form of notes or quotes, searching legal literature, books and others related to the identification of problems in this study both offline and online. Analysis of legal materials is carried out using the content analysis method (centent analysis method) which is carried out by describing the material of legal events or legal products in detail to facilitate interpretation in the discussion. One of the government's efforts in eradicating the land mafia is to make regulations or technical instructions in this case the Ministry of Agrarian Affairs and Spatial Planning of the National Land Agency issued technical instructions Number 01/JUKNIS/D.VII/2018 concerning Prevention and Eradication of Land Mafia. In addition, the government's efforts through the National Land Agency to eradicate the land mafia are by filing good and correct land rights certificates. Archives have an important role for every agency or organization because the archive is evidence of the administrative track record for the agency or organization. Government Regulation No. 24 of 1997 concerning Land Registration which aims to provide legal certainty to the holders of rights to a parcel of land, housing units and other registered rights so that they can easily prove themselves as holders of the rights in question, to provide information to the parties concerned. interested parties including the Government so that they can easily obtain the data needed to carry out legal actions regarding registered land parcels and apartment units, for the orderly implementation of land administration. In order to protect the community as victims of the land mafia, in this case, of course, criminal sanctions are needed for land mafias who have violated the applicable laws and regulations. Criminal law enforcement is part of criminal politics (criminal policy) as one part of the overall crime prevention policy, indeed the implementation of criminal law is not the only hope to be able to resolve or overcome the crime completely.

Abstract

The buying and selling process using the PPJB structure in general must be followed by an act of submission clause, in this case physical and juridical delivery (jurische levering), where in a juridical handover this is carried out by signing and making AJB before the PPAT, as regulated in a Government Regulation No. 24 of 1997 concerning Land Registration. Therefore, if there is no AJB in the buying and selling process, then it cannot be said that there has been a juridical handover, so that even though PPJB has occurred, the physical and juridical handover has not occurred. Thus, from some of these things, it can be seen that between PPJB and the sale and purchase agreement there are fundamental differences, namely related to the movement of goods or objects, where in PPJB the transfer of new goods or objects occurs in the future, while in the case of the transfer of the goods or objects in the sale and purchase agreement occur at the same time (moves instantly from the seller to the buyer). In the concept of buying and selling land and/or buildings, the transfer of land rights only occurs after the signing of the AJB in the presence of the authorized official, namely PPAT. This research is descriptive analytical with the approach used is normative juridical. The data collected is then processed and analyzed qualitatively, using an inductive method to draw a conclusion

Abstract

Hukum Agraria Nasional tersusun secara konsptual ke dalam Undang-Undang Nomor 5 Tahun 1960 tentang Pokok-Pokok Agraria atau yang lebih dikenal dengan sebutan UUPA (Undang-Undang Pokok Agraria). Dari berbagai literatur diketahui bahwa sejarah lahirnya UUPA menceritakan riwayat panjang perjuangan para tokoh bangsa dalam memangkas ketidak-berpihakan hukum tanah bagi kepentingan masayarakat secara luas. Di era reformasi konsekwensi logis antara kebaradaan politik dengan kepentingan dan kepastian hukum khususnya menyangkut persoalan pertanahan menjadi sebuah trending topic tersendiri yang menarik untuk dibicarakan. Kompleksitas persoalan pertanahan di negeri ini kian meninggi dan rumit serta diperparah dengan gesekan kepentingan yang sarat akan nuasa poltik sehingga menyandra kepastian hukum atas persoalan pertanahan di negeri tercinta ini. Mulai dari persoalan ketimpangan penguasaan tanah dan sumber daya alam, eksploitasi sumber daya alam yang kurang memperhatikan hak-hak asasi rakyat, termasuk hak masyarakat adapt dan kelestarian lingkungan, alih fungsi lahan pertanian yang semakin tak terkendali, hinggs tata ruang yang tidak tuntas dan administrasi tanah yang kacau. Secara pragmatais kondisi ini diyakini akan menenggelamkan nilai paedagogis dari roh yang tertanam di dalam tubuh UUPA

Abstract

Tidak seimbangnya antara persediaan tanah dengan kebutuhan akan tanah otomatis akan menimbulkan permasalahan pertanahan sebagaimana dikemukakan di atas. Tidak jarang di atas tanah yang dimiliki atau dikuasai masih memunculkan orang bersengketa, baik antara pemilik dan bahkan yang bukan pemilik yang menginginkan tanah tersebut, maupun dengan pihak lain yang pernah merasakan bahwa tanah itu pernah menjadi miliknya,atau bahkan dengan pemerintah. Sengketa bisa muncul di akibatkan ketidak jelasan status kepemilikan tanah, penguasaan tanah secara ilegal dan lain sebagainya. Penelitian ini mempergunakan alat pengumpul data berupa studi kepustakaan/ studi dokumen. Berdasarkan Pasal 19 UUPA diperintahkan kepada pemerintah untuk mengadakan pendaftaran tanah diseluruh wilayah Republik Indonesia. Yang dimaksud dengan kewajiban mendaftarkan menurut Undang-undang Pokok Agraria (UUPA) adalah pertama, Penguluran, perpetaan dan pembukuan tanah; Kedua, Pendaftaran hak-hak atas tanah dan peralihan hak-hak tersebut dan Pemberian surat-surat tanah bukti hak yang berlaku sebagai alasan pembuktian yang kuat. Peraturan pendaftaran tanah untuk pertama kali dilaksanakan berdasar PP No. 10 Tahun 1961 tentang Pendaftaran Tanah, dan sejak 8 Oktober 1977 disempurnakan dengan PP No. 24 Tahun 1997. Pendaftaran tanah diberlakukan mulai tanggal 24 September 1961 berdasarkan Pasal 19 UUPA. Alasan diubahnya Peraturan Pemerintah Nomor 10 Tahun 1961 didasarkan kepada beberapa hal, seperti yang tersebut dalam konsiderans menimbang bahwa peningkatan Pembangunan Nasional yang berkelanjutan memerlukan jaminan kepastian hukum di bidang pertanahan; bahwa pendaftaran tanah yang penyelenggaraannya oleh UUPA ditugaskan kepada pemerintah merupakan sarana dalam memberikan jaminan kepastian hokum yang dimaksudkan; bahwa PP No 10 Tahun 1961 tentang Pendaftaran Tanah dipandang tidak dapat lagi sepenuhnya mendukung tercapainya hasil yang lebih nyata pada pembangunan nasional, sehingga perlu dilakukan penyempurnaan

Abstract

The BOT agreement is an agreement between the government and investors in terms of mastering and utilizing state assets in the form of land. This writing uses the normative juridical legal research method (normative research) with descriptive analytical research specifications that use secondary data. The procedure for collecting data is in the form of documentation of notes or quotations, search of legal literature, books and others related to the identification of problems both offline and online, which are then analyzed using a legal approach through content analysis method with a focus on the issue of how the application of the BOT principle in the cooperation agreement on development and management of Merdeka Field between Pemko Medan and the private sector? and what is the view of State Administrative Law and Business Law on the BOT agreement in the development and management of Merdeka Field between the Pemko Medan and the private sector ?. From the results of the study it is known that the cooperation agreement between Pemko Medan and the Private Party has implemented the BOT principle by fulfilling the elements of building, managing and submitting the results of development and management by the Investor to Pemko Medan. Furthermore, the said BOT agreement is viewed from the State Administrative Law, an official act of the State administration that has dimensions of public law and private law. Whereas in the view of Business Law the BOT agreement must equally benefit both parties who make the agreement.

Abstract

Land issues are not only related to land disputes, conflicts and cases, but are also related to gaps in land tenure and land conversion which are considered to be inhibiting factors in achieving land as the greatest source of people's prosperity. Arranging access to capital after land redistribution within the framework of agrarian reform is one of the government's steps to address the issue of land management in Indonesia which will be studied from an Islamic perspective. This study uses a normative legal research method using secondary data which is analyzed through content analysis with a statua approach. The results showed that the aspect of post-land redistribution capital has a correlation with economic activity in the view of Islam as a whole, which aims to: meet one's basic needs, meet family needs, meet long-term needs, provide for the needs of abandoned families, provide social assistance and donations in the way of Allah SWT. The fundamental value of Islamic teachings regarding the post-land redistribution capital aspect as stated above is in line with the basic nature of agrarian reform activities in Indonesia which are characterized by democracy, social justice for land. Arrangement of access to capital after land redistribution is a form of continuity and equality between asset arrangement in the form of equal distribution of land ownership and access arrangement in the form of community empowerment to access capital based on land rights so as to realize community welfare.

Abstract

Tujuan dilaksanakannya Program Kemitraan Pengembangan Muhammadiyah (PKPM) ini adalah selain untuk melaksanakan salah satu unsur dari tri dharma perguruan tinggi, maka program ini dilakukan untuk menjawab permintaan masyarakat terutama warga persarikatan muhammadiyah, khususnya P  e  m  u  d  a  Muhammadiyah kota medan untuk melakukan Kegiatan yang bertemakan Peran Pemuda Muhammadiyah Kota Medan Dalam Penanggulangan Mafia Tanah. Target khusus yang ingin dicapai dari kegiatan program ini adalah: 1) Pemuda Muhammadiyah memiliki peran penting sebagai organisasi ke Islaman untuk mengetahui tentang mafia tanah khususnya di Kota Medan  ; 2) Pemuda Muhammadiyah Kota Medan dapat memberi pengetahuan kepada masyarakat tentang modus operandi mafia tanah ; 3) Pemuda Muhammadiyah Kota Medan sebagai Organisasi Keislaman untuk melakukan penanggulangan mafia tanah khususnya di Kota Medan. Metode yang digunakan adalah dengan mengadakan penyuluhan, tanya jawab, diskusi, penugasan dan praktik langsung. Kemudian metode pendekatan lain yang digunakan dalam kegiatan ini adalah pendekatan partisipatif (partisipatory approach). Tahap pelaksanaan program ini dimulai dari persiapan program, pelaksanaan program, dan evaluasi program. Hasil penelitian ini dapat menjadi rujukan dalam mengetahui modus operandi mafia tanah, dan juga sebagai bahan pengembangan literasi tentang penanggulangan mafia tanah

Abstract

The implementation of Presidential Decree No. 62 of 2023 has substantively attempted to integrate several regulations at technically applicable level; however, on the other hand, it still raises several problems, particularly in relation to the provision of land for agrarian reform objects, land originating from forest areas. This study aimed to analyze the implementation of Presidentialial Decree No.   62 of 2023 as the latest regulation regarding the acceleration of agrarian reform activities in Indonesia as an effort to recognize that land is the greatest source of wealth for people as ordered by the constitution. To analyze the problem, the method used is type study law normative. One of the factors inhibiting agrarian reform from seeming slow in creating just and prosperous land is the dis-harmonization of regulations, that cause legal gaps. The method used is normative legal research with a statutory regulation approach. The sectoral egos and legal gaps can be put aside and released to joint policies between related institutions, and agrarian reform can achieve its main essence; namely making land a source of the greatest prosperity for people. The results show that regulatory disharmony has narrowed the space for implementing agrarian reform. The advice given in this paper is to create an acceleration of agrarian reform that is right on target in accordance with the targets set, all implementing stakeholders must comply with the norms set out in the Presidential Decree in question. Thus, it is feared that Presidential Decree No. 62 of 2023 will become a regulatory distortion, even though its implementation aimed to provide a regulatory solution in the context of accelerating agrarian reform in Indonesia.
