Abstract

The case of PT Rafi Kamajaya Abadi (RKA) has been in the public spotlight due to alleged negligence that caused forest and land fires (karhutla) covering 2,560 hectares in West Kalimantan Province. These fires not only impacted the ecosystem, but also public health and economic activity. In this case, the Supreme Court (MA) sentenced PT Rafi Kamajaya Abadi (RKA) to pay compensation of Rp920 billion as well as environmental recovery measures. This research aims to examine the role and responsibility of PT Rafi Kamajaya Abadi (RKA) in the environmental damage done by the company through forest and land fires, and how it is applied in commercial law, especially related to corporate obligations in managing the environment. This research will analyze how the principles of corporate law are applied in the context of environmental damage caused by PT Rafi Kamajaya Abadi (RKA). In addition, this research will highlight the impact of court decisions on trade and economic relations, as well as how environmental law enforcement in the commercial sector, especially in ensuring that companies do not only focus on economic profit, but also have a great responsibility in maintaining environmental sustainability. Kasus PT. Rafi Kamajaya Abadi (RKA) menjadi sorotan publik karena diduga melakukan kelalaian yang menyebabkan kebakaran hutan dan lahan (karhutla) seluas 2.560 hektar di Provinsi Kalimantan Barat. Kebakaran ini tidak hanya memberi dampak terhadap ekosistem, tetapi juga kesehatan masyarakat serta aktivitas ekonomi. Dalam kasus ini, Mahkamah Agung (MA) memberikan hukuman kepada PT Rafi Kamajaya Abadi (RKA) membayar ganti rugi senilai Rp920 Miliar serta tindakan pemulihan lingkungan hidup. Penelitian ini bertujuan untuk mengkaji peran dan tanggungjawab PT. Rafi Kamajaya Abadi (RKA) dalam kerusakan lingkungan yang dilakukan oleh perusahaan tersebut melalui kebakaran hutan dan lahan, serta bagaimana penerapannya dalam hukum dagang, terutama terkait kewajiban korporasi dalam mengelola lingkungan. Penelitian ini akan menganalisis bagaimana prinsip hukum korporasi yang diterapkan dalam konteks kerusakan lingkungan yang diakibatkan oleh PT Rafi Kamajaya Abadi (RKA). Selain itu, penelitian ini akan menyoroti dampak putusan pengadilan terhadap hubungan dagang dan ekonomi, serta bagaimana penegakan hukum lingkungan di sektor komersial, terutama dalam memastikan bahwa perusahaan tidak hanya berfokus pada keuntungan ekonomi, tetapi juga memiliki tanggung jawab besar dalam menjaga keberlanjutan lingkungan.

Abstract

Unnamed agreements are a form of contract that are not specifically regulated by law but are valid if they meet the general requirements of an agreement. This paper discusses the concept, characteristics, and application of leasing agreements as one form of unnamed contracts. The case study used analyzes the relationship between the lessor and lessee in a leasing agreement, starting from the identification of key components, the impact of implementation on rights and obligations, to dispute resolution mechanisms. The analysis results show that leasing agreements provide legal flexibility to meet business needs without disregarding the principles of freedom of contract and good faith. However, vague provisions in the contract can trigger disputes. Therefore, this paper recommends the drafting of comprehensive contracts and the strengthening of related regulations to create legal certainty and protection for the parties involved. Perjanjian tidak bernama adalah bentuk kontrak yang tidak diatur secara spesifik dalam undang-undang, tetapi sah jika memenuhi syarat umum perjanjian. Makalah ini membahas konsep, karakteristik, dan penerapan perjanjian leasing sebagai salah satu bentuk perjanjian tidak bernama. Studi kasus yang digunakan menganalisis hubungan antara lessor dan lessee dalam perjanjian leasing, mulai dari identifikasi komponen utama, dampak implementasi terhadap hak dan kewajiban, hingga mekanisme penyelesaian sengketa. Hasil analisis menunjukkan bahwa perjanjian leasing memberikan fleksibilitas hukum untuk memenuhi kebutuhan bisnis tanpa mengesampingkan asas kebebasan berkontrak dan itikad baik. Namun, pengaturan yang tidak rinci dalam kontrak dapat memicu sengketa. Oleh karena itu, makalah ini merekomendasikan penyusunan kontrak yang komprehensif serta penguatan regulasi terkait untuk menciptakan kepastian hukum dan perlindungan bagi para pihak.

Abstract

Horticulture is one of the potentials in Cilobak land. The target partners at the location are residents who work at home, unemployed, and kids. Community empowerment in Cilobak land, Cinere Subdistrict, Depok City is motivated by the low understanding of horticulture so that there is a land vacancy which results in new problems, such as land abuse and disruption of aesthetic value. The misuse of land in question includes the use of land as a location for crime, immoral acts, and garbage disposal. This community empowerment aims to increase residents' awareness, skills, and knowledge about land conversion so that related problems can be resolved. In addition, the conversion of land into a horticultural garden can also improve the economy of residents through land productivity. The output target of this activity is to increase knowledge and skills, awareness, and motivate target partners in utilizing vacant land for horticultural gardening both in conventional and hydroponic media. The participatory method was used to actively involve partners in the implementation of horticultural training. The results of the activities that have been carried out include training in horticultural planting methods and techniques from seeding, knowledge of planting media, fertilizers, plant nutrition, pests, and plant diseases to production methods so that they can generate economic value and help food security at home. The community service program that has been implemented helps target partners solve problems and increase the productivity of target partners.
