Abstract

The increase in the establishment of minimarkets has implications for micro and small business actors, including owners of grocery stores and stalls that sell goods similar to minimarkets. Whereas this business sector is the largest in contributing to the Indonesian national economy. One of the factors causing the increase in the establishment of minimarkets is the regulation made by the government in the form of laws, government regulations, presidential regulations and ministerial regulations that provide convenience in the establishment of minimarkets. Therefore, it is necessary to have legal arrangements in regulating the increase in the establishment of minimarkets in order to protect micro and small businesses. This Journal writing uses normative legal research methods using primary legal materials and secondary data obtained through library data. The results showed that there was an impact of the existence of minimarket outlets on the income of retail traders and grocery stores experiencing changes in income. the traders experienced a decrease in turnover and the amount of income per day. The implication becomes the basis for the formation of the concept of new rules in maintaining business balance as an effort to protect the business actors of Grocery Stores and Stalls from the rampant establishment of Minimarket in the form of a review of the articles related to the existence of Minimarket adjacent to residential areas and fill the legal vacuum related to the distance setting of Minimarket establishment with other Minimarket as well as restrictions on granting business licenses, setting working hours and setting administrative sanctions.

Abstract

Everyone has the right to physical and spiritual well-being, a place to live, and a good and healthy living environment. In Indonesia, this is regulated in the 1945 Constitution of the Republic of Indonesia (hereinafter referred to as the 1945 Constitution of the Republic of Indonesia) and regulated in Article 28 Paragraph H (1) of the 1945 Constitution of the Republic of Indonesia. In this research, the approach used is normative juridical or doctrinal , legal research carried out by examining library materials or secondary data as basic material for research by conducting searches on regulations related to the issues discussed. Then the problem that is analyzed and studied is the role and obstacles of the regional government in implementing infrastructure, facilities and public works for housing and residential areas in the Organ Komering Ilir area. Results: In managing infrastructure, facilities and public services in Ogan Komering Ilir Regency, the role of local government is very important. The Ogan Komering Ilir Regent's government, through the Public Housing and Settlement Service, is tasked with implementing infrastructure, facilities and public services to support the function of settlements to ensure the welfare and comfort of the people who live in Ogan Komering Ilir Regency. Then there are challenges and obstacles in the process of transferring public infrastructure and facilities from the developer to the Ogan Komering Ilir Regent Government. Although existing, sustainable and reliable management must be maintained to ensure sustainability, challenges and obstacles still remain in the provision of public infrastructure and facilities. Budget and human resources in managing housing infrastructure, equipment and public services are limited. This can affect the quality and quantity of services provided by local governments. To overcome these obstacles, planned and coordinated efforts are needed from local governments, real estate developers and local communities..Keywords: role; obstacl; facilities; housing public works; residential area.

Abstract

As a country governed by the rule of law, Indonesia upholds the principle of legal supremacy, requiring both citizens and government officials to comply with applicable laws. This study examines the resolution of civil cases through mediation, focusing on Civil Case Number 72/Pdt.Plg/2023 at the Class 1A Palembang District Court, and analyzes the factors influencing the plaintiff’s and defendant’s decisions to accept or reject mediation. This research employs a normative method with a qualitative approach, relying on secondary data. The findings indicate that, despite an initial willingness to resolve the dispute amicably, challenges such as differences in family perspectives and a lack of understanding of the mediation process hindered its success. Consequently, the plaintiff withdrew the lawsuit, and the case was ultimately resolved through litigation, resulting in a court ruling granting all claims, including immaterial compensation of IDR 100,000,000. Several factors influenced the parties’ decisions, including legal considerations, the role of judges and mediators, infrastructure limitations, community attitudes, and the prevailing legal culture.

Abstract

Putusan pengadilan dalam sengketa kekayaan intelektual tidak hanya berperan sebagai penyelesaian hukum, tetapi juga mencerminkan nilai-nilai asas keadilan yang menjadi dasar sistem hukum di Indonesia. Penelitian ini bertujuan untuk menganalisis relevansi asas keadilan dalam penyelesaian sengketa kekayaan intelektual, dengan fokus pada studi kasus Putusan Nomor 465K/Pdt.Sus-HKI/2024/PN.Jkt.Pst.Metode penelitian yang digunakan adalah pendekatan yuridis normatif dengan analisis putusan pengadilan sebagai objek utama. Data dikumpulkan melalui studi literatur, dokumen hukum, dan analisis yurisprudensi terkait kekayaan intelektual. Penelitian ini membahas bagaimana asas keadilan diimplementasikan dalam pertimbangan hukum hakim, serta dampaknya terhadap perlindungan hak-hak para pihak yang terlibat.Hasil penelitian menunjukkan bahwa asas keadilan telah menjadi prinsip utama dalam putusan tersebut, terutama dalam penyeimbangan hak dan kewajiban para pihak. Namun, terdapat beberapa aspek yang memerlukan perhatian lebih dalam penguatan penerapan asas keadilan, seperti konsistensi argumentasi hukum dan perlindungan terhadap pihak yang lebih lemah. Penelitian ini diharapkan dapat memberikan kontribusi bagi pengembangan hukum kekayaan intelektual yang lebih adil dan merata di Indonesia.

Abstract

Pencatatan perkawinan sesuai dengan ketentuan UU No. 1 Tahun 1974 Pasal 2 Ayat (2) bertujuan untuk menjamin ketertiban perkawinan dan kepastian hukum bagi masyarakat. Akta Nikah sebagai Akta Otentik memiliki kekuatan pembuktian sempurna. Namun, dalam putusan Nomor 105/Pdt.G/2024/PA.Lt, Akta Otentik mengalami retrogesi atau penurunan nilai pembuktian. Penelitian ini mengkaji faktor penyebab retrogesi serta pertimbangan Majelis Hakim. Dengan pendekatan yuridis normatif yang didukung data empiris, hasil penelitian menunjukkan bahwa keberatan serta bukti lawan yang setara dan sempurna dapat menggoyahkan eksistensi Akta Otentik, sehingga menurunkan nilai pembuktiannya menjadi bukti permulaan atau setara dengan akta di bawah tangan.

Abstract

This study aims to analyze leasing agreements from a civil law perspective, focusing on the application of the principle of freedom of contract and the principle of justice. As an innominate agreement, leasing is generally set out in standard clauses determined unilaterally by the financing company, thereby creating an imbalance in the legal position between the lessor and the lessee. Although normatively valid under Article 1338 of the Civil Code, the practice of such contracts does not always reflect fairness, as they often contain unilateral clauses that are detrimental to the lessee. Using normative juridical methods and qualitative analysis, this study shows that the principle of freedom of contract must be interpreted in a limited manner and corrected by the principles of fairness, propriety, and protection of the weaker party. Therefore, modern civil law needs to be oriented not only towards formal legality, but also towards substantive justice that is capable of balancing the rights and obligations of the parties in a leasing agreement.
