Abstract

This study aims to analyze the role of inclusive education in increasing access to education and improving the quality of educational services for Children with Special Needs (ABK) as mandated by the Minister of National Education Number 70 of 2009. This research uses a descriptive-analytical method with a case study approach at SD Sains Al Biruni Bandung, the first inclusion school in Bandung. The focus of this study is on community participation, which includes the involvement of parents and accompanying teachers who are directly related to Children with Special Needs (ABK). The results showed that parental involvement and support could be seen in the admission process of new students to school at the time of identification from the Psychologist. The school supports through accompanying teachers who contribute significantly and inform the student activities through a daily report book. The openness of schools in terms of inclusive education plays an essential role in inclusion education. Penelitian ini bertujuan untuk menganalisis peran pendidikan inklusi untuk meningkatkan akses pendidikan dan meningkatkan mutu layanan pendidikan bagi Anak Berkebutuhan Khusus (ABK) sebagaimana amanat dari Permendiknas Nomor 70 tahun 2009. Penelitian ini menggunakan metode deskriptif analitis dengan pendekatan studi kasus di SD Sains Al Biruni Bandung sebagai sekolah inklusi pertama di kota Bandung. Hasil penelitian menunjukkan bahwa: Pertama, peran serta dan dukungan orang tua dapat terlihat pada proses penerimaan siswa baru di sekolah pada saat identifikasi dari Psikolog. Kedua, adanya dukungan sekolah melalui guru pendamping memberikan kontribusi besar serta informasi mengenai aktivitas siswa melalui buku laporan harian. Ketiga, keterbukaan sekolah dalam hal pendidikan inklusi merupakan peran penting terhadap pendidikan inklusi. Adapun fokus dari penelitian ini adalah pada aspek partisipasi masyarakat yang meliputi partisipasi orang tua dan guru pendamping yang berhubungan secara langsung dengan Anak Berkebutuhan Khusus (ABK).

Abstract

During economic crises, where companies are forced to lower their operating costs, layoffs are a frequent problem. Using a normative approach, this study aims to analyze policies related to termination of employment (PHK) in Indonesia. This study examines the conformity of termination policies with applicable regulations, such as the Manpower Law and other relevant regulations, as well as the principle of fairness for employers and workers. Layoffs are often the last resort in economic crisis situations, but they often cause conflicts of interest between companies and workers. The study found that the termination of employment policy (PHK) must be implemented for clear reasons and in accordance with legal procedures. In addition, they must consider the balance between business continuity and the protection of workers' rights.

Abstract

Increasing the quality of production power and the level of welfare of the Indonesian people by focusing on labor is still ongoing, the government is implementing Law Number 3 of 1992 concerning Social Security for Workers with regulations regarding protection for workers in order to reduce the possibility of reduction to the loss of the ability to work and labor income due to the possibility of illness, disability, accidents and even death. Then, with the implementation of this social security program for workers, what is its role in the development of the complete workforce and the comprehensive development of Indonesian society as a form of embodiment of the development of labor law in Indonesia. The role of social security for workers in realizing the development of labor law in Indonesia is considered very crucial as mentioned in a normativejuridical research, the role of social security is very crucial, in order to achieve the objectives of this program, there must be increased understanding of the benefits of social security as well as expanding access for all workers, including workers in the informal sector. Apart from that, this program also acts as a manifestation of legal certainty to create stability in work relations which creates the realization of higher quality legal development in Indonesia.

Abstract

Unilateral Termination of Employment (PHK) is one of the problems that often arise in industrial relations in Indonesia. Unilateral layoffs occur when one of the parties, both employers and workers, terminates the employment relationship without going through a mutual agreement or without a valid reason in accordance with the provisions of the law. The unilateral layoff process is regulated in Law Number 13 of 2003 concerning Manpower, which provides protection to workers, both in its implementation procedures and the rights that must be given. Even so, the implementation of unilateral layoffs often causes disputes between workers and employers. Therefore, the resolution of unilateral layoff disputes can be carried out through mediation, conciliation, or arbitration, which is regulated in Law No. 2 of 2004 concerning Industrial Relations Dispute Resolution. . This study aims to examine the procedure for unilateral layoffs, workers' rights in unilateral layoffs, and the mechanism for resolving unilateral layoff disputes in accordance with applicable laws in Indonesia.

Abstract

The employment agreement is the legal basis that regulates the relationship between employers and employees in the world of employment. In this context, protecting employee rights is crucial to ensuring welfare and justice in the workplace. This article aims to analyze employment agreements from a labor law perspective, with a focus on the aspect of protecting employee rights. Through a normative approach, this research explores various regulations governing employment agreements, including employment law and company regulations. In addition, this article discusses the challenges faced in implementing the protection of employee rights, such as unfairness in employment agreements and lack of law enforcement. The research results show the importance of collaborative efforts between governments, employers and labor unions to create a fair and sustainable work environment. The conclusions of this study emphasize the need for more comprehensive labor policy reform to protect employee rights and strengthen harmonious industrial relations.

Abstract

The issue of paying overtime wages is an important issue in Indonesian employment that is often ignored by companies, including in the case of PT SAI Apparel Industries. This article analyzes alleged violations of overtime pay committed by companies against their employees using a juridical and normative approach. Based on statutory regulations, in particular Article 78 paragraph (2) and Article 85 of the Manpower Law and PP Number 35 of 2021, companies are obliged to pay overtime wages in accordance with applicable regulations. However, it was found that PT SAI Apparel Industries did not record overtime hours properly and did not pay compensation in full, violating workers' rights to a living wage. These violations not only impact workers' welfare but also cause dissatisfaction and have the potential to lead to industrial conflicts. To resolve this case, steps such as mediation through the Manpower Service, filing a lawsuit with the Industrial Relations Court, and strict supervision by the government are proposed as solutions. In addition, companies need to increase transparency in working time management and ensure compliance with regulations. Enforcing workers' rights to overtime pay is a crucial step in building harmonious industrial relations and creating justice for both parties.

Abstract

PHK yang dilakukan tanpa memperhatikan perspektif pekerja secara signifikan mempengaruhi kesehatan mental. Mengamati peristiwa sosial, jelas bahwa mendapatkan pekerjaan tidak semudah yang terlihat bagi banyak pekerja. Persaingan yang semakin ketat, tenaga kerja yang terus berkembang, dan kondisi yang tidak stabil di lingkungan korporat telah menimbulkan kekhawatiran mengenai kemungkinan pemecatan. Metode penelitian yang digunakan adalah yuridis normatif, dengan data sekunder yang mencakup bahan primer, sekunder, dan tersier. Pendekatan penelitian meliputi perundang-undangan, konseptual, analitis, dan kasus, dengan teknik pengumpulan data melalui identifikasi dan inventarisasi aturan hukum serta literatur terkait. Analisis dilakukan dengan penafsiran gramatikal dan sistematis. Pemutusan hubungan kerja (PHK) diatur dalam berbagai peraturan hukum, seperti Pasal 158 ayat (1) Undang-Undang No. 13 Tahun 2003 dan Pasal 43 ayat (2) Peraturan Pemerintah No. 35 Tahun 2021, yang memperbolehkan PHK dengan alasan kerugian perusahaan, namun tidak boleh dilakukan sembarangan. PHK hanya dapat dilakukan jika perusahaan mengalami kerugian selama dua tahun berturut-turut dan harus dibuktikan dengan laporan keuangan yang sah. Selain itu, perlindungan bagi pekerja diatur dalam Pasal 153 UU Ketenagakerjaan, yang melarang pemutusan hubungan kerja atas dasar tertentu, memastikan tindakan pengusaha tidak sewenang-wenang. PHK harus diakui oleh Pengadilan Hubungan Industrial (PHI), dan pekerja berhak atas kompensasi seperti pesangon, penghargaan masa kerja (UPMK), dan uang pengganti (UPH) yang dihitung berdasarkan masa kerja dan alasan PHK.

Abstract

Serikat pekerja memainkan peran penting dalam penegakan hukum ketenagakerjaan di Indonesia, termasuk pengawasan, advokasi, dan mediasi. Penelitian ini bertujuan menganalisis peran tersebut dan mengidentifikasi kendala yang dihadapi, seperti hambatan regulasi, lemahnya kapasitas organisasi, dan resistensi pengusaha. Dengan metode kualitatif berbasis studi literatur dan analisis hukum, penelitian ini merekomendasikan penguatan kapasitas serikat pekerja, kolaborasi lintas lembaga, serta perbaikan regulasi sebagai strategi untuk meningkatkan efektivitas peran serikat pekerja.

Abstract

Legal protection for employment contracts for truck drivers is a crucial element in safeguarding the rights of workers within the transportation sector. This article examines the challenges and opportunities associated with the implementation of employment agreements in accordance with relevant legislation, including Law No. 13 of 2003 on Manpower.  The findings reveal that a significant number of truck drivers operate without written employment agreements, which exposes them to various rights violations, such as inadequate wages, insufficient social security, and excessive working hours. Furthermore, existing protections for occupational safety and compensation in the event of accidents are notably lacking. This study recommends policy enhancements that include the requirement for companies to establish written employment contracts, register employees with the Employment Social Security Agency (BPJS Ketenagakerjaan), and ensure equitable wages and working conditions. Adopting these measures is expected to foster a more just and productive working relationship for truck drivers.
