Abstract

This study aims to analyze the role of inclusive education in increasing access to education and improving the quality of educational services for Children with Special Needs (ABK) as mandated by the Minister of National Education Number 70 of 2009. This research uses a descriptive-analytical method with a case study approach at SD Sains Al Biruni Bandung, the first inclusion school in Bandung. The focus of this study is on community participation, which includes the involvement of parents and accompanying teachers who are directly related to Children with Special Needs (ABK). The results showed that parental involvement and support could be seen in the admission process of new students to school at the time of identification from the Psychologist. The school supports through accompanying teachers who contribute significantly and inform the student activities through a daily report book. The openness of schools in terms of inclusive education plays an essential role in inclusion education. Penelitian ini bertujuan untuk menganalisis peran pendidikan inklusi untuk meningkatkan akses pendidikan dan meningkatkan mutu layanan pendidikan bagi Anak Berkebutuhan Khusus (ABK) sebagaimana amanat dari Permendiknas Nomor 70 tahun 2009. Penelitian ini menggunakan metode deskriptif analitis dengan pendekatan studi kasus di SD Sains Al Biruni Bandung sebagai sekolah inklusi pertama di kota Bandung. Hasil penelitian menunjukkan bahwa: Pertama, peran serta dan dukungan orang tua dapat terlihat pada proses penerimaan siswa baru di sekolah pada saat identifikasi dari Psikolog. Kedua, adanya dukungan sekolah melalui guru pendamping memberikan kontribusi besar serta informasi mengenai aktivitas siswa melalui buku laporan harian. Ketiga, keterbukaan sekolah dalam hal pendidikan inklusi merupakan peran penting terhadap pendidikan inklusi. Adapun fokus dari penelitian ini adalah pada aspek partisipasi masyarakat yang meliputi partisipasi orang tua dan guru pendamping yang berhubungan secara langsung dengan Anak Berkebutuhan Khusus (ABK).

Abstract

Increasingly advanced technology does not always have a positive impact, sometimes it has a negative impact. This is like a widespread case because of the development of the Shopee marketplace which provides Cash On Delivery services) which, instead of benefiting the seller, is detrimental. This loss is not the responsibility of Shopee, but the seller itself. However, there is relevance to positive laws and regulations in Indonesia that can resolve this case. This study's goal is to determine the type of legal protection available to seller viewed from the Consumer Protection Act, the ITE Law, and the Civil Code and to find out Shopee's responsibility in protecting sellers who lose money because of the COD service. A technique to study called normative juridical is applied. The approach used is the legal approach. The data collection technique used is literature study. The data and data sources used come from secondary data, namely research journals, laws, and electronic sources that can be accounted for. The results and analysis of this study are that the regulations contain Law no. 8 of 1999 concerning Consumer Protection Articles 5, 6, 7, 34 and 45; Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions Article 45A; and the Civil Code Articles 1513, 1514, 1517, 1243, and 1267. Then, efforts to resolve this case can be done either through or outside the court and the seller activates the shipping insurance provided by Shopee.

Abstract

The Indonesian Ulema Council should maintain professionalism and independence when providing halal certification to ensure that the needs of Muslim consumers are met in accordance with religious teachings. Objectivity should be prioritized to avoid any subjective evaluations. The purpose of this research was to investigate the mechanism for issuing halal guarantee certification in the Processed Food Industry in West Java. Additionally, the study aimed to examine the application of the principles of independence and professionalism of the Indonesian Ulema Council in issuing Halal Guarantee Certification. The methodology employed in this research involved a qualitative approach through field research. The process for obtaining halal assurance certification starts when the Company provides written confirmation that it intends to implement SJH in accordance with the rules outlined by LPPOM MUI. Independence is not just determined by the organizational structure of an institution; expertise, field data, and appearance must also be considered. The Indonesian Ulema Council's application of the Professionalism principle in granting Halal Guarantee Certification to the food processing industry in West Java is evident in its product assessment methods. The Council has effectively coordinated with LPPOM to carry out the process appropriately and efficiently. Majelis Ulama Indonesia senantiasa dituntut untuk menjunjung profesionalisme dan independensi dalam pemberian penetapan halal agar kebutuhan konsumen muslim dapat tetap terjaga dari hal-hal yang diharamkan menurut ajaran agama. Penelitian dilakukan untuk mengetahui mekanisme penerbitan sertifikasi jaminan halal pada Industri Olahan Makanan di Jawa Barat; serta penerapan prinsip independensi dan profesionalisme Majelis Ulama Indonesia dalam menerbitkan Sertifikasi Jaminan Halal. Penelitian ini merupakan penelitian lapangan (field research) dengan pendekatan kualitatif. Mekanisme penerbitan sertifikasi jaminan halal diawali dengan Perusahaan menyatakan secara tertulis tujuan penerapan SJH di perusahaannya sesuai dengan aturan yang telah digariskan oleh LPPOM MUI. Aspek independensi tidak hanya dilihat dari kemandirian dalam penyelenggaraan suatu lembaga saja, jauh dari itu pertimbangan keahlian, data lapangan dan juga penampilan harus menjadi tolak ukur utama. Penerapan prinsip Profesionalisme Majelis Ulama Indonesia dalam menerbitkan Sertifikasi Jaminan Halal pada industri makanan olahan di Jawa Barat dapat dilihat pada metode pengkajian produk industri olahan makanan. Majelis Ulama Indonesia telah mampu melaksanakan koordinasi yang baik dan tepat dengan memberikan peran ini pada LPPOM.
