Abstract

The absence of special arrangements regarding customary law has the potential to cause inferiority in the position of customary law compared to the substance of national law in customary disputes relating to natural resources. This study seeks to analyze and formulate the idea of ​​resolving customary disputes over the management of natural resources in a progressive legal perspective to achieve justice. The results of the study confirmed that the problems of customary disputes related to the management of natural resources, especially those that occurred in the territories of indigenous peoples, made the position of customary law weaker compared to national law. This happens because regulations regarding indigenous peoples have not been ratified. Legal efforts to settle natural resource customary disputes to achieve justice in a progressive legal perspective need to be regulated through the establishment of a Perppu (Government Regulation in Lieu of Law) to facilitate the position of customary law in resolving customary disputes in the field of natural resource management. In the Perppu, it is hoped that there will be confirmation regarding the enactment of the conception of legal pluralism so that customary law has an equal position with national law in customary disputes over natural resource management.

Abstract

Minuman beralkohol selain bertentangan dengan norma agama dan jiwa bangsa Indonesia yang religious, juga telah terbukti menelan korban jiwa yang jumlahnya tidak sedikit. Jenis penelitian ini adalah yuridis normatif Adapun hasil penelitian ini adalah Untuk mengantisipasi dan atau menanggulangi penyalahgunaan peredaran minuman beralkohol Pemerintah Daerah wajib mengadakan Penertiban secara terprogram dan berkelanjutan yakni membentuk tim terpadu yang terdiri atas unsur : a. POLRI; b. TNI; c. Polisi Pamong Praja; d. Dinas Kesehatan; e. Dinas Koperasi Perindustrian dan Perdagangan; f. Bagian Hukum; g. Organisasi Keagamaan dan Organisasi Masyarakat; dan h. Unsur lain yang dianggap perlu. Tim dikordinasikan oleh Organisasi Perangkat Daerah yang bertanggung jawab dalam penegakan Peraturan Daerah.Pemerintah Daerah wajib melakukan pembinaan dan pengawasan dalam rangka penanggulangan bahaya mengkonsumsi minuman beralkohol yang mengandung unsur memabukkan dalam hal ini Dinas Kesehatan ditunjuk dan bertanggung jawab terhadap pembinaan dan pengawasan tersebut. Pembinaan dan pengawasan dilakukan dalam bentuk antara lain : a. Penyuluhan mengenai bahaya mengkonsumsi minuman yang beralkohol; b. Pembinaan dan pengawasan terhadap Pengelola Hotel, Restoran, Pub dan Café yang memperoleh izin serta kawasan khusus; dan c. Rehabilitasi terhadap korban pecandu. Pembinaan dan pengawasan, oleh Dinas Kesehatan dapat membentuk tim pembinaan yang ditetapkan dengan Keputusan Bupati. Pembinaan dan pengawasan melibatkan unsur-unsur terkait.

Abstract

Elections constitute a fundamental manifestation of democracy, serving as a crucial mechanism connecting candidates and voters. However, electoral contests continue to be undermined by violations, particularly money politics and political dowries. Article 228 explicitly prohibits the giving and receiving of political dowries in the nomination of presidential and vice-presidential candidates, yet the practice of vote-buying through money or goods persists and has increasingly become embedded as a political culture. This phenomenon threatens democratic integrity, weakens clean governance, and undermines the realization of fair elections. This study examines campaign finance regulation as a preventive legal policy against money politics practices. Employing a normative juridical research method, the study relies on primary and secondary legal materials through a statute approach and a comparative approach. The statute approach is conducted by analyzing the regulatory framework governing campaign finance, criminal provisions, and law enforcement mechanisms related to electoral violations. Meanwhile, the comparative approach is carried out through a micro-level examination of campaign finance limitation policies in the United States in order to construct a preventive model applicable within the Indonesian context. Using deductive legal reasoning and legal syllogism, the research positions legal norms as the major premise and correlates them with relevant legal facts to formulate conclusions. The findings indicate that limiting campaign funds serves as a strategic instrument to reduce excessive monetary influence in politics. Strengthening contribution limits, transparency mechanisms, and law enforcement is therefore essential to prevent money politics and safeguard electoral integrity and democratic accountability.
