Abstract

This study examines the effectiveness of madrasah principal leadership in improving teacher performance at MTs Al-Azhar Teluk Sentosa, addressing issues of teacher absenteeism, mismatched subject assignments, and suboptimal teaching quality. Using a qualitative descriptive approach, data were collected through observation, interviews (with 1 principal, 3 vice principals, and 3 teachers), and documentation at Jl. Besar Ajamu, Teluk Sentosa Village. Findings reveal that democratic leadership fostering collegial relationships significantly enhances teacher performance. While persistent challenges remain (including tardiness and qualification mismatches), regular training and supervision by the principal have effectively mitigated these issues. The study uniquely demonstrates how democratic leadership in rural Indonesian madrasahs creates familial work environments that improve performance despite resource constraints. Results suggest that school leaders should: (1) adopt participatory decision-making, (2) implement ongoing teacher mentoring programs, and (3) maintain consistent supervision to address performance gaps. This research provides a model for balancing authoritative guidance with collaborative leadership in Islamic educational institutions, offering actionable strategies for under-resourced settings.

Abstract

Indonesian people generally buy private vehicles by using credit facilities or making monthly payments to finance companies to own their vehicles. Vehicles purchased on credit are bound by using fiduciary guarantees prone to being pawned, rented out and transferred by the debtor unilaterally. The reason was due to default so that the fiduciary guarantee vehicle was diverted so that it could be confiscated by POLRI investigators to be used as evidence. As a result of the unilateral transfer of the debtor, the creditor suffers a loss, so that the creditor must be legally protected. The purpose of this research is to find out and analyze the legal protection for credit related to violations and diversion of vehicles based on the principle of justice. The method in this research is qualitative research with empirical and normative juridical approaches. Empirical juridical research prioritizes secondary data, books, laws and regulations and examines positive legal principles from literary data and comparative law. The fiduciary giver must be responsible, carry out his obligations and keep the collateral object under his control. However, in reality it does not rule out the possibility of the Fiduciary Guarantee object changing hands or transferring control to a third party because it is transferred by the debtor, usually due to economic factors. The existence of Law no. 42 of 1999 concerning guarantees in Indonesia which are lex specialis derogat legi general, is one of the legal principles which implies that specific legal rules will override general legal rules.

Abstract

The Mortgage Loan Agreement (Kredit Pemilikan Rumah/KPR) in Indonesia is one of the central components in banking financing activities, which carries substantial economic and commercial value. Within the KPR process, the use of an authentic deed is indispensable. The validity of an authentic KPR deed signed without the presence of a Notary/PPAT constitutes a violation of the professional code of ethics and an unlawful act. This journal research employs a normative legal research method, which positions law as a structure and system of norms, using primary legal materials such as statutes and regulations, secondary materials such as books and journals, and tertiary materials including manuals and explanatory documents related to the primary and secondary sources. The findings show that a KPR deed signed without the Notary’s presence loses its authentic character and is downgraded to a private deed, thereby losing its perfect evidentiary value (volledig bewijs). This condition weakens the legal position of the bank as creditor in collection and collateral execution, increases the risk of disputes with debtors, and reduces legal certainty for all related parties. A Notary/PPAT who fails to ensure compliance with formal procedures may be held civilly liable based on Articles 1365 and 1366 of the Indonesian Civil Code and may also face ethical sanctions from the Notary Honorary Council (DKN) and the Notary Honorary Assembly (MKN). Professionalism of the Notary/PPAT in performing their duties is crucial to maintaining the legal legitimacy of KPR deeds and protecting the interests of both creditors and debtors.
