Abstract

Basically, the Prosecutor's Office is a state law enforcement tool, protector and protector of society, obliged to maintain the rule of law. The Prosecutor's Office thus acts as a law enforcer. The prosecutor's office is the only state institution which is a government apparatus that has the authority to delegate criminal cases, prosecute perpetrators of criminal acts in court and carry out decisions and decisions of criminal judges. This power is a characteristic of the prosecutor's office that differentiates other law enforcement institutions or bodies. In the criminal justice system, there is a prosecution sub-system carried out by the Prosecutor's Office of the Republic of Indonesia. The prosecutor has an important role in the trial and it is the prosecutor who is authorized by law to carry out prosecutions as a public prosecutor who acts on behalf of the State in carrying out his duties and authority. In the realm of criminal law, the prosecutor's office has a very urgent role and also has a role and authority which is confirmed in Article 30C of Law Number 11 of 2021 concerning Amendments to Law Number 16 of 2004 concerning the Prosecutor's Office of the Republic of Indonesia.

Abstract

Kejahatan seksual terhadap anak merupakan pelanggaran serius terhadap hak asasi manusia yang berdampak panjang pada korban. Undang-Undang Nomor 12 Tahun 2022 tentang Tindak Pidana Kekerasan Seksual (UU TPKS) hadir untuk memberikan perlindungan hukum bagi anak-anak sebagai kelompok rentan. Artikel ini menganalisis penerapan pidana bagi pelaku kejahatan seksual terhadap anak berdasarkan UU TPKS. Metode penelitian yang digunakan adalah yuridis normatif, dengan pendekatan perundang-undangan. Hasil analisis menunjukkan bahwa UU TPKS memberikan sanksi berat bagi pelaku, termasuk pidana tambahan seperti kebiri kimia dan pemasangan alat deteksi elektronik. Kesimpulan menegaskan pentingnya penegakan hukum yang efektif untuk menciptakan efek jera sekaligus melindungi hak anak sebagai generasi penerus bangsa.

Abstract

Indonesian Migrant Workers (PMI) in Kuching, Malaysia, often face various legal issues related to employment contracts, unpaid wages, inhumane working conditions, and discriminatory treatment. A lack of understanding of their legal rights—both under national and Islamic law—weakens their position in resolving these problems effectively. This Community Service Program (PKM) aims to strengthen the Islamic legal literacy of PMI through educational and participatory approaches. The objective is to raise legal awareness, empower workers to claim their rights lawfully, and promote fair and humane working environments rooted in the principles of maqāṣid al-sharī‘ah.The implementation method includes a preliminary survey (pre-test) to assess the participants’ baseline understanding of their rights, followed by Islamic law-based legal counseling and interactive discussion sessions. The materials emphasize key principles such as justice (al-‘adl), protection of life (ḥifẓ al-nafs), and protection of property (ḥifẓ al-māl)—core objectives of Islamic law. A practical Islamic legal literacy module was also developed to support independent learning among PMI. The final evaluation (post-test) showed a significant increase in participants’ understanding of Islamic legal principles and their rights as workers in a cross-border context. This activity demonstrates that an Islamic values-based legal approach can serve as an effective alternative in educating and empowering migrant workers. It also strengthens the legal protection system that has often been inadequate. Furthermore, this program presents a collaborative model involving academics, migrant worker communities, and support institutions to establish a more inclusive, humane, and transformative framework of legal protection.
