Abstract

Early marriage remains an important issue in Indonesia, as noted in the 2024 Report on People's Welfare Indicators by the Central Statistics Agency (BPS). The majority of women in Indonesia marry for the first time between the ages of 19 and 24, with a proportion reaching 49.58%, an increase of 0.57% compared to 2023. The research method used is qualitative with a phenomenological approach. The data sources are library research, primary data, and secondary data from readings (laws and regulations, legal books, legal journals, and literature related to the subject of study in the field of law). The collected data is then analyzed using descriptive analysis techniques and conclusions are drawn. Early marriage, although justifiable from an Islamic legal perspective under certain conditions, has the potential to cause significant negative impacts from a psychological aspect, such as anxiety, stress, and unpreparedness in fulfilling the roles of husband or wife, which may disrupt marital harmony. According to Indonesian legal provisions, the minimum age for marriage is 19 years, aimed at ensuring the physical and mental readiness of the parties involved. Therefore, early marriage can be justified in certain situations, such as to avoid adultery or in the case of pregnancy outside of marriage, but the decision to marry should be based on careful consideration of the physical and psychological readiness of the couple. The principle of maslahah mursalah emphasizes that early marriage should only be conducted in urgent circumstances and after considering the welfare and harmony of the family.

Abstract

Abstract

This study examines the role of local wisdom of the Dana Mbojo community in climate change mitigation, focusing on the Parafu system (customary land management patterns) and Pamali practices (customary prohibitions related to environmental conservation). The urgency of this research lies in the need for a culturally based approach to strengthen climate change mitigation strategies that have been dominated by technocratic approaches. This study aims to identify and analyze the contribution of the Parafu system and Pamali practices to forest, water, and soil conservation, and assess their relevance in the context of climate change adaptation. The study used mixed methods with qualitative and quantitative approaches. Data collection techniques included in-depth interviews with 25 traditional and community leaders, field observations in three traditional villages, and the distribution of questionnaires to 150 respondents, which were analyzed using descriptive statistics. The results showed that the Parafu system contributed to a decrease in deforestation rates by 18.3% in the last five years, while Pamali practices were effective in reducing land burning activities by up to 27.6% compared to non-customary areas (p=0.003). Eighty-four percent of respondents stated that the application of customary values can maintain the balance of local ecosystems, and 76% stated that customary law is more adhered to than formal government regulations. The local wisdom of Dana Mbojo, through the Parafu system and Pamali practices, has great potential for climate change mitigation, particularly through social control mechanisms, value-based conservation, and sustainable spatial use. Integrating local values into climate mitigation policies at the regional and national levels is a strategic step that needs to be implemented immediately.

Abstract

The use of Kalembo Ade as a local identity leaves a concern for its speakers to interpret this expression in a literal sense. This research aims to explore a deep understanding of the local idiom Kalembo Ade both literally and in the context of its use and explore the values implied by the use of the idiom Kalembo Ade in the lives of its origin. By exploring its meaning, this article synthesizes further the significance of the use of the Kalembo Ade in the terms of spiritual values of Islamic roots in Bima. This research uses a qualitative approach based on cultural memory studies by conducting in-depth interviews, enumerating literal meanings through text analysis, and observing the use of Kalembo Ade. The data sources in this research are Bima language speakers (origin), consisting of those from the ethnic of Bima in West Nusa Tenggara, as well as several articles related to the term Kalembo Ade. The research results show that there are several contexts for the use of the term Kalembo Ade in everyday life, including as an expression of gratitude, apology, condolences, and accepting or rejecting a consensus. Some of these contexts were also found to be attached to spiritual values maintained by society regarding manners of behavior and speech (attitude) according to Islamic roots. This research also shows that there are some intentions to preserve local cultural values through the widespread use of Kalembo Ade by the local community

Abstract

This study conceptually explores the possibility of integrating Islamic criminal law, particularly the doctrine of taʿzīr, into Indonesia’s constitutional framework of checks and balances. Rather than proposing an institutional mechanism, the paper normatively analyzes how Islamic ethical values such as ʿadl (justice), maslahah (public welfare), and hisbah (moral accountability) can enrich the moral foundation of state governance. The analysis is conducted through a qualitative normative approach based on secondary legal materials, including constitutional theory, Islamic jurisprudence, and contemporary scholarly discourse. The paper argues that taʿzīr, while traditionally applied to individual moral violations lacking explicit textual sanctions, may serve as a philosophical reference for enhancing ethical responsibility among state officials. However, this requires a clear epistemological distinction between taʿzīr as a moral-legal doctrine and checks and balances as a political-institutional system. The integration, therefore, should not be understood as a merger of institutional powers but as a normative dialogue between divine ethics and constitutional governance. The study concludes that Islamic criminal law contributes by offering an ethical corrective dimension to Indonesia’s democratic system, emphasizing moral accountability and justice without undermining legal pluralism or constitutional principles.
