Abstract

This study discusses the position of wives, children, and property in unregistered marriages based on Islamic law, Law No. 1 of 1974, and Constitutional Court Decision No. 46/PUU-VIII/2010. The method used is a legal-normative approach with a comparative approach to Islamic legal literature and legislation. The results of the study show that according to Islamic law, unregistered marriages are valid religiously if they fulfill the pillars and requirements of marriage, but they do not have legal force because they are not registered. As a result, wives and children find it difficult to obtain legal protection for their status and civil rights, including inheritance rights and joint property. Constitutional Court Decision No. 46/PUU-VIII/2010 recognizes the civil relationship between children born out of wedlock and their biological fathers, thereby strengthening legal protection for children born from siri marriages. Therefore, marriage registration is important to ensure legal certainty for all parties.

Abstract

The digitization of the judicial system through the implementation of electronic court summonses (e-summons) is part of efforts to modernize legal services with the aim of improving efficiency and access to justice. However, the implementation of e-summons faces serious challenges at the rural community level, especially among communities with limited digital literacy or technological illiteracy. This Community Service (PkM) activity aims to increase understanding of electronic court summonses (e-summons) among the community of Jirek Mas Village, which has limited technology proficiency. The method used is a descriptive qualitative approach with an educational-participatory model through stages of observation, legal socialization, simple technology education, simulation, and mentoring. Data was collected through observation, interviews, pre-test and post-test questionnaires, and activity documentation. The PkM results showed that before the activity was carried out, the majority of the community did not understand the meaning, delivery medium, or legal force of e-summons. After the education and mentoring activities, there was a significant increase in the community's understanding of all measured indicators. This activity proves that an educational-participatory approach is effective in increasing legal literacy and awareness among rural communities regarding the electronic court system. Thus, this Community Service Program contributes to supporting the implementation of inclusive court digitalization and strengthening access to justice for rural communities.

Abstract

This study aims to reconstruct the concept of Islamic business management through an Islamic education paradigm approach as an effort to strengthen the foundation of values, ethics, and business objectives oriented towards public interest. The main focus of this research is to integrate spiritual, moral, and social dimensions into sharia business managerial practices so that they are not solely profit oriented but also focused on shaping the character of business actors. The research method used is a qualitative approach with a library research type, through critical analysis of relevant literature, including Islamic business management theory, the Islamic education paradigm, and the concepts of values and ethics in Islam. The results of the study show that the Islamic education paradigm is capable of providing a holistic epistemological and axiological framework for Islamic business management. This reconstruction produces an Islamic business management model that emphasizes the internalization of the values of tauhid, morals, justice, and social responsibility as operational principles, thereby supporting the creation of sustainable and ethical business practices.
