Abstract

One type of law that is expected to make a major contribution to legal reform in Indonesia is Islamic law. Islamic law is expected to provide a positive color to national law, as well as family law which is a derivative of Islamic law. From the time of the Kingdom, which was replaced by Dutch colonialism, the New Order, until now, there is legal politics that seeks to reform the law in determining choices regarding the goals and methods that will be used to regulate the social life of Muslim communities in Indonesia. In implementing Islamic law as a positive color for national law, there are theories used in the formation of Islamic law, especially family law. This article uses a qualitative descriptive data analysis type with library research data collection techniques. This article will later have a purpose and discussion point regarding the political theory of Islamic legal reference used in Indonesia which is then also used in family law.

Abstract

Suatu pernikahan yang didalamnya sudah tidak memiliki arti yang sakral dan hilangnya tujuan pernikahan, biasanya akan berujung pada perceraian. Namun, masih banyak Masyarakat di Indonesia yang menganggap bahwa mengurus perceraian di Pengadilan Agama memakan proses yang Panjang dan menyulitkan para pihak yang hendak bercerai, sehingga banyak diantaranya lebih memilih melaksanakan perceraian diluar pengadilan atau bisa disebut dengan perceraian dibawah tangan. Tujuan dari adanya artikel ini untuk lebih mengetahui bagaimana perceraian dibawah tangan dan dampak hukumnya bagi hak asuh anak pasca terjadinya perceraian dibawah tangan, sehingga dalam artikel ini menggunakan metode analisis deskriptif kualitatif dengan jenis penelitian kepustakaan. Pasca perceraian dibawah tangan, biasanya orangtua yang telah dikarunai anak akan memperebutkan hak asuh anak akan dipegang oleh siapa, dan biasanya jika hak asuh anak telah jatuh ke tangan salah satu ibu atau bapaknya, maka ibu atau bapaknya yang tidak mendapatkan hak asuh anak susah untuk menemui anaknya dan anak kurang mendapatkan kasih sayang dari kedua orangtuanya. Sehingga artikel ini penting untuk dikaji lebih dalam supaya dapat menjadi bahan ajar dan pembelajaran bagi setiap orang yang memiliki keinginan dan sudah melaksanakan perceraian dibawah tangan.

Abstract

One of the conditions for someone to receive inheritance is that one of the family members dies (muwaris) and leaves behind his/her assets. Then the heirs can obtain a portion of the inheritance in accordance with the applicable provisions (faraid). However, things are different if one of the heirs is of a different religion or converts from Islam to a religion other than Islam (apostatizes), then according to Islamic jurisprudence scholars, he is no longer an heir and absolutely does not receive a share of the inheritance of the muwaris. This article uses a qualitative descriptive method with data collection techniques in the form of literature. This article is interesting to discuss in more depth because if an heir has apostatized, he will not receive a single cent of inheritance from the muwaris because Islamic law states that a Muslim cannot inherit from a non-Muslim. This is also clearly regulated in the Compilation of Islamic Law (KHI). However, there is another option if an heir who was previously Muslim becomes an apostate, but he still wants to get a share of the inheritance, Therefore, Islamic law in Indonesia permits it by way of a mandatory will, on the condition that the gift of assets does not exceed 1/3.
