Abstract

This article discusses the government’s acrobatics in forming the Government Regulation in Lieu of Law (as known as Perppu) using the omnibus law method which has caused controversy. The studied aspect is the feasibility of Perppu to be able to use the omnibus law method. Looking further, Law Number 13 of 2022 on the Second Amendment to Law Number 12 of 2011 on The Establishment of Laws and Regulations has restrained the use of omnibus law method in forming laws with the necessity to enact through planning documents. Based on the Legal Restraint perspective, this article is in a negative position to legitimize the use of the omnibus law method in Perppu. The rationalization is because Perppu was formed without using planning documents and it cannot take refuge in an emergency clause which obliges it to grant unlimited exceptions. The force to form Perppu using the omnibus law method is a form of a Constitutional Dictatorship that also in the process of enacting it has the potential to create constitutional chaos. In elaborating the legal issue, the research method used in this article is normative legal research with statutory approaches, conceptual approaches, comparative approaches, and historical approaches.

Abstract

The primary objective of this research is to analyze legal liability in breach of patient’s medical record in SatuSehat platform that provides Cloud Computing-based electronic medical record. This research is a document study or normative legal research that uses conceptual approach and statute approach. The Omnibus Health Law and Minister of Health Regulation about Medical Records require in implementation of medical records must be in electronic form or electronic medical records. As a result of this obligation, legal issue arises related to the protection and confidentiality of patient data which stored and managed by electronic medical record’s administrator. Focus of this research is the implementation of a cloud computing-based electronic system through a system developed by the Ministry of Health which is SatuSehat. This research shows that the party who legally liable for the implementation of Cloud Computing-based electronic medical records is the Ministry of Health, the reason is because there is a transfer of legal liability from healthcare facility to the Ministry of Health because initially the patient data is received by the healthcare facility, and then integrated into the Cloud Computing-based electronic medical record. So because of that, Ministry of Health as a party who has full authority of the data that has been received and integrated in SatuSehat system must held the responsibility if there is a problem with the data. Therefore, the purpose of this study is not only to analyze of the legal responsibility but also to provide legal basis for the protection of hospitals, doctors and patients in the event of a data leak in the SatuSehat Platform. In addition, authors analyzes the protection principles applied in Indonesia with three pillars of patient health data protection applied in the United States.

Abstract

This research analyzes the fulfillment of health rights through telemedicine services by Foundation Hospitals. The best practice of telemedicine services by Panti Wilasa Citarum Hospital is carried out as a form of citizens' right to health as mandated in the Constitution. The best practice of hospital telemedicine is in line with the character of the foundation that prioritizes humanitarian values and is not for profit.  This research is an empirical juridical research that uses field studies complemented by literature studies. A purposive sampling technique was used to sample the good practice of telemedicine in Panti Wilasa Citarum Hospital. Primary data was collected by interviewing the director and the doctor in charge of telemedicine, while secondary data was collected by literature study. After the data is collected, it is analyzed qualitatively. From this study, the fulfillment of patient health rights in telemedicine services is in principle subject to the 1945 Constitution, Law Number 17 of 2023 concerning Health and implementing regulations governing patient rights. The findings in this study are that the Foundation Hospital or Panti Wilasa Citarum Hospital, the best practices carried out have described practices that refer to a model of excellence in telemedicine services that can be utilized by other hospitals as a model for telemedicine and the government in formulating policies that can encourage better implementation of telemedicine by Foundation Hospitals. Furthermore, the fulfillment of patient health rights in the implementation of best practices in hospital telemedicine services, in the form of being given the correct answer from the results of the examination, giving the right medicine, getting assistance if the patient is in a category that must be accompanied, and getting personal data protection. Thus, the right to health has been fulfilled through the Foundation Hospital telemedicine service.

Abstract

The use of social media by children is an action that needs supervision from parents. Social media can support the education sector in children. However, it is not uncommon for children's actions on social media to be unconsciously justified as violations of the law. Therefore, it is important to conduct socialization with parents about the wise use of social media. In addition, this socialization will also provide parents with an understanding of the regulations related to activities on social media. With this understanding, it becomes a provision for parents to supervise their children. The methods used in this activity are presentation and question and answer. Through this activity, it benefits parents in the form of understanding the existence of violations in the use of social media that can ensnare children as well as remind parents of their responsibilities in supervising children, especially in the use of social media.

Abstract

This article will discuss the principles of good corporate governance and what good practices an individual company should adopt. An Individual Company is a legal entity that has only one shareholder in the company. The Job Creation Law legally recognizes this provision. In principle, the norm is incompatible with the concept of a limited liability company consisting of shares. Practically, the organs in an individual company will not be as ideal as the limited liability companies that have existed so far. On this basis, the issue to be discussed in this article is whether the management of an individual company in Indonesia is in accordance with the principles of good corporate governance. This article argues that an appropriate governance concept is needed so that individual companies can still run well based on good corporate governance principles.

Abstract

Subjek hukum memegang peranan penting sebagai pelaku sekaligus pendukung hak dan kewajiban. Artinya, subjek hukum yang terdiri dari manusia dan badan hukum memiliki hak dan kewajiban yang melekat dalam dirinya. Pada hakikatnya manusia dikatakan sebagai subjek hukum sejak dilahirkan. Namun, pada perkembangannya timbul pertanyaan bagaimana kedudukan manusia yang masih berada dalam kandungan/janin sebagai subjek hukum. Meskipun janin tidak memiliki kewenangan untuk melakukan perbuatan hukum tapi ketidakmampuan tersebut tidak akan menghilangkan eksistensi janin sebagai subjek hukum. Janin merupakan calon manusia sehingga kedudukan janin pada dasarnya sama seperti manusia. Tulisan ini akan menjustifikasi dan memberi kejelasan mengenai adanya hak pada janin ketika kepentingan yang mendesak dilihat dari perspektif hukum perdata.

Abstract

This article aims to formulate the ethics of using Artificial Intelligence (AI) in legal education. Legal education held by the Faculty of Law is a center for the development of excellence in legal science in order to generate competent graduates. The ability to provide a legal opinion on a legal issue is a competency that every law graduate must have. In this era, law students can easily command AI to construct legal opinion without going through the legal research process. The implication for Faculty of Law is that they fail to prepare law graduates who are able to produce legal opinion. The issue to be discussed in this article is how is the role of Faculty of Law in dealing with the developmet of AI in the midst of educating future law graduates. This article argues that ethics occupies an essential aspect that should be a concern for Faculty of Law because with the systematized ethics, law students can act with caution in utilizing AI. The application of ethics also applies to legal academics in Faculty of Law as those who educate law students. There are 3 (three) ethics proposed by the Author, namely reviewing, honesty, and carefulness. The formulation of these ethics is carried out by examining the existing regulation related to AI in Indonesia and then comparing it with the regulation related to AI in Europe. This research is conducted using normative legal research methods through statutory approach and comparative approach.

Abstract

Latar Belakang: Penyakit Tidak Menular (PTM) merupakan salah satu masalah kesehatan utama di Indonesia yang berdampak besar terhadap kualitas hidup masyarakat, termasuk mereka yang tinggal di wilayah pedesaan. Upaya pencegahan dan peningkatan kesadaran dini melalui pemeriksaan kesehatan rutin menjadi strategi dalam menurunkan risiko PTM pada berbagai kelompok usia. Tujuan: Kegiatan pengabdian kepada masyarakat ini bertujuan untuk melakukan pemeriksaan kesehatan guna mendeteksi faktor risiko PTM melalui pengukuran kadar asam urat, kolesterol, glukosa darah, tekanan darah, serta pengukuran antropometrik (berat badan dan tinggi badan). Metode: Kegiatan dilaksanakan melalui kolaborasi antara kampus dan Posbindu di Desa Ngrawan, Jawa Tengah pada bulan Juli-September 2024. Pemeriksaan dilakukan terhadap tekanan darah, kadar glukosa, asam urat, kolesterol, berat, dan tinggi badan. Data dianalisis secara deskriptif untuk memetakan risiko PTM pada kelompok usia produktif dan lanjut usia. Hasil: Sebanyak 70 warga mengikuti pemeriksaan, terdiri atas 59% usia lanjut dan 41% usia produktif, dengan mayoritas perempuan (90%). Sebagian besar kadar asam urat dan glukosa normal, namun ditemukan kolesterol tinggi pada usia produktif (45%) dan lanjut usia (67%), serta hipertensi pada kedua kelompok (66% dan 59%). Kesimpulan: Kegiatan kolaboratif antara kampus dan Posbindu di Desa Ngrawan menunjukkan partisipasi masyarakat yang tinggi serta mengungkap potensi risiko hipertensi dan kolesterol tinggi. Sinergi ini menegaskan kebutuhan penguatan kader dan keberlanjutan Posbindu dalam deteksi dini dan pencegahan PTM di pedesaan.
