Abstract

Progressive Legal Theory is a legal theory that changes rapidly makes fundamental reversals in legal theory and practice, and makes various breakthroughs. This liberation is based on the principle that law is for humans and not vice versa and that law does not exist for itself but for something broader, namely for human dignity, happiness, welfare, and human glory. Through an analysis of various cases and legal policies in Indonesia, this article attempts to show how progressive legal theory can be the basis for more inclusive and equitable legal reform. This type of research is qualitative, using data from the literature; the data is then analyzed using descriptive techniques. The results of this study indicate that progressive legal theory offers a dynamic and responsive approach to responding to social developments and community needs. In the context of the Indonesian rule of law, this theory emphasizes the importance of flexibility and adaptability of law to realize substantive justice

Abstract

Childfree sering kali dianggap sebagai pilihan yang egois. Pilihan childfree dianggap telah menyalahi tujuan dari perkawinan itu sendiri. Yang mana, di negara Pronatalis seperti Indonesia, memiliki anak setelah menikah merupakan sebuah norma, bahkan hampir menjadi sebuah keharusan yang harus dijalani oleh setiap orang yang sudah menikah. Menurut sebagian orang, kunci kebahagiaan sebuah perkawinan adalah dengan memiliki anak. Maka sebaliknya, jika tidak memiliki anak maka perkawinan tidak akan bahagia. Oleh karena itu, penulis ingin mengkaji ulang mengenai tujuan utama dari sebuah perkawinan dengan argumentasi yang diberikan masyarakat melalui beberapa kuesioner yang penulis bagikan secara abstrak di berbagai wilayah Indonesia. Selain itu, penulis juga melakukan pengkajian ulang terhadap teks al-Qur’an dan Hadits serta jurnal yang berkaitan dengan topik yang diteliti. Atau yang biasanya disebut dengan kajian pustaka (library research). Berdasarkan data hasil kuesioner yang penulis sebar, mayoritas masyarakat tidak setuju dengan childfree. Karena childfree bertentangan dengan ajaran Islam, yaitu memiliki anak setelah menikah. Namun dari sisi lainnya, tujuan perkawinan menurut masyarakat tidak selalu identik dengan “anak”. Banyak di antara mereka yang berpendapat bahwa tujuan dari perkawinan adalah sebagai wadah untuk mendekatkan diri kepada Tuhan. Sehingga, dengan demikian, dari sudut pandang tujuan hukum perkawinan Islam, ada dan tidak adanya anak dalam rumah tangga bisa membuat siapapun bahagia. Mereka yang kontra terhadap childfree bisa bahagia dengan hadirnya anak. sedangkan mereka yang pro dan memilih childfree bisa bahagia dengan cara mereka sendiri. Misalnya dengan fokus pada karir serta tumbuh dan berkembang dengan pasangan.

Abstract

Kekuasaan kehakiman di Indonesia saat ini telah mengalami perubahan yang sangat signifikan dengan terbentuknya lembaga baru mahkamah konstitusi dan komisi yudisial. Kedua lembaga tersebut memiliki kewenangan dan fungsi yang diamanahkan langsung oleh Konstitusi dalam melaksanakan tugas dan fungsinya. Perubahan sistem kekuasaan kehakiman Indonesia tidak hanya berimplikasi terhadap sistem Indonesia tetapi juga terhadap hubungan secara kelembagaan antar lembaga-lembaga Negara yang sering kali menimbulkan konflik horizontal terhadap kewenangan lembaga masing-masing. Penegasan aturan hukum dan konkritisasi norma menjadi sangat penting dalam memberikan kepastian hukum dalam pelaksanaan fungsi kelembagaan khususnya terhadap lembaga yang berada pada kekuasaan kehakiman (yudikatif) di Indonesia.

Abstract

This research examines the role of DLHK in the implementation of article 21 of Padang Lawas District Regulation No. 2 of 2014 concerning Garbage from the perspective of Fiqh Siyasah. This research is a field research and was compiled using an empirical normative approach, the primary data source comes from Padang Lawas District Regulation No. 2 of 2014 concerning Trash Cans and secondary data comes from books and journals related to this research. While the data collection techniques used in this study consisted of interviews, observation and documentation and data analysis techniques using qualitative descriptive techniques. The results of this study state that the role of DLHK Padang Lawas Regency in implementing article 21 of Regional Regulation of Padang Lawas Regency Number 02 of 2014 concerning Trash Cans has not been implemented effectively. Because the socialization that has been carried out has not been evenly distributed and the distribution of trash cans that are not on target. Then from a review of siyasa dusturiyah studies. The role of DLHK in implementing Article 21 of Regional Regulation Number 2 of 2014 has not been implemented properly.

Abstract

This study examines default in the practice of istishna' contract against weaving craftsmen in terms of the Sharia Economic Law Compilation in Silangge Hamlet, Sipirok District, South Tapanuli Regency. This type of research is field research using a qualitative approach, the primary data source is data obtained directly through interviews with Silungkang weaving craftsmen in Silangge Hamlet, Sipirok District, South Tapanuli Regency and some of its consumers, secondary data sources are journal books and documents. related to this research, the data collection technique is by means of observation, interviews and documentation. Then the descriptive type of data analysis technique describes this research completely in a language so that an understanding in the field between reality and the language used does not reduce the existing data. The results of this study conclude that the causes of default in the practice of istishna' contract for weaving craftsmen are not on time to complete the ordered goods because the weaving machine is damaged or defective, too many orders, complicated motifs, and the difficulty of obtaining basic materials. Settlement of defaults carried out by craftsmen and consumers in a simple way, conducting deliberation between the two parties and making decisions so that no one is harmed. The review of the Compilation of Sharia Economic Law on defaults in the practice of itishna' contracts against weaving craftsmen is contained in Article 108 paragraph (2) If the object of the ordered goods does not match its specifications, the customer can use the right to vote (khiyar) to continue or cancel the order

Abstract

One of the results of the amendments to the 1945 Constitution was the lossof the GBHN as the state's guidance or direction in implementing nationaldevelopment. This GBHN disappeared along with changes in the duties of theMPR institution as a consequence of the change in its institutional position fromthe highest state institution to a high state institution. As a replacement for theGBHN, Law no. 25 of 2004 regulates the National Development Planning System,which states that the explanation of the objectives for the formation of theRepublic of Indonesia as contained in the Preamble to the 1945 Constitution, isset out in the form of a RPJP (Long Term Development Plan). The RPJP timescale is 20 years, which is then described in the RPJM (Medium TermDevelopment Plan), namely planning with a 5 year time scale, which contains thevision, mission and development program of the elected president, guided by theRPJP. The problem is when the President is in office His term has expired and anew president has been re-elected, so politically the existence of the lawregarding the National Development planning system can very easily be changedto suit the vision and mission of the elected president.

Abstract

Pembatasan usia nikah menjadi perdebatan yang hangat dalam konteks hukum Islam, terutama di Indonesia yang memiliki populasi muslim yang signifikan. Kajian ini bertujuan untuk menyelidiki pandangan hukum positif terhadap pembatasan usia nikah dalam kerangka hukum Islam di Indonesia. Melalui pendekatan analitis, artikel ini mengeksplorasi dasar hukum Islam, relevansi praktek dan pemahaman lokal terhadap isu ini, serta dampak implementasi pembatasan usia nikah terhadap masyarakat. Dengan menganalisis peraturan perundang-undangan dan interpretasi ulama, kajian ini berupaya memberikan pemahaman yang komprehensif tentang status quo dan tantangan yang dihadapi dalam menegakkan pembatasan usia nikah dalam kerangka hukum positif di Indonesia.

Abstract

The formation of laws in Indonesia requires a holistic approach to ensure that the resulting legal products are not only legally valid but also in line with the values ​​of Pancasila as the foundation of the state. This study aims to analyze the application of inclusive legal theory in the Pancasilaist legislative process. Inclusive legal theory recognizes the diversity of legal sources, including positive law, customs, religion, and other social norms, which are relevant in pluralistic Indonesia. This study uses a qualitative method with a normative and descriptive-analytical approach that aims to describe how inclusive legal theory is implemented in forming laws in Indonesia and analyze the suitability of applying the theory to the values ​​of Pancasila. Data were collected through document studies, literature studies, and in-depth interviews with legal experts and practitioners. Data analysis was conducted using qualitative techniques. This analysis will focus on how Pancasila values ​​are integrated into laws by applying Inclusive Legal Theory. The results of the study indicate that the application of inclusive legal theory in the formation of laws can increase public acceptance and compliance with the law because this approach takes into account and integrates various sources of law that exist in society, such as social norms, customs, religious values, and morality. The values ​​of Pancasila are reflected in the legislative process, which creates legal products that are fairer, more humane, and meet the needs of society. This study provides concrete recommendations for policymakers to improve the quality of legislation in Indonesia through a more inclusive approach based on Pancasila values. Thus, this study contributes to the development of inclusive legal theory and provides practical guidance for forming laws that are more effective for the identity of the Indonesian nation.
