Abstract

This article discusses the opportunities for implementing halal certification to increase their economic growth. It is said that new opportunities for business actors who are benchmarks are the guarantee of halalness of products sold to consumers in attracting the business opportunities they are undergoing. Therefore, the Sambas Regency Government is always optimal and strives to develop the halal food and beverage industry in each region in order to encourage the growth of the halal industry for culinary business actors. In implementing the acceleration of the implementation of halal standards where one of the things needed is halal products, article 4 states that halal certification of a product is mandatory. To support one of the developments of the halal industry, an in-depth study is needed in this study to find out the extent of application in providing halal product assurance through halal certification for MSME food and beverage products in Sambas district. The research method used is a descriptive qualitative approach research method. Based on the results of observations that show that superior food and beverage products, culinary business actors have great potential in realizing halal product guarantees so that they have optimal potential and are found to be quite strategic and appropriate in realizing the design of the halal food and beverage industry.

Abstract

Pokok masalah dalam penelitian ini adalah mengenai perspektif hukum Islam terkait ritual massoppo’i urang yang dilakukan oleh masyarakat Kabupaten Polewali Mandar khususnya di Desa Alu, Kecamatan Alu. Jenis penelitian ini termasuk penelitian kualitatif dengan menggunakan pendekatan penelitian yakni: deskriptif, etnografi, sosio­logis dan antropologis. Adapun terdapat beberapa sumber data dalam penelitian ini yakni passoppo’i urang, tokoh ulama, tokoh agama dan tokoh masyarakat. Selanjutnya, metode pengum­pulan data yang diguna­kan adalah observasi, wawancara, dan dokumentasi. selanjutnya, teknik pengolahan dan analisis data yang dilakukan melalui tiga tahapan, yaitu: reduksi data, penyajian data, dan pena­rikan kesimpulan. Hasil penelitian menunjukkan bahwa ritual massoppo’i urang yang ada di Kabupaten Polewali Mandar menggunakan beberapa media dalam pelaksanaannya serta terdapat pantangan yang harus dihindari selama proses ritual. Berdasarkan pandangan tokoh agama dan tokoh masyarakat di Desa Alu bahwa ritual yang mereka lakukan masih tetap berada dalam jalur yang baik dan tidak bertentangan dengan hukum Islam. Adapun medianya hanya sebagai simbol bukan alat untuk meminta. Begitupun dari perspektif hukum Islam bahwa ritual ini dapat dilakukan dan tidak menyalahi hukum Islam sepanjang tidak menggantungkan harapan atau doa mereka kepada media atau atas keahlian dari passoppo’i urang.

Abstract

Al-Adah al-Muhakkamah yaitu adat adalah hukum. Secara etimologi kata al-Adah berarti pengulangan baik berupa perkataan atau perbuatan. Secara terminologi al-Adah berarti sebuah kecenderungan berupa ungkapan atau pekerjaan pada suatu obyek tertentu sekaligus pengulangan akumulatif pada obyek pekerjaan dimaksud, baik dilakukan oleh pribadi maupun kelompok. Terdapat beberapa macam kaidah turunan dari al-Adah al-Muhakkamah yang masing-masing berorientasi pada adat kebiasaan masyarakat yang dapat dijadikan landasan hukum. Namun tidak semua adat dapat dijadikan sebagai landasan hukum. Hanya adat yang tidak bertentangan dengan syariat dapat dijadikan sebagai landasan hukum dalam hukum Islam.

Abstract

This study aimed to analyze the implementation of the green investment paradigm in Morowali’s mining industry based on the principles of maqasid al-shari‘ah. The research method used was a qualitative approach with descriptive analysis through literature studies, interviews with mining industry stakeholders, and observations of the environmental impacts caused by mining activities. The data were analyzed using the maqasid al-shari‘ah approach to evaluate the extent to which the mining industry in Morowali had implemented sustainability principles in its operations. The results showed that although some companies had adopted environmentally friendly practices, such as land reclamation and the use of waste processing technologies, many aspects still did not align with maqasid al-shari‘ah. Excessive resource exploitation, environmental pollution, and social inequality remained, which impacted the welfare of the local community. In conclusion, the application of green investment in the mining industry of Morowali still required optimization based on maqasid al-shari‘ah, particularly in the areas of hifẓ al-bī’ah (environmental protection), hifẓ al-nafs (protection of life), and hifẓ al-māl (protection of wealth). Within the framework of contemporary Islam, this study emphasized the importance of revitalizing maqasid al-shari‘ah as an ethical and strategic foundation for sustainable investment. The academic contribution of this research lies in the integration of maqasid al-shari‘ah in the analysis of green investment in the mining sector, which has been limited in previous studies. This study provides a new perspective on Islamic economics by highlighting how the principles of maqasid al-shari‘ah can serve as an ethical framework for sustainable investment.
