Abstract

Abstract: The change in the law made by Imam Syafi'i in his ijtihad can have a social impact on social life. So the purpose of this study is to describe the social impact of the change in Imam Syafi'i qaul qadim to qaul jadid. The research method used in this study is the library research method, namely by examining sources from books and literature related to the formulation in this article. The research method used in this research is the library research method, namely by examining sources from books and literature related to the formulation in this article. the following are some conclusions that can be drawn by researchers: First, the history of the growth of the imam shafi'i school of thought is inseparable from the influence of his two teachers' schools, namely the school of imam malik and the school of imam abu hanifah. Second: The factors that influence the change in ijtihad in the school of Imam Shafi'i from qaul qadim to qaul jadid include: The existence of new Prophetic traditions or atsar found by Imam Shafi'i, the existence of arguments that are stronger (arjah) than previous arguments and the geographical differences between the two countries of Iraq and Egypt. Third; The social consequences of the change from qaul qadim imam shafi'i to qaul jadid can affect social relations in society, both Iraqi society and Egyptian society at that time, this is inseparable where both countries need to adjust to the new opinion of imam shafi'i. Abstrak: Berubahnya hukum yang dilakukan oleh Imam Syafi'i dalam ijtihadnya dapat memberikan dampak sosial bagi kehidupan bermasyarakat. sehingga tujuan dari penelitian ini adalah untuk mendeskripsikan dampak sosial dari perubahan qaul qadim Imam Syafi'i menjadi qaul jadid. Adapun metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian kepustakaan (library research), yaitu dengan menelaah sumber-sumber dari buku-buku dan literatur-literatur yang berkaitan dengan rumusan dalam artikel ini. berikut ini beberapa kesimpulan yang dapat diambil oleh peneliti: Pertama; sejarah pertumbuhan mazhab imam syafi'i tidak terlepas dari pengaruh dua mazhab gurunya yaitu mazhab imam malik dan mazhab imam abu hanifah. Kedua: Adapun faktor-faktor yang mempengaruhi perubahan ijtihad dalam mazhab imam syafi'i dari qaul qadim menjadi qaul jadid, diantaranya: Keberadaan hadis-hadis Nabi atau atsar baru yang ditemukan oleh imam syafi'i, adanya dalil-dalil yang lebih kuat (arjah) dari dalil-dalil sebelumnya dan adanya perbedaan geografis antara kedua negara Irak dan Mesir. Ketiga; Akibat sosial dari perubahan qaul qadim imam syafi'i ke qaul jadid dapat mempengaruhi hubungan sosial dalam masyarakat, baik masyarakat Irak maupun masyarakat Mesir waktu itu, hal ini tidak terlepas dimana kedua negara tersebut perlu penyesuain terhadap pendapat baru imam syafi'i.

Abstract

This study aims to examine the flexibility of Islamic law in addressing the economic impacts of climate change, focusing on applying relevant Sharia principles in mitigating and adapting to these global challenges. It also analyzes how religious fatwas, such as MUI Fatwa No. 86 of 2023, and approaches by religious organizations like Nahdlatul Ulama and Muhammadiyah contribute to sustainable, Sharia-based solutions. This research employs a qualitative methodology with a juridical-normative approach. The primary sources include literature reviews of books, academic journals, religious fatwas, and official documents related to the flexibility of Islamic law, climate change impacts, and their economic implications. Data were analyzed to evaluate the relevance of Islamic law in providing adaptive solutions to contemporary issues. The findings reveal that the flexibility of Islamic law enables Sharia regulations to adapt to modern social and environmental conditions, including climate change. Principles such as maqasid al-shariah, maslahah mursalah, and usul al-fiqh have proven effective in supporting climate change mitigation and adaptation. Religious fatwas, such as MUI Fatwa No. 86 of 2023, along with the approaches of NU and Muhammadiyah, have significantly contributed to raising collective awareness and formulating environmental policies grounded in religious values. This study underscores the critical role of Islamic law in offering sustainable solutions that are both relevant and adaptive to the economic impacts of climate change.

Abstract

Digital transformation in zakat management faces significant challenges regarding efficiency, transparency, and regulatory compliance. This study aims to explore the role of digital technologies in enhancing zakat collection and distribution by Amil Zakat Institutions (LAZ) in Indonesia. Using a qualitative literature review approach, this research analyzes key regulations, including the Electronic Information and Transactions Law (ITE Law), Data Protection Law, and relevant sharia fatwas on e-wallet usage. Findings indicate that digital technologies, such as web applications, e-wallets, and QRIS systems, enhance the flexibility and reach of zakat payments, thereby expanding the collection area to remote regions. Digitalization also facilitates automation of payments and enables transparency through real-time tracking of zakat funds. However, key challenges include data privacy, low digital literacy, and sharia compliance.The implications suggest that zakat institutions need to strengthen data security and promote digital literacy to address adoption barriers. Collaboration between the government, zakat institutions, and stakeholders is essential to ensure a trustworthy and efficient digital zakat system. This study recommends stronger regulations and continuous innovation to make zakat a sustainable economic empowerment tool.

Abstract

Contemporary issues such as financial technology, biotechnology, and social change present new challenges in the establishment of Islamic law, necessitating an approach based on ushul fiqh. This study aims to analyze how ushul fiqh, through the integration of syara' sources (the Qur'an, Hadith, ijma', and qiyas), can be applied to address modern challenges and provide relevant, contextual legal guidance. Using a qualitative research method with a descriptive-analytical approach, primary data was gathered from foundational Islamic legal texts, while secondary data was obtained from classical literature, scholarly journals, and fatwas from official bodies like the National Sharia Council (DSN) and the Indonesian Ulema Council (MUI). The data was analyzed through reduction, classification, and interpretation techniques to answer the research questions. The study found that the principles of maqashid shariah (the preservation of religion, life, intellect, lineage, and wealth) play a crucial role in navigating contemporary issues. Fatwa institutions play a strategic role in transforming the theory of ushul fiqh into practical guidance through a collaborative and flexible approach, while mujtahids are expected to conduct ijtihad using an interdisciplinary and information technology-based approach to produce sound and applicable rulings. The study contributes theoretically by enriching the Islamic legal literature and practically by providing guidance for fatwa institutions and mujtahids to respond adaptively to the challenges of the times. The study’s implications indicate that Islamic law remains relevant for addressing the dynamics of modern society, provided that it is accompanied by a contextual and shariah-based approach.

Abstract

Sharia law is an important element in Islamic law that includes rules and principles that govern various aspects of Muslim life, including worship, muamalah, and social ethics. This article analyzes the basic concept of sharia law which is divided into taklifi and wadh'i laws, as well as how relevant they are in answering challenges in the modern era. In Indonesia, the implementation of sharia law is faced with internal challenges such as stagnation of ijtihad, diversity of interpretations, and lack of trust in sharia legal institutions. External challenges include friction with the secular legal system, globalization, and human rights issues. To overcome this problem, it is necessary to update thinking through contextual ijtihad, strengthening education and literacy of sharia law, reforming legal institutions, and harmonizing sharia law with the national legal system. With a progressive and inclusive approach, sharia law can continue to be relevant in creating a just and prosperous society, as well as making a significant contribution to shaping global ethics that support social justice and sustainable development. This article offers an applicative solution to ensure that sharia law remains a relevant moral guideline in the midst of dynamic social change.

Abstract

The existence of fatwa institutions is very important because it can provide a roadmap for resolving contemporary legal problems. This research aims to examine the nature and importance of fatwas, the existence of fatwa institutions in Indonesia and their mandate and the absorption capacity of fatwa institutions in Indonesia in responding to current problems. Research was carried out in the literature using a normative-historical approach in analyzing the absorption capacity of fatwa institutions in responding to contemporary issues. The fatwa institutions in question are centered on the Majlis Tarjih Muhammadiyah, Bahtsul Masa'il Nahdlatul Ulama (NU) and by fatwa institutions such as the Indonesian Ulema Council (MUI). The results show that a fatwa is a form of answer from a mufti to a question asked by a mustafti which is based on a compelling case. Remembering that the mufti is the person chosen to be the caliph and successor of the Prophet, as stated by Imam Syatibi. Therefore, fatwas have a strategic and important position in social life to answer contemporary problems. Fatwa plays an important role in answering contemporary problems, especially problems in the era of modernization. One reason is because the majority of Muslims need legal answers that can solve problems. Based on the number of fatwas that have been issued, it shows that fatwa institutions in Indonesia have responded to contemporary legal issues.

Abstract

This study aimed to analyze the implementation of the green investment paradigm in Morowali’s mining industry based on the principles of maqasid al-shari‘ah. The research method used was a qualitative approach with descriptive analysis through literature studies, interviews with mining industry stakeholders, and observations of the environmental impacts caused by mining activities. The data were analyzed using the maqasid al-shari‘ah approach to evaluate the extent to which the mining industry in Morowali had implemented sustainability principles in its operations. The results showed that although some companies had adopted environmentally friendly practices, such as land reclamation and the use of waste processing technologies, many aspects still did not align with maqasid al-shari‘ah. Excessive resource exploitation, environmental pollution, and social inequality remained, which impacted the welfare of the local community. In conclusion, the application of green investment in the mining industry of Morowali still required optimization based on maqasid al-shari‘ah, particularly in the areas of hifẓ al-bī’ah (environmental protection), hifẓ al-nafs (protection of life), and hifẓ al-māl (protection of wealth). Within the framework of contemporary Islam, this study emphasized the importance of revitalizing maqasid al-shari‘ah as an ethical and strategic foundation for sustainable investment. The academic contribution of this research lies in the integration of maqasid al-shari‘ah in the analysis of green investment in the mining sector, which has been limited in previous studies. This study provides a new perspective on Islamic economics by highlighting how the principles of maqasid al-shari‘ah can serve as an ethical framework for sustainable investment.
