Abstract

Tulisan ini bertujuan untuk mengetahui akibat hukum bagi Pejabat Pembuat Akte Tanah (PPAT) dalam menandatangani Akta Jual Beli yang dibuat berdasarkan Akta Surat Kuasa Absolut yang dibuat dengan menggunakan template kosong. Selain itu juga bertujuan untuk mengetahui sanksi yang dikenakan terhadap Pejabat Pembuat Akta Tanah yang tidak melaksanakan uji tuntas dalam pembuatan Akta Jual Beli, sesuai dengan putusan Pengadilan Nomor 289/Pdt/2015/PT. Bdg. Penelitian ini menggunakan metode penelitian hukum normatif, dengan menggunakan pendekatan perundang-undangan dan berpegang pada kode etik jabatan PPAT. Temuan kajian menunjukkan adanya pelanggaran kode etik PPAT, khususnya terkait ketentuan yang tertuang dalam Pasal 3 huruf b Kode Etik PPAT. Selanjutnya telah terjadi pelanggaran terhadap ketentuan hukum terkait yang tercantum dalam Pasal 24 PP Nomor 37 Tahun 1998 tentang peraturan yang mengatur tentang kedudukan PPAT. Pasal tersebut menyatakan bahwa “Ketentuan tambahan mengenai tata cara pembuatan akta PPAT diatur dalam peraturan perundang-undangan mengenai pendaftaran tanah.” Dalam konteks ini apa yang dimaksud dengan Pasal 39 ayat 1 huruf d PP Nomor 24 Tahun 1997 tentang Pendaftaran Tanah?

Abstract

This study discusses hadiths related to stock investment from an Islamic perspective, focusing on a hadith narrated by al-Khamsah from ‘Amr bin Syu’aib, sourced from his father and grandfather, which has been authenticated by Tirmidzi, Ibnu Khuzaimah, and Hakim. After confirming the authenticity of the hadith, the next step is to provide syarah (explanation) to clarify its meaning. This research employs the methods of takhrij and syarah, along with a disciplinary approach that includes theological, historical, and philosophical perspectives. The study aims to answer several key questions regarding the content of the hadith on investment, the authenticity of the hadith related to investment, and the explanation of hadiths that support stock investment in Islam. The methodology used is a thematic (maudhui) approach with textual, contextual, and intertextual analysis.In conclusion, Prophet Muhammad (SAW) taught that investment should be conducted with honesty and commitment. The hadith regarding stock investment is accepted and serves as guidance for Muslim practices. Investment is encouraged in Islam, as it can create employment opportunities and prevent the accumulation of wealth. However, it must avoid prohibited elements in both the object and method of investment.

Abstract

This study investigates the historical, theological, and socio-political differences between Sunni and Shia Islam. By examining core issues such as leadership, understanding of the Prophet’s companions, and interpretation of the Quran, the study highlights the complex factors that contribute to sectarian divisions. The paper then explores the potential for harmonization between the two sects, focusing on the importance of interfaith dialogue, education, and community-building initiatives. Although Sunnis and Shias share a common foundation in Islamic belief, their differing perspectives on key doctrinal and historical issues have caused sectarian tensions for centuries. The study argues that by fostering mutual understanding, promoting tolerance, and addressing the underlying political and social factors, sectarian conflict can be reduced and bridges can be built between Sunni and Shia communities. The paper concludes by emphasizing the importance of continued dialogue and cooperation in achieving lasting peace and harmony in the Muslim world.
