Abstract

Kajian ini bertujuan untuk menganalisis Putusan Pengadilan Negeri Situbondo Nomor 40/Pdt.G/2021/PN.Sit serta peran pejabat pembuat akta tanah sementara dalam proses peralihan tanah terlantar menjadi tanah kas desa. Metode yang digunakan yaitu sosio-legal research dengan pendekatan peraturan perundang-undangan, pendekatan konseptual, dan pendekatan kasus. Putusan Pengadilan Negeri Situbondo Nomor 40/Pdt.G/2021/PN.Sit berkaitan dengan sengketa peralihan tanah terlantar menjadi tanah kas desa yang terjadi di Desa Kesambirampak. Peralihan tanah terlantar menjadi tanah kas desa harus melalui beberapa tahap yaitu evaluasi terhadap tanah terlantar, pemberian peringatan kepada pihak terkait, serta penetapan sebagai tanah terlantar sehingga dapat dikuasai oleh pemerintah desa. Camat dan/atau Kepala Desa sebagai Pejabat Pembuat Akta Tanah Sementara berperan dalam melakukan pengawasan terhadap proses peralihan tanah terlantar menjadi tanah kas desa agar tidak menimbulkan sengketa di kemudian hari.

Abstract

Women play a crucial role in driving advancements in the local economy in alignment with the Sustainable Development Goals. This research seeks to offer an unbiased understanding of women’s motivational levels, perspectives, and roles in Desa Pesanggrahan, Mojokerto, East Java, contributing to the development of their cultural landscape. This descriptive qualitative study utilized data collected from August to September 2023 through document reviews, interviews, and observations with female members of the Family Welfare Development (Pembinaan Kesejahteraan Keluarga [PKK]) in Desa Pesanggrahan organization in Desa Pesanggrahan. We employed Abraham Maslow's theory on the hierarchy of needs as a base for the analysis of this paper. The result of interviews with the locals, documentation, and observation carried out in the data collection of this research found that women in Desa Pesanggrahan still have low motivation based on Maslow’s theory. This affects their ability to generate innovative ideas and make independent decisions in the development of local culture. Women tend to select men as their leaders, as they often lack the confidence to assume leadership roles in the village. Their role in developing their cultural products in the village is overshadowed by the men of the village.

Abstract

On July 30, 2022, the government's policy in terminating access to unregistered private scope electronic system operators to several internet platforms including: Paypal, Yahoo, Epic Games, Steam, Dota, Counter Strike, Xandr.com, and Origin, has resulted in material and immaterial losses to citizens who use the platform of unregistered private scope electronic system operators. The government's policy in terminating access or blocking access to PSE LP, harms the digital rights of citizens. Blocking has an impact on the inaccessibility of services and loss of revenue due to termination of PSE LP access. Citizens are eligible for legal protection, which includes preventive and repressive legal protection. Preventive protection includes the right to communicate and access information guaranteed in human rights provisions. Repressive protection includes the right to legal guarantees for legal remedies in filing state administrative court lawsuits.

Abstract

The amendment to Article 15 of the State Ministry Law, which eliminated the cap on ministries and replaced it with "as needed by the President," has introduced legal uncertainty in Indonesia. This change adversely affected the structuring and formation of state ministries. This study analyzes the factors influencing ministry formation and aims to reconstruct the regulatory framework by reinstating limitations on the number of ministries to mitigate negative impacts. Using a normative legal method with statutory, conceptual, and historical approaches, this study identifies regulatory gaps. The findings reveal that the amendment to the State Ministry Law, particularly the revision of Article 15, which allows ministry numbers to be determined by presidential discretion, creates legal uncertainty. This fails to meet two key indicators of legal certainty theory - lex stricta and lex certa - leading to detrimental implications for ministry formation. This study recommends a judicial review of the amendments and advocates for reinstating a maximum limit on ministry numbers within the legal framework. This regulatory provision enhances legal certainty and prevents potential abuse of authority.

Abstract

Introduction to The Problem: Delegated legislation in Indonesia is a new type of legislation that should be interpreted and ruled carefully. However, nowadays, the Indonesian legal system has no fixed term for delegated legislation and no hierarchy on it. Furthermore, as many as 57.677regulations at the level of Ministries, Agencies and State Institutions have the potential to overlap regulations and become subject to judicial review in the Supreme CourtPurpose/Objective Study: This article aims to analyze the best term and hierarchy of delegated legislation in the legal system in Indonesia.Design/Methodology/Approach: This legal research conducted normative studies, by examining previous studies on delegated legislation and Electronic and Information Transaction (EIT) law to imagine the delegated legislation type and hierarchy. The data was analyzed by a prescriptive method to give a new idea regarding delegated legislation in Indonesia's legal system.Findings: This paper finds no fixed term for delegated legislation in the Indonesian legal system. There is a loophole in the Indonesian legal system related to delegated legislation. However, some scholars argue that delegated legislation in Indonesia can be found in Government Regulation, Presidential Regulation, Local Regulation and beleidsregel in Article 8 Paragraph (1) Law Number 12 of 2011 concerning Establishing Statutory Regulation and its amendment. As a suggestion, the amendment of the Law on Establishing Statutory Regulation is a must in carrying delegated legislation definition, purpose and hierarchy.Paper Type: Research Article
