Abstract

This article aims to provide an overview of the justice system for juvenile offenders of violent crimes. Criminal acts are not just committed by grownups but the perpetrator can also be a child. Child are the golden generation for the nation and state, for that children need attention, protection and coaching to ensure their growth and development, mindset, mentality and behavior. Aggressive behavior in children often stems from children's habits in the use of mobile phones that contain video games that refer to violent games. The event that often occurs today is the crime of persecution where the perpetrator is a child. The factor of acts of abuse committed by children is an action taken by children to express their disappointment with the victim which results in physical violence which often results in injuries, disabilities, and even death. This study identifies the procedure for giving demands for cases of abuse committed by children. Abstract

Indonesia merupakan negara yang memiliki tingkat kerawanan bencana yang tinggi sehingga menuntut adanya tanggung jawab negara dalam memberikan perlindungan dan penanganan terhadap korban bencana. Tanggung jawab tersebut merupakan perwujudan tujuan negara sebagaimana diamanatkan dalam Pembukaan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 serta prinsip negara hukum dan negara kesejahteraan. Penelitian ini bertujuan untuk menganalisis pengaturan tanggung jawab negara dalam penanganan korban bencana berdasarkan Undang-Undang Nomor 24 Tahun 2007 tentang Penanggulangan Bencana serta menganalisis pelaksanaannya ditinjau dari perspektif hukum tata negara. Penelitian ini merupakan penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum diperoleh melalui studi kepustakaan serta didukung oleh data hasil survei di Desa Cempa, Kabupaten Langkat.. Hasil penelitian menunjukkan bahwa pengaturan tanggung jawab negara telah memiliki landasan konstitusional dan yuridis yang kuat melalui UUD NRI Tahun 1945 dan Undang-Undang Nomor 24 Tahun 2007 yang mengatur tanggung jawab pemerintah pada tahap prabencana, tanggap darurat, dan pascabencana. Namun demikian, pelaksanaannya belum sepenuhnya optimal karena masih terdapat kendala koordinasi antarlembaga, perbedaan kapasitas pemerintah daerah, keterbatasan pendanaan, serta rendahnya pemahaman masyarakat mengenai hak-haknya sebagai korban bencana. Oleh karena itu, diperlukan penguatan koordinasi kelembagaan, peningkatan kapasitas pemerintah daerah, serta optimalisasi pelaksanaan peraturan perundang-undangan agar tanggung jawab negara dapat diwujudkan secara efektif sesuai dengan amanat konstitusi.
