Abstract

Democracy is a form of government in which power rests with the people. Freedom of speech and assembly are the fundamental foundations of a democratic state. In Indonesia, these rights are guaranteed by the constitution. However, in practice, demonstrations, which embody these freedoms, often end in violence and riots. Law enforcement responds by enforcing Article 170 of the Criminal Code against demonstrators deemed to be engaging in violence. This conflict between rights and public order creates a complex and compelling dilemma to analyze. This research employs a normative approach and case studies. It finds that the application of Article 170 of the Criminal Code must be selective and proportional to avoid violations of human rights and the principles of the rule of law.

Abstract

Rumah sakit merupakan instansi yang bergerak di bidang pelayanan kesehatan. Dalam operasional rumah sakit ada dampak negative yang perlu diperhatikan yakni limbah medis yang ditakutkan akan mencemari lingkungan dan penyebab wabah penyakit, hal ini karena di dalam rumah sakit terdapat limbah yang tidak memungkiri dapat mengandung jasad renik seperti virus dan bakteri. Sehingga, tujuan dilaksanakannya penelitian ini ialah untuk mengkaji tanggung jawab rumah sakit terhadap pengelolaan limbah medis dalam upaya pencegahan penyakit dengan studi yang dilaksanakan di RS Idaman Banjar Baru. Metode yang diterapkan ialah observasi dan studi literatur. Hasil yang diperoleh menunjukkan bahwa pada pengelolaan limbah medis di RS Idaman Banjar Baru telah sesuai dengan Peraturan Menteri Lingkungan Hidup Nomor 56 tahun 2015 sehingga proses pengelolaan limbah dapat dipertanggungjawabkan sebagaimana mestinya.

Abstract

The government has accommodated children's rights in Law Number 39 of 1999 concerning Human Rights which is an umbrella act for all forms of human rights protection in Indonesia, including children's rights. Commercial Sexual Exploitation of Children (CSEC) in girls where girls are easily persuaded, is sold at a high selling value. Consumers assume that girls are cleaner from venereal diseases and not too many suffer from them. Children who are victims of CSEC are entitled to legal protection from law enforcement, the government and the state to ensure that children's rights remain unfulfilled. Normatively, the rights of CSEC victims are adequately protected by Law Number 23 of 2002 concerning Child Protection (Articles 4-20). In this case, the protection of children's rights has acquired a stronger legal basis, because in more detail the rights and obligations of the child's executors have been regulated in such a way, including their criminal provisions. Children of CSEC victims receive special protection through Article 59 and Article 64 paragraph (3) of Law No. 23/2002. Abstract

Kajian terhadap kebijakan hukum pidana sering kali lebih menitikberatkan pada upaya represif terhadap pelaku kejahatan, sementara posisi korban cenderung terabaikan dalam proses penegakan hukum. Dalam perihal HAM, korban memiliki kepastian untuk mendapatkan perlindungan, keadilan, serta pemulihan yang layak atas penderitaan yang dialaminya. Jurnal dibentuk dalam rangka menganalisis serta mengevaluasi tindakan hukum berdasarkan hukum pidana Indonesia kepada korban tindak pidana, ditinjau dari perspektif Undang-Undang Nomor 39 Tahun 1999 tentang Hak Asasi Manusia dan instrumen hukum nasional serta internasional lainnya yang relevan. Penelitian ini menggunakan metode yuridis normatif melalui sudut pandang perundang-undangan (statute approach) serta menggunakan sudut pandang konseptual (conceptual approach), serta dianalisis berdasarkan deskriptif-analitis. Hasil riset menunjukkan bahwa meskipun sistem hukum Indonesia terdapat beberapa regulasi yang mengatur mengenai hak korban, seperti hak menerima restitusi, remunerasi, dan pemulihan, namun implementasinya masih lemah dan belum sepenuhnya berperspektif korban. Ketidakseimbangan antara perlindungan terhadap pelaku dan korban mengindikasikan adanya kekosongan normatif dan lemahnya kebijakan kriminal yang responsif terhadap korban. Lebih lanjut, penegakan hak-hak korban selalu menemui banyak kesulitan, termasuk terbatasnya akses terhadap keadilan, ketidaktahuan korban terhadap hak-haknya, serta minimnya mekanisme yang berpihak kepada korban dalam sistem peradilan pidana. Dengan demikian, diperlukan reformulasi kebijakan hukum pidana nasional yang berlandaskan dasar dan pedoman HAM dan keadilan restoratif, yang secara aktif mengintegrasikan perlindungan dan pemberdayaan korban ke dalam seluruh tahapan proses peradilan pidana. Reformasi ini mencakup penyusunan regulasi khusus tentang perlindungan korban, penguatan institusi pendukung, serta peningkatan kesadaran aparat penegak hukum akan pentingnya perspektif korban dalam penanganan perkara pidana. Dengan pendekatan tersebut, hukum pidana Indonesia diharapkan tidak hanya menjadi instrumen represif terhadap pelaku, tetapi juga menjadi alat perlindungan dan pemulihan bagi korban dalam kerangka keadilan yang menyeluruh.

Abstract

Today's child crime has grown rapidly and is heavily influenced by technological developments. Various kinds of child crimes are problematic with the law so that the swift advancement of information technology presently holds a beneficial influence on society by easily obtaining the information needed and has a negative impact because there is a lot of misleading information circulating and websites, pornographic sites. So that children who are just about to grow up or teenagers will feel curious and will most likely take actions beyond reason. So legal action is needed to safeguard minors from the impact of the conventional judicial proceedings granted to offenders of such offenses, thereby allowing the criminal justice system to prosecute the culprits of sexual assault, it is necessary to do a better alternative justice for children. However, it must be balanced for the victims as well, so that the alternative referred to as "diversion" or what is referred to as restorative justice does not feel shielded.

Abstract

This study was aimed at revealing the customary and legal issues that were applied in the practice of bride-napping in Sumba, East Nusa Tenggara (NTT). The practice of bride-napping does not give women the freedom to choose their life partner and is a violation of the law that could be punished according to article 328 of the Criminal Code (KUHP). This was field research where the researcher conducted direct interviews with the informants and elaborated the data with the related literature. The method used was normative legal research with a literature study approach. The focus of this study was on the ambiguity of the implementation of laws and regulations on the practice of bride-napping. Indonesia has issued Law of the Republic of Indonesia (UU RI) No.1 of 1974 concerning Marriage which regulates the rights and obligations of each person in marriage. Finally, the result of this study was the practice of bride-napping has deviated from its origins resulting in the violations of human rights.Keywords: forced marriage; bride-napping; Marriage Law
