Abstract

Dalam situasi hukum perundang-undangan yang mengatur tentang Hukum Pidana,dimana bersifat elitis, maka apabila penerapan hukum perundang-undangan dilakukandengan menggunakan konsep hukum sebagaimana yang dipahami dalam tradisiberpikir legal-positivism; yang memandang hukum hanya sebatas pada lingkaranperaturan perundang-undangan dan yang melakukan pemaknaan perundang-undangansecara formal-tekstual; dengan mengabaikan nilai-nilai sosial dalam masyarakat, makayang akan terjadi adalah hukum yang mengabdi kepada kepentingan elit, bukan kepadakepentingan masyarakat luas, sehingga tujuan hukum untuk mewujudkan keadilan akansemakin jauh dari apa yang diharapkan. Rekonstruksi analogi dalam hukum pidana diIndonesia untuk masa yang akan datang sangatlah diperlukan sebagai upaya untukmemperbaharui hukum pidana di Indonesia melalui pendekatan hukum progresif, yaknidengan cara dari atribut-atribut yang melekat, yang mengutamakan penjatuhan sanksipidana, terutama pidana yang merampas kemerdekaan seseorang sebagai ultimumremidium, yang mengutamakan pula manusia itu diatas hukum, dan bukan sebaliknya.Hukum hanya sebagai sarana untuk menjamin dan menjaga berbagai kebutuhanmanusia. Hukum tidak lagi dipandang sebagai dokumen yang absolut dan ada secaraotonom. Hukum progresif yang bertumpu pada manusia, membawa konsekuensipentingnya kreativitas. Kreativitas dalam konteks penegakan hukum selaindimaksudkan untuk mengatasi ketertinggalan hukum, ketimpangan hukum, jugadimaksudkan untuk membuat terobosan-terobosan hukum bila perlu melakukan rulebreaking. Terobosan-terobosan ini diharapkan dapat mewujudkan tujuan kemanusiaanmelalui bekerjanya hukum, yaitu hukum yang membuat bahagia.

Abstract

Democracy transition era which is happening in Indonesia recently, inspires wider demand of the improvement of political opportunity for all its citizens. It opens a leeway for women to posit themselves in political arena which has been legitimated and been accommodated by UUD 45. As the irony of the fact, there is a complicated interest and tight negotiation process between the dominant political ideology and the developing inspiration. In determining people's representative in the parliament in each of political parties, women are still holdding the lowest number. It indicates that there is still men’s hegemony to “conquere” the parliament. This ironical fact of political rights is not only due to the various interpretation of 30% regulation of women’s proportion but also the weaknesses of law enforcement in politics. The lowest level of law enforcement in politics  results in orientation of political feminism bias which echoes gender equality and equity. It is not easy to give meaning and interpretation to regulation texts of women’s 30% proportion in the parliament. Hence, it should be looked holistically, responsibly as well as progressively.Kata kunci : paradigma, teks, keterwakilan perempuan

Abstract

Hukum pidana adat terdapat kaedah-kaedah yang mencerminkan nilai-niIai moral yang tinggi yang berlaku secara universal bagi seluruh masyarakat di Indonesia. Dengan demikian dapatlah disimpulkan bahwa hukum pidana adat telah mencerminkan nikai-nilai dalam pendekatan hukum progresif. Oleh karena itu, hukum pidana adat adalah mutlak perlu mendapatkan tempat bagi pembentukan KUHP Nasional di masa yang akan datang sebagai salah satu upaya pembaharuan hukum. Namun kiranya perlu dipertimbangkan bahwa didalam memberikan tempat kepada hukum pidana adat bagi pembentukan KUHP Nasional tersebut hendaknya dicari kaedah-kaedah yang hanya berlaku secara universal bagi seluruh masyarakat. Kaedah-kaedah tersebut kemudian dikodifikasikan dalam KUHP Nasional, sehingga ia akan menjadi kaedah-kaedah KUHP Nasional semata-mata, bukan sebagai kaedah hukum pidana adat lagi. Dalam hal ini berarti bahwa kedudukan hukum pidana adat telah digantikan hukum pidana nasional, namun yang tetap dijiwai perasaan hukum yang hidup didalam seluruh masyarakat di Indonesia. Adapun konsep transplatasi sanksi bagi pelanggar hukum pidana setempat, sebaiknya pengadilan memilih menjatukan tindakan (maatregel) yang dipertimbangkan dapat memberikan beban bagi si pelanggar, namun sebaliknya dapat memberikan manfaat langsung bagi rnasyankat setempat. Hal ini bertujuan mengembalikan keseimbangan yang ada didalam masyarakat yang bersangkutan. Hal yang kiranya perlu mendapat perhatian didalam menjatuhkan sanksi kepada si pelanggar hukum pidana setempat adalah : 1. Beratnya sanksi yang berupa tindakan tersebut disesuaikan berat ringannya pelanggaran yang dilakukan. 2. Beratnya sanksi juga disesuaikan dengan tingkat kemampuan si pelanggar yaitu sejauh mana ia dapat melaksanakan sanksi itu. 3. Apabila pelanggaran hukum pidana adat setempat tersebut ternyata terdapat pidananya didalam KUHP NasionaI, maka yang barus dipergunakan banyalah kaedah dan sanksi yang dirumuskan didalam KUHP Nasional. Customary criminal law has methods that reflect high moral values that apply universally to all people in Indonesia. Thus it can be concluded that customary criminal law reflects values in a progressive legal approach. Therefore, customary criminal law is absolutely necessary to get a place for the formation of the National Criminal Code in the future as an effort to reform the law. However, it is important to consider that in providing a place for customary criminal law for the establishment of the National Penal Code, methods should be sought that are universally applicable to all people. These methods are then codified in the National Criminal Code, so that they will become the National Criminal Code solely, not as a customary criminal law method anymore. In this case it means that the position of customary criminal law has been replaced by national criminal law, but that is still imbued with a feeling of law that lives in all people in Indonesia. As for the concept of transplanting sanctions for local criminal law offenders, the court should choose to unite actions (maatregel) which are considered to be a burden on the offender, but instead can provide direct benefits to the local community. This aims to restore the existing balance in the community concerned. Things that need attention in imposing sanctions on local criminal offenders are: 1. The severity of sanctions in the form of such actions is adjusted for the severity of the violations committed. 2. The severity of the sanction is also adjusted to the level of the offender's ability, namely the extent to which he can implement the sanction. 3. If the violation of the local customary criminal law turns out to have a criminal offense in the National Criminal Code, then only a number of methods and sanctions should be used which are formulated in the National Criminal Code.

Abstract

This article aimed to discuss the Islamic law notes on child-friendly justice and the importance of protecting children's rights during the juvenile process. The reform of Juvenile Justice in Indonesia was based on the UN convention, where on January 26, 1990, in New York, the Indonesian Government signed the 1989 Convention on the Rights of Children. Thus, to protect children through criminal law, paying attention to the principles in the Convention on the Rights of the Child has been the norm. The Child Protection Law in Indonesia has regulated the age limit for a child who can be held accountable. The existence of provisions regarding the minimum age limit for children in the law is what is required by international documents, especially regarding the minimum age of criminal responsibility, namely at least 12 years. Such provisions are parallel to The Beijing Rules, which recommend an age limit that is not too low. The problem is the provision of the law that children under 12 years (meaning between 8-12 years) can still be processed for trial and can be subject to action. Even at the age of 8 years, it is still possible to process. The problem is whether the eight-year age limit needs to be higher. Even though they were not punished and were only subject to action, the experience during the process of being submitted to trial did not bring stigma and negative impacts for children of young age. Abstract

The purpose of this study was to analyze the Banyumas District Court Decision Number 05/Pid.Sus-Anak/2015/PN-Bms and analyze the recidivism concept in Indonesia's juvenile criminal justice system. This study uses a normative doctrinal method with legal, case, and conceptual approaches. The decision of the Banyumas District Court Number 05/Pid.Sus-Anak/2015/PN-Bms contained a case of abuse by a child who had previously been punished with three months in prison by the Purbalingga Court for committing the crime of theft. The concept of recidivism in the juvenile criminal justice system in Indonesia was based on Article 7 paragraph (2) letter b of Law Number 11 of 2012, which explained that children who commit recidivists could not be diverted.

Abstract

This research examines the legal and practical challenges faced by notaries in the process of drafting and approving cooperative establishment deeds in Manado. The study highlights the importance of notaries in providing legal certainty for cooperatives, yet identifies significant gaps in the legal framework governing their authority. Using an empirical approach, data were collected through interviews and observations, revealing issues such as lack of standardized deed formats and insufficient coordination with relevant authorities. The findings suggest that these obstacles not only delay the establishment process but also undermine the credibility of cooperatives as legal entities. The study concludes with recommendations for improving notarial services and ensuring that cooperatives can be established with greater efficiency and legal security.

Abstract

This study aims to analyze the role of premarital education and guidance outcomes in building family harmony and supporting national resilience. The family as the smallest social unit has a strategic role in creating a strong and stable society, which in turn supports national resilience. To achieve this goal, the research used a Systematic Literature Review (SLR) approach that utilized PRISMA guidelines in identifying, screening and synthesizing relevant literature. Through in-depth analysis, the study found that premarital education and guidance play a crucial role in shaping individuals' mindsets and skills, which are essential in leading a harmonious married life. Moreover, these programs are designed to equip prospective couples with the knowledge and skills necessary to create a balanced and healthy relationship, ultimately contributing to national resilience. The government has an important role in developing effective strategies through premarital education and guidance programs, including increased accessibility, integration of family policies, and program monitoring and evaluation. This comprehensive approach is expected to create stable and productive families, which are the foundation for national resilience. This study suggests strengthening policies and programs on premarital education and guidance, increasing accessibility, especially in remote areas, effective monitoring and evaluation, and improving the quality of human resources through training premarital counselors. In conclusion, premarital education and guidance play an important role in maintaining family harmony and strengthening national resilience.
