Abstract

Penulisan artikel ini dilakukan sebagai bentuk dari pemenuhan dari tugas PJBL hukum islam yang dimana berisi tentang penyelesaian sengketa wakaf serta keikutsertaan pengadilan dalam menyelenggarakan sengketa wakaf. Wakaf merupakan menghalangi atau menahan harta benda atau pun kuasa yang digunakan untuk kebajikan demi ibadah kepada Allah SWT. Akan tetapi, hal ini tak luput dari adanya keikusertaan dalam sengketa yang terjadi dalam pelaksanaan wakaf tanah. Hal ini dapat dilakukan dengan berbagai tindakan baik secara preventif maupun secara represif. Dalam upaya penyelesaian sengketa secara preventif dapat dilakukan dengan musyawarah, arbitrase, mediasi. Akan tetapi, jika sengketa yanh terjadi tidak dapat dilakukan secara baik-baik antara kedua belah pihak maka hal ini bisa dilakukan dengan cara terakhir yaitu dengan diadili lewat pengadilan.

Abstract

Marriage is a spiritual and physical bond between one man and one woman as husband and wife with the aim of forming a happy family based on the belief in the Almighty God. In a marriage, forming a happy family certainly requires cooperation between each party, both husband and wife. If both parties have different goals, it will trigger problems in the household. Problems in the household can influence divorce between both parties, namely husband and wife. Divorce is a condition in the household where there is no common ground for harmony and harmony in the relationship between husband and wife so that it can be decided by the District Court for those of non-Islamic religions or the Religious Court for those of Islamic religion. Considering that Indonesia is a country of law where every action has rules, if seen from the principle of Nebis In Idem, this problem is no longer acceptable. However, in this divorce case the lawsuit was accepted by the judge and the judge decided again with a different decision. Based on this, the formulation of the problem is how to apply the Ne Bis In Idem Principle by the judge in divorce cases

Abstract

Gender equality in the workforce is a fundamental issue closely linked to human rights and sustainable economic development. This study examines the paradox in the implementation of maternity leave rights as part of the legal protection for female workers—where a right intended to provide protection instead becomes a barrier during recruitment processes. The aim of this research is to analyze the relationship between the provisions on maternity leave rights and the principle of legal equality in the workplace, as well as to identify efforts that companies can undertake to protect female workers from discrimination and to promote gender equality. This study employs normative legal research methods with a qualitative approach by analyzing various national and international regulations related to the protection of female workers. Primary data were obtained through an in-depth review of Undang-Undang No. 13 Tahun 2003 tentang Ketenagakerjaan, Undang-Undang Dasar Negara Republik Indonesia Tahun 1945, and their implementing regulations, as well as international conventions such as CEDAW and ILO standards. The analysis was carried out using a deductive approach to identify the gap between legal norms and the reality of their implementation in practice.
