Abstract

Notaries/PPAT can act as plaintiffs' witnesses if they are aware of incidents that become the core of disputes beyond their notarial duties. This study discusses the presence of Notaries/PPAT as plaintiffs' witnesses based on Civil Law and Law Number 2 of 2014 concerning the position of Notaries. A case study was conducted on the decision of the Semapura Bali District Court Number 53/PDT.G/2020/PN.SRP on November 5, 2020. This research is normative legal and socio-legal research with a descriptive-analytic approach. Data were collected from secondary and primary sources and analyzed qualitatively. The results show that the presence of Notaries/PPAT as plaintiffs' witnesses considers Civil Law and the Law concerning the position of Notaries/PPAT. The presence of Notaries/PPAT as plaintiffs' witnesses can be rejected based on the right of refusal regulated by the law. The Notary Honorary Board (MKN) acts as legal protection, assesses the authority of Notaries/PPAT, and maintains confidentiality by legal provisions. The role of Notaries/PPAT as a witness in court is to provide legal explanations.

Abstract

Road Infrastructure Development Projects not only serve to facilitate and accelerate access to communities everywhere but also as a means to stimulate economic growth and tourism in a region. In the process of liberation of rights, landowners must be given a sense of justice and legal certainty in paying losses fairly and in accordance with the procedures regulated by law. For that I raised the title of the research “Compensation of Land Construction Road Tol Medan-Tebing High Year 2013” to understand the legal protection that Pemkot has in acquiring land and the mechanism of solving the problem of land acquisition. The types of research used are normative juridic and qualitative descriptive. Techniques of data collection through interviews and observations and libraries. The data is collected and analyzed qualitatively. According to paragraph 2, no. 2 In 2012, the legal protection in land acquisition for the public interest includes the provision of fair and fair compensation to the legal party. Articles 17 and 18 of Kepres No. 36 of 2005 regulate the determination of damages. In accordance with the Law No. 2 of 2012, the process of procurement of highway tolls Field-Tebing began.

Abstract

Abstract: The plaintiffs' lawsuit against the implementation of the mortgage execution auction occurred because the auction was sold at an unreasonable price. The sale of mortgage objects below market price is carried out if the object is not sold in the first sale, so the selling price must be lowered until the object is sold and the final sales value limit must not be below the liquidity value, as regulated in Article 49 of PMK Number 27 / PMK.06 / 2016 concerning Auction Implementation Guidelines. This study discusses three problems, namely: 1) Procedures for implementing mortgage execution auctions in default cases at the State Assets and Auction Service Office (KPKNL); 2) Legal protection for creditors and auction winners against debtor lawsuits regarding the implementation of mortgage execution auctions in default cases; and 3) Analysis of the judge's considerations on the decision of the Supreme Court of the Republic of Indonesia Number 1143 PK / PDT / 2022 concerning lawsuits for implementing mortgage execution auctions through public auctions.Keyword: Lawsuit, Execution of Mortgage Right Auction, State Property and Auction Service Office Abstrak: Gugatan para penggugat atas dilaksanakannya lelang eksekusi hak tanggungan, terjadi karena pelelangan tersebut dijual dengan harga yang tidak wajar. Penjualan objek hak tanggungan di bawah harga pasar dilakukan apabila dalam penjualan pertama objek tersebut tidak laku terjual, sehingga harga penjualannya harus diturunkan sampai objek tersebut terjual dan batas akhir nilai penjualan tidak boleh di bawah nilai likuiditas, sebagaimana diatur dalam Pasal 49 PMK Nomor 27/PMK.06/2016 tentang Petunjuk Pelaksanaan Lelang. Penelitian ini membahas tiga permasalahan, yaitu: 1) Prosedur pelaksanaan lelang eksekusi hak tanggungan dalam perkara wanprestasi pada Kantor Pelayanan Kekayaan Negara dan Lelang (KPKNL); 2) Perlindungan hukum bagi kreditur dan pemenang lelang terhadap gugatan debitur atas dilaksanakannya lelang eksekusi hak tanggungan dalam perkara wanprestasi; dan 3) Analisis pertimbangan hakim atas putusan Mahkamah Agung RI Nomor 1143 PK/PDT/2022 tentang gugatan pelaksanaan lelang eksekusi hak tanggungan melalui pelelangan umum.Kata kunci: Gugatan, Pelaksanaan Lelang Eksekusi Hak Tanggungan, Kantor Pelayanan Kekayaan Negara dan Lelang

Abstract

One of the financing institutions in Indonesia is the Federal International Finance (FIF GROUP) company. PT. Federal International Finance Tembung Branch, Deli Serdang City is one of the company's branches engaged in multipurpose financing by means of funding facilities or also called Danastra. In terms of lending, FIF offers loan products using collateral in the form of BPKB (Motor Vehicle Ownership Book), financing activities are carried out through a credit provision system where payments by consumers are made in installments or periodically. This study uses a normative legal research method, namely research conducted by examining library materials or secondary materials. The purpose of this study is to determine the legal protection of the parties in multipurpose financing by means of funding facilities at PT. Federal International Finance (FIF Group) Tembung Branch, Deli Serdang. Often the provisions or rules that have been made and agreed upon by both parties in practice do not meet and do not comply with the contents of the agreement, whether it is intentional or due to negligence of the parties, where the agreement implemented is not in accordance with what is desired. In addition, there is also a factor that is caused by consumers not knowing the standard regulations that have been made by the creditor, because they are more concerned with the goods they take rather than paying attention to the regulations set out in the agreement, so that there is a default in the implementation of the agreement.

Abstract

Abstract: Using financing facilities with the principles of Islamic law is a consumer's right from a financing institution. Therefore, the emergence of laws and regulations that regulate financing facilities can help the public in determining the financing facilities they want. The research method used in this writing is normative juridical research. The forms of research approach used in this research are the statutory approach and the case approach. Data sources in this research include primary, secondary legal materials and non-legal materials using library data collection techniques. To analyze all the legal materials that have been collected, this research uses qualitative data analysis. The absolute competence of the Religious Courts is only to adjudicate sharia economic cases based on "sharia economics" which are fully regulated in the explanation of Article 49 letter (i) of the Religious Courts Law and the MUI DSN Fatwa on sharia financial institutions and the MUI DSN Fatwa on murabahah financing. Likewise, financial institutions which in the research are financing companies with conventional cooperative legal entities, are expected not to commit unlawful acts such as disbursing murabahah financing which is not within their rights as regulated in statutory regulations. Keyword: Disputes, Conventional Cooperatives, Financing, Murabahah. Abstrak: Menggunakan fasilitas pembiayaan dengan prinsip-prinsip syariat Islam merupakan hak seorang konsumen dari lembaga pembiayaan. Oleh karena itu, munculnya undang-undang maupun peraturan perundang-undangan yang mengatur fasilitas pembiayaan dapat membantu masyarakat dalam menentukan fasilitas pembiayaan yang diinginkannya. Metode Penelitian yang dipakai dalam penulisan ini yaitu jenis penelitian yuridis normatif. Bentuk pendekatan penelitian yang digunakan dalam penelitian ini adalah pendekatan perundang-undangan (statute approach) dan pendekatan kasus (case approach). Sumber data dalam penelitian ini meliputi bahan hukum primer, sekunder dan bahan non-hukum dengan teknik pengumpulan data kepustakaan. Untuk menganalisis seluruh bahan hukum yang telah terkumpul, dalam penelitian ini menggunakan analisis data kualitatif. Kompetensi absolut Pengadilan Agama hanya mengadili perkara ekonomi syariah yang berdasarkan “ekonomi syariah” yang diatur sepenuhnya dalam penjelasan Pasal 49 huruf (i) UU  Peradilan Agama dan Fatwa DSN MUI tentang lembaga keuangan syariah maupun Fatwa DSN MUI tentang pembiayaan murabahah. Sama halnya dengan lembaga keuangan yang dalam penelitian adalah perusahaan pembiayaan berbadan hukum koperasi konvensional, diharapkan tidak melakukan perbuatan melanggar hukum seperti menyalurkan pembiayaan murabahah yang bukan menjadi haknya sebagaimana diatur di dalam peraturan perundang-undangan. Kata kunci: Sengketa, Koperasi Konvensional, Pembiayaan, Murabahah.

Abstract

This research discusses the preferential rights of creditors in the implementation of fiduciary security execution auctions in Indonesia, as well as the impact of the Constitutional Court decision No. 18/PUU-XVII/2019 on these rights. Prior to the decision, creditors could execute fiduciary security objects without going to court. However, the Constitutional Court's decision changed the mechanism by requiring the debtor's consent or a court decision. This research uses normative legal research methods with a case and statutory approach. The results show that the Constitutional Court's decision aims to protect debtors' rights from creditors' arbitrary actions, although it also creates legal uncertainty for creditors.
