Abstract

This research is normative legal research, an explanatory descriptive nature that aims to describe, disclose and explain the relationship between the non-criminal investigation of consumer protection with consumer guarantee agreements. The analysis is carried out using a juridical approach method which is then synchronized vertically or horizontally to related laws to see the existence of harmonization and certainty in the existing legal system. To further sharpen the results of the study also carried out an analysis of the effectiveness of the case. The results of the study provide an illustration that the Fiduciary Security Act has a problem in Article 15 regarding the provisions of the procedure for execution that is contrary to the HIR / RBg. Likewise, between Article 54 paragraph (3) and Article 56 paragraph (2) of the Consumer Protection Act, an inconsistency occurs in its application and implementation. With respect to agreements containing standard clauses, business actors and / or their management can be criminalized, in accordance with Article 18 in conjunction with Article 62 of the Consumer Protection Act. It is recommended that the Government and the House of Representatives of the Republic of Indonesia be able to revise these articles in order to realize legal certainty for all parties.

Abstract

Salah satu doktrin hukum yang diadopsi adalah apa yang dikenal dengan arbitrase Ex Aequo et Bono. Menurut doktrin ini, arbiter dapat memeriksa dan memutus sengketa yang diajukan kepadanya dengan tidak berdasarkan ketentuan hukum materiil dan formil yang berlaku, melainkan berdasarkan prinsip-prinsip keadilan dan kepatutan di luar koridor ketentuan hukum, seperti prinsip etika dan moral apabila sang arbiter diotorisasi oleh para pihak yang bersengketa. Tujuan penelitian untuk menganalisis kewenangan arbiter dalam menerapkan asas Ex Aequo et Bono dalam memutus sengketa bisnis pada arbitrase, dan perbandingan penerapan asas Ex Aequo et Bono pada Arbiter BANI dan Hakim Pengadilan Negeri. Penelitian ini adalah penelitian normatif bersifat deskriptif analisis dan digunakan pendekatan perundang-undangan dan pendekatan konseptual. Berdasarkan hasil penelitian ditemukan bahwa Kewenangan arbiter dalam memutus perkara arbitrase secara Ex Aequo et Bono terdapat pada pasal 1 ayat (3) UU No. 30 Tahun 1999, pelaksanaan putusan arbitrase yang menggunakan asas ini muncul apabila para pihak menyepakatinya dan arbiter untuk menyelesaikan perkara menggunakan keadilan dan kepatutan di luar Undang-undang. Apabila arbiter diberi kewenangan untuk menggunakan asas ini, maka arbiter harus menggali keadilan tidak hanya dalam Undang-undang, namun berdasarkan norma objektif yang tidak tertulis, keyakinan agama, akal sehat dan hati nurani. Namun begitu akal sehat dan hati nurani yang digunakan tentu saja tidak bersifat subjektif sehingga akan mendapatkan putusan yang tidak adil dan benar.

Abstract

Terbitnya Instruksi Presiden Nomor 1 Tahun 2022 mewajibkan pembeli untuk terdaftar di BPJS Kesehatan dalam pendaftaran peralihan hak tanah karena jual beli, menambahkan persyaratan baru. Penelitian ini bertujuan mengevaluasi sinkronisasi regulasi keanggotaan BPJS Kesehatan dalam pendaftaran peralihan hak tanah, implementasi persyaratan oleh Kantor Badan Pertanahan Nasional Kota Medan, dan penundaan pelaksanaan. Penelitian normatif melibatkan wawancara dan studi literatur, menganalisis bahan hukum primer, sekunder, dan tersier secara kualitatif. Temuan menunjukkan sinkronisasi vertikal tidak praktis untuk Instruksi Presiden sebagai regulasi kebijakan. Sinkronisasi horizontal antara Undang-Undang Pokok Agraria Nomor 5 Tahun 1960 dan Undang-Undang Badan Penyelenggara Jaminan Sosial Nomor 24 Tahun 2011 kurang relevan. Kantor Badan Pertanahan Nasional Kota Medan awalnya menerapkan persyaratan kartu BPJS Kesehatan, namun surat edaran pada 18 Agustus 2022 mengindikasikan penundaan, menunjukkan ketidakselarasan. Penundaan sesuai karena Instruksi Presiden Nomor 1 Tahun 2022 tidak memiliki kekuatan hukum mengikat. Namun, surat edaran tidak menyebutkan durasi penundaan, menimbulkan ketidakpastian hukum dan masalah manfaat.

Abstract

The development of civil law in resolving disputes needs to be addressed by implementing court decisions that have permanent legal force in the form of jurisprudence. Civil law problems that are developing rapidly are unable to be followed by existing legal regulations, and are not even sufficient to answer all the problems in civil law itself. The research uses a normative juridical research type. Jurisprudence has a big role and contribution in the development of civil law to fill legal gaps and provide legal certainty. Article 10 Paragraph (1) Law no. 48 of 2009 states that "Courts are prohibited from refusing to examine, try and decide on a case submitted on the pretext that the law does not exist or is unclear, but is obliged to examine and try it". The position of jurisprudence in Indonesia, which adheres to a civil law system, adheres to the principle of freedom or is "persuasive precedent". Efforts to bring about legal convergence in certain cases are not possible. However, there are still legal similarities which can be used as a legal basis for resolving various problems in civil law in Indonesia. The role of the Supreme Court is very important in reviewing judges' decisions that are suitable for use as jurisprudence and carrying out an inventory of decisions in the field of civil law that constitute legal reform.

Abstract

The principle of good faith is an important principle in contract law and is accepted in various legal systems, but until now the doctrine of good faith is still controversial. Good faith is known as 2 (two) phases, namely the pre-contract phase and the contract implementation phase. The pre-contract phase is called subjective good faith, which means good faith is more directed towards honesty, while good faith in the contract implementation phase is called objective good faith, which means good faith is interpreted as appropriateness and propriety or fairness. A work agreement is an agreement between a worker/laborer and an entrepreneur or employer which contains work conditions, rights and obligations for the parties. The definition of work conditions is the rights and obligations of employers and workers that have not been regulated in statutory regulations. The work agreement made must not conflict with existing labor agreements or Collective Work Agreements (KKB). This research uses a type of normative legal research sourced from secondary data related to the research topic, secondary data that has been compiled systematically and then analyzed qualitatively. From the research conducted, it was found that the position of the principle of good faith is very important not only at the contract creation (signing) stage and post-contract creation (implementation) stage, but also must exist at the pre-contract creation (drafting) stage because in contract law practice judges use their authority to interfere with the contents of the contract. The legal consequence of a collective work agreement that does not contain the principle of good faith is that if the subjective requirements relating to the subject of the PKB are incomplete, or in other words the conditions that must be fulfilled are not appropriate for those who want to make a PKB, then the PKB that has been made can be requested for cancellation by the trade union/labour union. If the cancellation is not requested by both parties concerned, then the CLA remains valid for the parties. The first legal effort was carried out by PT. United Rope with workers/labor unions is by deliberation to reach a consensus first, although in resolving disputes if there is no good faith in the collective work agreement, it is through 2 (two) systems, namely first, non-litigation/outside the industrial relations court, namely resolution by means of bipartite, mediation, conciliation and arbitration, while the second solution is litigation

Abstract

A loan secured by a mortgage, if the debtor defaults or breaches the agreement, meaning the debtor is unable to fully repay the debt to the bank, and it ultimately becomes a non-performing loan, requires the bank, as the creditor, to take prompt action to resolve the issue. The fastest solution for the bank to settle the non-performing loan is to conduct the sale of the mortgaged property at the local State Property and Auction Service Office (KPKNL). The objective of this study is to understand the mechanism for resolving non-performing loans secured by a mortgage through voluntary sale at the BRI Padangsidimpuan Branch. The method used in this study is normative legal research, which refers to legal norms and is conducted through literature review to obtain secondary data in the form of primary, secondary, and tertiary legal materials related to the issues being studied. This research is descriptive-analytic in nature. The study is based on relevant regulations and legal materials, with field research conducted at the BRI Padangsidimpuan Branch. The data analysis method used is qualitative, obtained through interviews with representatives of the BRI Padangsidimpuan Branch. The research findings reveal that the legal provisions for resolving non-performing loans secured by a mortgage that are sold voluntarily relate to the execution of the mortgaged property. Abstract

This study analyzes the legal implications and risk mitigation strategies in the use of uncertified land as credit collateral at PT Bank Sumut. The bank plays an important role in supporting local economic growth through the provision of credit to SMEs, but faces major challenges related to the legality of uncertified land. The research method used is normative juridical, supported by empirical data to examine relevant laws and regulations, such as Law Number 10 of 1998 concerning Banking and Law Number 4 of 1996 concerning Dependent Rights. The results of the study show that land that has not been certified as collateral increases legal risks for banks. Bank Sumut has developed a comprehensive credit assessment strategy and mitigation measures, such as independent assessments and credit restructuring, to mitigate the associated risks. In conclusion, this practice requires the strict application of the prudential principle.

Abstract

This article aims to analyze the role of BANI Medan in resolving business settlements that occur between perpetrators and the government in Medan City. This research will also examine the factors that cause default in cooperation agreements as well as settlement efforts made by BANI Medan. Data was collected through document study, interviews with related parties, and direct observation of arbitration cases at BANI Medan and analyzed qualitatively. This study concludes that BANI Medan plays an important role in resolving business peace by providing efficient, fast and confidential arbitration. While there are challenges such as lack of awareness about arbitration, the benefits are clearly greater. With the increasing complexity of business in Medan, BANI's role is increasingly relevant. To prevent default in business agreements, it is important to draw up clear contracts, manage finances well, and understand the law. BANI Medan helps maintain a stable business environment and reduces sustainability risks.

Abstract

This study seeks to examine and elucidate the significance of the principle of good faith within the national legal framework, as well as to develop norms pertaining to good faith in the context of operational cost recovery for production sharing contracts in Indonesia's oil and gas industry. This study utilizes a normative legal methodology alongside a legislative framework. The sources of data encompass essential legal materials, including legislation, journal articles, books, and pertinent research reports that contribute to the discourse. The analysis of the data is performed qualitatively through a juridical-philosophical lens, developing arguments rooted in legal philosophy, legal theory, and various legal principles. The findings reveal that the principle of good faith in the operational cost recovery of production sharing contracts in Indonesia is governed at each stage of the contract to safeguard the interests of disadvantaged parties. This regulation addresses the essential principle of good faith that all parties must adhere to in order to guarantee the equitable execution of rights and obligations. In the context of operational cost recovery for production sharing contracts in Indonesia, good faith is characterized by adherence to and compliance with audit results, reflecting a commitment to the proper execution of the business contract's terms. The operational cost recovery system is anticipated to serve as a reimbursement mechanism for expenses associated with oil and gas production.

Abstract

Abstrack: This study aims to examine the socialization of arbitration based on Law No. 30 of 1999 concerning Arbitration and Alternative Dispute Resolution to business actors, identify factors that cause minimal familiarity of business actors with the Indonesian National Arbitration Board (BANI), and evaluate the role and existence of BANI in resolving business disputes in North Sumatra. Using a normative juridical research method, this study relies on secondary data sources from library materials, legal principles, legal theories, books, and laws and regulations. The results of the study indicate that although arbitration offers advantages such as a simple process, short time, low cost, and mutually beneficial settlements, the lack of knowledge and socialization about BANI among business actors hinders the use of arbitration as a dispute resolution method. Therefore, increased socialization and education are needed so that more business actors understand and use arbitration, especially through BANI, in resolving their business disputes. Keyword: BANI (Indonesian National Arbitration Board), dispute resolution Abstrak: Penelitian ini bertujuan untuk mengkaji sosialisasi arbitrase berdasarkan Undang-Undang No. 30 Tahun 1999 tentang Arbitrase dan Alternatif Penyelesaian Sengketa kepada pelaku usaha, mengidentifikasi faktor-faktor yang menyebabkan minimnya daya kenal para pelaku usaha terhadap Badan Arbitrase Nasional Indonesia (BANI), serta mengevaluasi peran dan eksistensi BANI dalam penyelesaian sengketa bisnis di Sumatera Utara. Dengan menggunakan metode penelitian yuridis normatif, penelitian ini mengandalkan sumber data sekunder dari bahan pustaka, asas hukum, teori hukum, buku-buku, dan peraturan perundang-undangan. Hasil penelitian menunjukkan bahwa meskipun arbitrase menawarkan keunggulan seperti proses yang sederhana, waktu singkat, biaya murah, dan penyelesaian yang saling menguntungkan, kurangnya pengetahuan dan sosialisasi tentang BANI di kalangan pelaku usaha menghambat pemanfaatan arbitrase sebagai metode penyelesaian sengketa. Oleh karena itu, diperlukan peningkatan sosialisasi dan edukasi agar lebih banyak pelaku usaha memahami dan menggunakan arbitrase, khususnya melalui BANI, dalam penyelesaian sengketa bisnis mereka. Kata Kunci: BANI ( Badan Arbitrase Nasional Indonesia), sengketa , penyelesaian
