Abstract

Writing this article aims to find out how law enforcement is viewed from the perspective of problems and also the handling of Illegal Fishing carried out by traditional sailors from Pantai Labu in Malaysian waters. The problem is focused on law enforcement in Malaysian waters against Illegal Fishing by traditional seafarers. In order to approach this problem, a theoretical reference is used from the 1982 UNCLOS ratification concerning sea waters or ZEE. The data were collected through interviews and searches through literature studies, as well as utilizing the media and articles related to the issues being discussed and analyzed qualitatively. This study concludes that traditional seafarers from Pantai Labu have been carrying out Illegal Fishing by stealing fish in the Malaysian border waters. Illegal Fishing is subject to sanctions in accordance with the provisions of Article 73 UNCLOS 1982 which relates to Illegal Fishing, if foreign vessels do not comply with the laws and regulations of the coastal state in terms of conservation of fishery resources, the coastal state may arrest the vessel with imprisonment according to age. minimum confinement of 10 days – 2 years and confiscation of vessels and fish caught.

Abstract

Di Indonesia, sering terjadi perbedaan upah antara gender laki-laki dan perempuan. Perbedaan upah ini disebut ketidakseimbangan upah. Hal ini terjadi ketika dua orang dalam satu perusahaan memiliki kualifikasi, pengalaman dan kemampuan kerja yang sama, namun salah satu dari mereka tidak mendapatkan gaji yang sama. Situasi semacam ini dianggap diskriminatif. Namun kesenjangan upah di Indonesia masih besar. Tujuan jurnal ini adalah menyajikan data statistik perbandingan gaji/upah berdasarkan gender, faktor-faktor yang mempengaruhi pendapatan minimum perempuan dibandingkan laki-laki, peran perempuan dalam dunia kerja, dan posisi perempuan sebagai tulang punggung dari keluarga. Dibahas juga tanggapan pemerintah dan upaya mengatasi masalah ini. Metode penelitian yang digunakan penulis dalam penelitian ini adalah penelitian kepustakaan, yaitu menggabungkan data dengan membaca dan menganalisis data dari sumber bersama dan mengolahnya menjadi jurnal. Perbedaan gender terdapat di sebagian besar negara di dunia, namun hal tersebut disertai dengan diskriminasi yang berbeda bentuknya. Bentuk diskriminasi yang paling umum adalah upah atau pendapatan dari suatu usaha. Meski bekerja di bidang yang sama, laki-laki dan perempuan memperoleh gaji yang berbeda. Terkait pengupahan, Indonesia masih belum bisa menetapkan pengupahan berdasarkan prinsip pengupahan yang adil dan berdasarkan hak asasi manusia.

Abstract

Splitting a case file is defined as the act of creating a new case file with more than one defendant. The purpose of the research is to find out the rationale for splitting cases, the legal basis, the impact and challenges in the implementation of splitting cases. The method used in this research is descriptive normative legal research with data collection techniques through observation at the Medan District Court and collection of written references. Splitsing is regulated in the provisions of Article 142 of the Criminal Procedure Code, but in the case of corruption in the Medan District Court it is true that the prosecutor split the case but in the trial the case was merged in accordance with the provisions of Article 141 of the Criminal Procedure Code, this was done so as not to conflict with the legal principle of contante justitie (fast, simple and low cost justice). Splitting will only complicate and slow down the trial process and even cause convoluted trials so that the principle of contante justitie is not fulfilled. In addition to the impact of splitsing, there are also challenges in its implementation, namely the possibility of defendants in other cases helping each other in their testimony so as not to incriminate the final decision of the crime and the violation of the defendant's human rights, namely the principle of non-self-incrimination.
