Abstract

Indonesia merupakan negara yang kaya akan keanekaragaman sumber daya alam hayati, dimana sumber daya alam hayati tersebut meliputi sumber daya alam tumbuhan (tumbuhan) dan hewan (satwa) serta unsur-unsur faktor abiotik lainnya yang terdapat pada lingkungan hidup secara umum yang membentuk suatu ekosistem. Tujuan dilakukannya penelitian ini adalah untuk mengetahui Bagaimana Pengaturan Sanksi Pidana Terhadap Pelaku Perdagangan Satwa Yang Dilindungi dan Bagaimana Pertanggungjawaban Terhadap Pelaku Perdagangansatwa Yang Dilindungi. Penelitian ini menggunakan metode penelitian kualitatif-normatif (normative legal research). Sumber data yang digunakan dalam penelitian normatif adalah sumber hukum sekunder melalui studi pustaka (literatur research). Berdasarkan hasil penelitian dapat diketahui bahwa: kasus perdagangan satwa yang dilindungi, bentuk pertanggung-jawaban yang digunakan yaitu pertanggungjawaban pidana. Pertanggungjawaban pidana merupakan suatu pertanggungjawaban orang terhadap tindak pidana yang dilakukannya. Pertanggungjawaban pidana pada hakekatnya merupakan mekanisme yang dibentuk oleh hukum pidana agar bereaksi terhadap pelanggaran atas kesepakatan menolak perbuatan tertentu. Bentuk pertanggungjawaban terhadap pelaku perdagangan satwa yang dilindungi adalah pertanggungjawaban pidana. Dalam hal ini pelaku tersebut dikenakan sanksi pidana yang terdapat di Pasal 21 ayat (1) dan ayat (2) serta Pasal 33 ayat (3) dipidana dengan pidana penjara paling lama satu tahun enam bulan dan denda paling banyak sepuluh juta rupiah.

Abstract

Splitting a case file is defined as the act of creating a new case file with more than one defendant. The purpose of the research is to find out the rationale for splitting cases, the legal basis, the impact and challenges in the implementation of splitting cases. The method used in this research is descriptive normative legal research with data collection techniques through observation at the Medan District Court and collection of written references. Splitsing is regulated in the provisions of Article 142 of the Criminal Procedure Code, but in the case of corruption in the Medan District Court it is true that the prosecutor split the case but in the trial the case was merged in accordance with the provisions of Article 141 of the Criminal Procedure Code, this was done so as not to conflict with the legal principle of contante justitie (fast, simple and low cost justice). Splitting will only complicate and slow down the trial process and even cause convoluted trials so that the principle of contante justitie is not fulfilled. In addition to the impact of splitsing, there are also challenges in its implementation, namely the possibility of defendants in other cases helping each other in their testimony so as not to incriminate the final decision of the crime and the violation of the defendant's human rights, namely the principle of non-self-incrimination.

Abstract

This study investigates the emerging phenomenon of "digital self-slavery" (perbudakan diri digital) within Indonesia's Society 5.0 landscape, focusing on the TikTok live-streaming ecosystem as a site of voluntary self-exploitation mediated by algorithmic systems. Employing a mixed-method approach combining an online survey of 304 respondents with qualitative essay analysis and social media observation this research identifies a critical gap in existing digital slavery literature, which predominantly addresses externally coerced exploitation while neglecting voluntary self-exploitation through digital platforms. Drawing on the Modern Slavery Wheel theory, the digital labor exploitation framework, and the Islamic jurisprudential concept of maqashid al-syariah, this article introduces "self-slavery" as a distinct analytical category separating it from conventional modern slavery. Empirical findings reveal that 85.5% of respondents—predominantly Generation Z—classified online gift-begging behavior as technology-disguised slavery, directly refuting the prevailing social stigma of generational digital apathy. Additionally, 33.2% reported experiencing algorithmic pressure to follow social media trends, and 73.3% expressed support for cyber law reform. From the Islamic legal perspective, this practice constitutes violations of hifzh al-'irdh (preservation of honor) and hifzh al-nafs (preservation of the self), rendering it inconsistent with the objectives of Islamic law. The study concludes that Indonesia's current cyber law framework—including the ITE Law and Presidential Regulation No. 47 of 2023—is structurally insufficient to address nuanced forms of digital self-exploitation, and proposes a reform agenda grounded in both positive law and Islamic normative principles.
