Abstract

Penelitian ini mengkaji tentang konstitusi hukum Islam sebelum kemerdekaan dan sesudah kemerdekaan sejak kemerdekaan 1945 sampai sekarang. Penelitian ini menggunakan deskriptif kualitatif. Hasil penelitian ini menunjukkan bahwa konstitusi hukum Islam dalam negara Indonesia telah mengalami perubahan dan perkembangan yang sangat signifikan, walaupun pada masa pertengahan kemerdekaan perkembangan konstitusi hukum Islam telah menerobos serta mempengaruhi untuk masuk kedalam konstitusi-konstitusi negara Indonesia secara berkala dan berkelanjutan, namun setelah pertengahan kemerdekaan, terjadi perubahan 4 kali amandeme UUD 1945, hal ini yang membuka ruang perkembangan hukum Islam dalam konstitusi-konstitusi negara Indonesia mengalami kemajuan yang signifikan sehingga beberapa produk undang-undang dapat menjadi pertimbangan untuk masuk dalam materi perundang-undangan yang dapat pula berpengaruh sistem hukum ketatanegaraan di Indonesia.

Abstract

Slavery is not a product of Islam as it existed long before the Prophet Muhammad came. Even in the Qur'an, there are strong indications that enjoying sex with an unmarried slave girl is the same as enjoying it with a legal wife, so it is not even called zina in the Qur'an. It is evident that during the pre-Islamic era, sexuality between a master and his slave girl was commonplace. This research is a literature that is sourced in the form of books, journals and previous research that has the same theme of discussion as this issue. The result of this writing is that in Islam, the master or employer having sex with a slave girl is allowed and is not called adultery because it is stated in the Al-Qur'an surah Al-Mu'minun verses 5-7. The slavery that currently occurs in Saudi Arabia with various forms of slavery, one of which is the forced sexual intercourse of the master against his slave girl, is an act that is strictly prohibited and hated in Islam because it lowers the dignity and dignity of women.

Abstract

This research aims to understand and analyze the reason why students decide to marry during their studies and to understand and analyze the impact of student marriage on the continuation of their studies and family harmony. This research is a qualitative study with a descriptive method, where data is obtained from primary and secondary source. The data collection techniques used are interviews and documentation. The result of this research indicate that reasons students decide to marry during their studies include feeling reay for marriage, adhering to islamic law to avoid the slander of adultery and due to “married by accident”. The impacts of students marriages during their studies include positive impacts on the continuation of their studies, such as support and motivation from their partner, increased enthusiasm for learning, personal growth, and avoiding immoral actions. The negative impacts on their studies include poor time management, inability to complete academic task optimally, and not being able to graduate on time.

Abstract

Crispy fried chicken is a popular fast food item in Indonesia, and it can be made even more appealing by combining spicy flavours with cheese. This modern twist on a classic dish makes it enjoyable for all ages, especially young people. Many housewives in Bobaneigo Madihutu Village who are currently unemployed or underemployed lack a stable income. To address this, we are offering training in crispy chicken preparation to improve the economic opportunities for these women. The training session was held at Campus IV of Khairun University in Bobaneigo Village, Madihutu District, West Halmahera, North Maluku. It was attended by 20 local housewives and Agricultural Faculty students involved in community service activities. Pre- and post-training tests indicated a significant increase in the participants' knowledge about making crispy fried chicken. The feedback from the attendees was highly positive, highlighting the usefulness of the training and the new insights gained into chicken preparation. Overall, the training was well-received and met its objectives effectively

Abstract

The expansion of e-commerce in Indonesia has significantly transformed digital transactions, offering unparalleled convenience while simultaneously giving rise to pressing legal concerns regarding the distribution of unauthorized goods. Items such as unregulated pharmaceuticals, harmful beauty products, and counterfeit merchandise are increasingly prevalent on online marketplaces, endangering consumer safety. This research adopts a normative juridical framework, incorporating legislative, theoretical, and case-study approaches to examine the extent of liability e-commerce platforms bear in facilitating the trade of illegal products. Under Indonesia’s Consumer Protection Law, Trade Law, and the Electronic Information and Transactions (ITE) Law, these platforms are expected to regulate and oversee transactions, yet in practice, accountability predominantly falls on individual vendors. The principles of strict liability and vicarious liability provide a legal basis for evaluating platform responsibility in such cases. Findings suggest that enforcement mechanisms remain insufficient, allowing gaps in regulatory oversight. To address this, robust policies must be introduced, including stringent verification protocols for sellers and products, alongside stronger governmental supervision of digital commerce. Strengthening these regulatory frameworks will not only enhance consumer rights but also curtail the proliferation of illegal goods across e-commerce platforms, ensuring a safer and more accountable online marketplace.

Abstract

The revision of the Indonesian Civil Code, inherited from Dutch colonial law, has become an urgent necessity in responding to the dynamic development of society, economy, and technology. This normative legal research aims to analyze the fundamental challenges faced in the process of revising the Civil Code, as well as the strategic opportunities that can be utilized to modernize the legal system. Through a normative-juridical approach supported by literature studies, legal documents, and comparative law analysis, this study identifies key weaknesses in the current Civil Code, such as outdated norms, lack of digital regulation, and inadequate protection for contemporary civil relations. The research also reveals the potential benefits of integrating digital law, simplifying legal procedures, recognizing local customary laws, and embedding the principle of justice to enhance legal relevance and responsiveness. The findings of this study offer theoretical and practical recommendations for stakeholders involved in legal reform efforts, emphasizing that modernizing civil law must be grounded in Indonesia's socio-cultural context while embracing global legal developments.

Abstract

This study investigates the contested status of waqf land designated for the Santiong Village Public Cemetery (TPU), which has been occupied by community members for housing, creating a conflict over its intended use. The research aims to analyze the legal status of this waqf land from an Islamic law perspective and to assess the resident community's understanding and perception of its function and empowerment principles. Using a quantitative method, data was collected via questionnaires distributed to a sample of 50 residents living on the waqf land. The research reveals two primary issues. First, the legal status of the waqf land is precarious; it lacks an official certificate from the Land Agency and relies solely on a Notary Deed held by the An-Nur Foundation, the acting nazhir (manager). Second, community understanding of waqf principles is low, with a majority of residents (66%) not providing empowerment benefits to the nazhir5. Despite these legal and social challenges, the study concludes that the waqf land possesses significant potential for future development. This potential is based on indicators such as the positive character of some respondents toward waqf and the prospective economic empowerment of the community.

Abstract

The development of social media as part of digital transformation has opened up new opportunities in community education efforts, especially through the Student Creativity Program (PKM). This study aims to examine the strategy of utilizing social media as an educational tool in digital-based PKM activities. Social media such as TikTok, Instagram, and Facebook are used strategically to reach various segments of society, taking into account generational characteristics, information needs, and socio-cultural contexts. A descriptive qualitative approach was used in this study, with data collection techniques through in-depth interviews with implementing students, supervising lecturers, and beneficiary communities. Data analysis was carried out thematically with source triangulation to maintain validity. The results of the study indicate that the integration of social media in PKM not only increases access to educational information but also strengthens community participation in the learning process. The success of the program is highly dependent on the design of content that is visually attractive, substantively contextual, and participatory in its implementation. However, challenges related to digital literacy, information credibility, and community involvement still need to be addressed through sustainable strategies. Thus, social media has the potential to be an effective educational platform if utilized critically, creatively, and collaboratively within the framework of digital-based community service.

Abstract

Power struggles and social dynamics are important topics in the study of social science and politics because they illustrate how power influences the structure and functioning of society. In the era of globalization, information technology and mass migration, these dynamics are increasingly complex and have an impact on social and political changes throughout the world. In response to this phenomenon, there is a need to understand how power is seized, exercised and maintained amidst rapid social change. The aim of this research is to analyze the role of technology, globalization, and societal responses in influencing power structures and social dynamics. This research uses a descriptive qualitative approach with data originating from relevant previous studies. Data is collected and processed to identify patterns that show the interaction between power and social change. The conclusions of this research show that technology has significantly changed the way power is gained and exercised, giving minority groups more voice but also creating new challenges in the control of information. Globalization has influenced domestic policies and widened economic disparities, while international organizations play an increasingly important role in global politics. Society shows a variety of responses to changes in power, from adaptation to resistance, with the media and social movements playing a key role in this process. Understanding these dynamics is important for navigating social and political change in an ever-changing global context.
