Abstract

A leader is someone who has been chosen by a group who is given the mandate to lead the organization to achieve a goal, and is considered to have an influence on others and has an inherent leadership spirit. In Islam, the criteria for ideal leaders are in the Prophet Muhammad, but as ordinary humans, of course, we cannot equalize the criteria for leaders in the Prophet Muhammad, therefore in Islam there are criteria for imams according to Al-Mawardi which are based on the Qur'an and Hadith. In Indonesia, there are criteria for leaders according to the 1945 Constitution and Law No. 7/2017 on general elections. The two criteria certainly have different views, but if the two are compared whether it will be relevant or contradictory. This study will answer the relevance of the criteria of state leaders in Indonesia with the criteria of the Imam according to Al-Mawardi. This study will answer the relevance of the criteria for state leaders in Indonesia with the criteria for imam according to Al-Mawardi. This type of research belongs to the Qualitative category using descriptive analysis methods with data collection techniques, namely library research or literature studies. The 5 criteria for state leaders according to the 1945 Constitution and Law No. 7 of 2017 are relevant to the criteria for imam according to Al-Mawardi, namely according to the 1945 Constitution and Law No. 7 on elections (never betrayed the country and never committed corruption and other serious crimes, educated at least graduated from high school / vocational or other schools equivalent, spiritually able to carry out the duties of his obligations as President and Vice President and free from narcotics abuse, has a vision, mission, and program in implementing the government of the Republic of Indonesia, and the President is a native Indonesian) and according to Al-Mawardi (fair, healthy, knowledgeable, healthy limbs, have a vision and mission, and descendants of the Quraysh). So it can be concluded that the criteria for state leaders according to the 1945 Constitution and Law No. 7/2017 on elections when compared with the criteria for priests according to Al-Mawardi will be very relevant.

Abstract

Elections are a democratic party because every individual has the right to determine his choice of candidates who he thinks are worthy of being President and Vice President. The debate on presidential and vice presidential candidates is one of the stages in the election, the debate is also a basis for first-time voters to determine their preferences. Siyasah dusturiyah also discusses the criteria for leaders. This research will answer the political participation of novice voters and their preferences in watching debate broadcasts by presidential and vice presidential candidates, which are then reviewed from a siyasah dusturiyah perspective. This type of research is included in the qualitative category using a descriptive analysis method whose data collection technique is through a multistage random sampling method, namely taking samples in stages and then each stage is carried out using a simple random sampling method. The political participation of novice voters in watching presidential and vice presidential debate broadcasts is quite good but not yet optimal due to inadequate socialization and minimal political education. then the preferences of novice voters for their chosen leaders include a clear vision and mission, courage and firmness, being able to act fairly, and broad insight. Of the seven criteria for potential leaders according to Al-Mawardi, six of them are still strong foundations that are very relevant to the preferences of young voters today in order to create state leaders who can bring prosperity to their people.

Abstract

Due to their significant influence, new voters have a dynamic political orientation and are crucial targets in elections. In the 2024 General Election, Generation Z and millennials will dominate the voter demographic, comprising 56.45% of 204 million voters, thus holding substantial potential in determining election outcomes. This study examines new voters' political awareness and participation in the Cibeunying Kidul Sub-district, focusing on the influence of political understanding, environmental support, family socialization, and political education. This research employs a juridical-empirical approach using interviews and participatory observation to gather data from new voters aged 17-21. Findings indicate that new voters' political awareness is heavily influenced by family habits and guidance, highlighting the need for more intensive political education. Some new voters exhibit apathy due to distrust in the political system. Therefore, the role of the KPU (General Election Commission) in socializing elections to new voters is crucial to enhance their participation. From the siyasah dusturiyah perspective, political participation is part of obedience to the leader and a mandate that must be fulfilled. Elections in Islam resemble deliberations to select a leader who will be sworn in. New voters' participation in elections aligns with the amar ma'ruf nahi munkar principle. Enhanced political awareness among new voters will increase their participation in elections, thereby strengthening the quality of democracy in Indonesia.

Abstract

This study aims to analyze the data management processes in State Islamic Higher Education Institutions (PTKIN) to enhance their academic quality and accreditation achievements. Using a qualitative approach with case studies at several PTKINs, the research focuses on identifying challenges and proposing solutions for optimizing database management. Data collection methods include documentation, observations, and in-depth interviews with key stakeholders. The findings reveal that database management is critical for supporting accreditation and institutional development. Challenges such as insufficient human resources, system inefficiencies, and weak coordination among administrative units hinder optimal data management. However, solutions include strengthening technological infrastructure, enhancing human resource capabilities through training, and implementing integrated management information systems. Moreover, innovative technologies like artificial intelligence, big data analytics, and blockchain are recommended to improve data accuracy, security, and usability. The research concludes that effective data management significantly impacts PTKIN accreditation and reputation. Institutions need to prioritize the development of systems, policies, and resources to achieve their vision as leading educational institutions contributing to society.

Abstract

Purpose - This research analyzes the Nagari system of governance in West Sumatra as an independent customary law system rooted in family and blood relations. In addition, it examines the respect for this system in its day, including by the Dutch colonial government, and its impact on modern regulation. Contemporary Islamic law is also examined in supporting or criticizing this system, particularly concerning justice, deliberation, and leadership. Methods - This research uses a qualitative method with an empirical juridical approach and descriptive analysis. Data were collected through direct observation and recording of social and legal phenomena in Nagari communities. Findings - The results showed that West Sumatra is a village-based customary law society with a unique organizational structure now regulated in Law No. 6 of 2014. The democratic system of the Minangkabau Nagari Community has the disadvantage of being hereditary, which can inhibit more inclusive leadership dynamics. Its political structure tends to be paternalistic, influencing patterns of governance and decision-making. Contribution/Limitation - This research helps to understand the dynamics of the Nagari government system in the context of customary law and the challenges of modernization. In addition, it examines the relevance of this system to contemporary Islamic legal principles, particularly in social justice, leadership transparency, and community participation. However, this research is limited to analysis in West Sumatra and does not include comparisons with other regions. Originality/Value - This research provides insight into the sustainability of the Nagari government system in the face of modern regulations and social dynamics, as well as its relevance in contemporary Islamic law.

Abstract

Penelitian ini bertujuan untuk menganalisis politik hukum Pemerintah Daerah Kota Bekasi dalam mengentaskan kemiskinan selama periode 2020–2023 berdasarkan Peraturan Daerah Kota Bekasi Nomor 4 Tahun 2018 tentang Penanggulangan Kemiskinan. Kajian ini menggunakan pendekatan yuridis-empiris dengan metode deskriptif-analitis. Data penelitian menunjukkan bahwa meskipun terdapat penurunan jumlah penduduk miskin dari 2020 hingga 2023, tingkat kedalaman dan keparahan kemiskinan justru meningkat. Faktor penyebab meliputi alokasi anggaran yang kurang memadai, distribusi bantuan sosial yang tidak tepat sasaran, dan kurangnya koordinasi antarinstansi. Peraturan Daerah Nomor 4 Tahun 2018 dinilai efektif dalam beberapa aspek, seperti pemberdayaan ekonomi melalui UMKM dan pelatihan keterampilan. Namun, implementasi kebijakan masih menghadapi kendala. Studi ini merekomendasikan pendekatan yang lebih terpadu untuk meningkatkan efektivitas program pengentasan kemiskinan di Kota Bekasi.

Abstract

This study aims to critically examine the effectiveness of law enforcement efforts against illegal goods smuggling conducted by the Directorate General of Customs and Excise in Bandung City, based on Regulation No. P-53/BC/2010, through the normative lens of Siyasah Dusturiyah in Islamic political theory. Employing a qualitative juridical-empirical method, this research integrates doctrinal legal analysis with field data obtained through interviews, document studies, and observations. The findings reveal persistent structural and operational challenges, including limited technological surveillance, insufficient human resources, weak inter-agency coordination, and low public legal awareness. These issues have contributed to the continued rise in smuggling activities, indicating gaps in the current enforcement framework. From the perspective of Siyasah Dusturiyah, smuggling is not merely a violation of state law but a transgression against public welfare (maslahah ‘ammah), undermining economic justice and societal harmony. The study concludes that an integrated enforcement strategy—combining preventive, repressive, and rehabilitative approaches—is essential to address the root causes of smuggling. Furthermore, the research contributes theoretically by reinforcing Siyasah Dusturiyah as a moral and legal framework for customs governance, and practically by advocating for a participatory and ethically grounded legal culture. This holistic model is vital for developing an accountable, just, and spiritually conscious enforcement system in the face of transnational economic threats. Contribution: By situating smuggling as not only a legal violation but also a breach of public welfare and economic justice from an Islamic political perspective, the research advances the discourse on integrating moral and spiritual values into state governance.

Abstract

Constitutional Court Decision Number 60/PUU-XXII/2024 provides a new interpretation of the provisions on the threshold for nominating regional heads in Article 40 paragraph (3) of Law Number 10 of 2016, which previously limited non-parliamentary political parties from nominating regional head candidates even though they obtained valid votes. This study aims to analyze the normative correction from a legal perspective. This study uses a juridical-normative and qualitative-contextual approach with a library research method through an analysis of the Constitutional Court's decision, the principles of legal principles, and constitutional law literature. The results of the study show that the Constitutional Court's decision eliminates forms of electoral discrimination by restoring the rights of political parties that obtain 25% of valid votes to continue to nominate regional head candidate pairs, even without DPRD seats. In a legal perspective, this constitutional interpretation is in line with the principles of justice (al-adl), political equality (al-musawah), and public welfare (al-maslahah al-'ammah). This decision is considered as a form of ijtihad siyasiy by state institutions to free political access from the domination of local oligarchy. Thus, the constitution and Islamic principles can synergize in encouraging substantive democracy at the local level.

Abstract

This study aims to analyze the management of databases at State Islamic Higher Education Institutions (PTKIN) in supporting the accreditation of study programs. The research adopts a descriptive qualitative approach, employing data collection methods such as interviews, observations, and documentation. Data were obtained from several PTKIN institutions in the Java region, including UIN Syarif Hidayatullah Jakarta, UIN Sultan Maulana Hasanuddin, and IAIN Pekalongan. The findings reveal that database management plays a crucial role in enhancing the accreditation scores of study programs by providing valid and relevant data. Strategic policies, such as strengthening human resources, implementing independent academic information systems, and conducting accreditation simulations by Quality Assurance Institutions, have proven effective in preparing study programs for assessment by the National Accreditation Board for Higher Education (BAN-PT). The study also highlights challenges, such as limited human resources and inconsistencies in reporting data, which can be addressed through technological innovations and continuous training. This research underscores the importance of integrated database management in supporting the quality of higher education at PTKIN.
