Abstract

Artikel ini membahas tentang munculnya gerakan inklusivisme dalam gerakan sosial keagamaan. Dengan metode kualitatif artikel ini menemukan bahwa organisasi keagamaan Persatuan Islam yang notabene sebuah organisasi eksklusif di Indonesia telah berubah menjadi inklusif manakala berhadapan dengan pihak-pihak lain, terutama dalam kehidupan ketetanggaan, berbangsa dan bernegara. Hal ini dilihat sebagai skema survival dari organisasi tersebut, sehingga selalu eksis dan tetap dapat menyesuaikan dengan tantangan zaman.

Abstract

Abstract: A man is allowed to marry more than one woman with one important require­ment, have an ability to act fairly. The sources of Islamic law, the Al-Quran and As-Sunnah, do not explain in detail the procedures or techniques of fairness for polygamous husbands. However, in the Law No 1 of 1974 concerning Marriage there are articles governing poligamy, as in Article 4 and Article 5. Those provisions show that in the  context of Islam Nusantara fiqh, polygamy is open to all men who want to marry more than one woman, but at once closed to a man who unable to the legislation require­ments. Through literature studies with jurudic-normative approach, this study found that Indonesia has its own approach to ensure that a polygamous husband can act fairly toward his wives. The article 4 and 5 of Law No. 1 of 1974 on Marriage proofing the intention. Therefore, the position of legislation as a result of Islamic Law transformation into national law becomes a concrete form of Islam Nusantara’s fiqh that has been applied in Muslim community life.Abstrak: Seorang suami boleh beristri lebih dari seorang dengan syarat memiliki kemampuan melaksanakan keadilan. Sumber hukum Islam, yakni Al-Quran dan As-Sunnah tidak menjelaskan secara rinci tata cara atau teknis melaksanakan keadilan untuk suami yang poligami. Akan tetapi di dalam Undang-undang Nomor 1 Tahun 1974 tentang Perkawinan terdapat pasal-pasal yang mengatur prinsip keadilan secara yuridis dan teknis, sebagaimana pada Pasal 4 dan Pasal 5. Dengan ketentuan peraturan per­undang-undangan tersebut dapat dipahami bahwa dalam konteks fiqh Islam Nusantara poligami terbuka untuk seluruh pria yang hendak menikahi lebih dari seorang isteri, akan tetapi sekaligus tertutup bagi pria yang bermaksud melakukan poligami apabila tidak terpenuhi persyaratan yang ditetapkan oleh peraturan perundangan-undangan yang ber­laku. Melalui studi literatur dengan pendekatan yurudis-normatif, penelitian ini mene­­­mu­­kan bahwa Indonesia memiliki pendekatan sendiri untuk memastikan bahwa suami yang poligami dapat bertindak adil terhadap istrinya. Pasal 4 dan 5 UU No. 1 tahun 1974 tentang Perkawinan membuktikan niat tersebut.  Oleh karena itu, posisi legislasi sebagai hasil transformasi Hukum Islam menjadi hukum nasional menjadi bentuk konk­ret fiqh Islam Nusantara yang telah diterapkan dalam kehidupan masyarakat Muslim.

Abstract

Nowadays there is a phenomenon, where there is news or chain reports circulating in the media whose truth is invalid. This invalidity can be in the form of content that is not in accordance with the original, whether in the form of what, where, when, and who was involved in the reporting. Not only that, sometimes the title seems to have bias in it. This is from the side of the news source. It doesn't stop there, in terms of people's behavior it also shows its own uniqueness, namely that they easily pass on the news without first checking and checking the truth of the news. Finally, the invalid news, which we call a hoax, spread very quickly via FB, Twitter, IG, WAG, etc. How Islamic caution first used to verify and convey news. Apart from that, we will also invite readers to see the method of practicing good and evil, preaching in accordance with the recommendations of religious scholars based on the Koran and Alhadist. The results obtained are that passing on religious content advice on social media is not as easy and simple as the intention to preach and preach good and evil, because in it there are religious boundaries that must be taken into account, including whether the religious content is valid or not, and the party giving advice has done so or not. Keywords: Hoax, Islam, social media Abstrak Dewasa ini ada fenomena, di mana ada berita atau kabar berantai yang beredar di media yang kebenarannya tidak sahih. Tidak sahih tersebut bisa dalam bentuk isi yang tidak sesuai dengan aslinya, baik berupa apa, di mana, kapan, dan siapa yang terlibat dalam pemberitaan tersebut. Tidak hanya itu, terkadang judul yang dibuat terkesan ada bias di dalamnya. Ini dari sisi sumber berita. Tidak berhenti di situ, dari sisi perilaku masyarakat juga memperlihatkan keunikan tersendiri, yaitu dengan mudahnya meneruskan berita tersebut tanpa terlebih dahulu memberikan cek dan ricek akan kebenaran berita tersebut. Akhirnya, berita yang tidak sahih tersebut yang kita sebut sebagai hoax tersebar begitu cepatnya menyebar via FB, twitter, IG, WAG, dan lain-lain. Bagaimana kehati-hatian Islam pertama dulu memverifikasi dan menyampaikan berita. Selain itu kami juga akan mengajak pembaca untuk melihat bagaimana metode dalam beramar ma’ruf nahi munkar, berdakwah yang sesuai dengan anjuran dari para alim ulama berdasarkan Alquran dan Alhadist. Diperoleh hasil bahwa meneruskan nasihat-nasihat konten agama dalam media sosial tidak semudah dan sesederhana dengan alasan niat untuk berdakwah dan beramar ma’ruf nahi munkar, karena di dalamnya ada batas-batas agama yang harus diperhatikan, diantaranya adalah konten agama tersebut sahih atau tidak, dan pihak yang memberi nasihat sudah melakukan atau belum. Abstract

The practice of polygamy is still a polemic to this day, with pros and cons both from human rights activists and from polygamy practitioners themselves. This research aims to examine the phenomenon of polygyny in Karawang Regency from the perspective of Islamic law and laws for justice; the social conditions that occur in Karawang further impact family welfare, such as household harmony, economic conditions, early marriage, and even polygamy. Polygamy has increased in Karawang in the form of polygyny. A lack of understanding about fairness in polygynous marriages in Karawang society supports the problems that arise from the occurrence of polygyny. The approach used in this research is an empirical juridical approach, or field research, examining applicable legal provisions and what happens in society. The results of the research show that the understanding of husbands and wives who practice polygyny in Karawang regarding Law No. 1 of 1974 regarding marriage varies, and some need help understanding the law, especially those relating to polygynous marriages. Some need help understanding law no. 1 of 1974, limited public understanding of Law no. 1 1974 concerning marriage is due to a lack of public interest. Also, because socialization regarding this law is uneven, especially regarding polygynous marriages, the public is more interested in using Islamic law.

Abstract

One of the Islamic boarding schools that is known to be quite fundamental in implementing an understanding of Islamic teachings is the Islamic Association Islamic Boarding School. The main sources of Islamic teachings which are the benchmark for truth in all actions, especially those related to faith and sharia are the Koran and al-Hadith. However, if there is minimal development of interpretive methodology for these two sources, it will result in exclusive religious behavior and truth claims for one's own opinions. So, it is not uncommon for this understanding to give rise to cultural conflicts in society where some parties have long practiced traditional Islamic religion and give rise to radical thought patterns and actions. The fundamental and radical thinking pattern which is interpreted politically is not without reason, but refers to various terrorist incidents which when the perpetrators were interviewed and books which were used as references for acts of terrorism indicated radical, takfiri and truth claim thinking patterns which were then aimed at educational products. Deradicalism means eliminating radical actions or radicalism, eliminating all ideologies and currents that give rise to acts of violence and terror. This gives rise to religious radicalism which, at a certain level, gives rise to acts of terror as an implementation of the concept of jihad which causes victims in an inhumane way. The research method uses descriptive analysis with qualitative data types and a sociological approach. The type of data is adjusted to the research objectives, while the primary data source is the caregivers and students of Islamic Association Islamic boarding schools in West Java, East Java and Central Java. Secondary data is in the form of students' allegiance documents, books about the Islamic Association, and profiles of the Islamic Association Islamic boarding school, the tertiary data is all scientific works that support this research. Data was collected by observation, interviews, documentation and literature study. The data collected was analyzed using the content analysis method.

Abstract

The purpose of this study is to find out the legal regulations regarding legal certainty in the decision of the honorary board of election organizers based on the decision of the Constitutional Court Decision Number 32/PUU-XIX/2021). The method used in this study is the Normative Juridical approach. Juridical-normative research was chosen because it affirms the existence of ethical norms and legal norms as part of the norm system that applies in society. The results of the study concluded that the Urgency of DKPP is a vital and significant institution to deal with violations of the Election Organizer's code of ethics and is a unified function of the Election Organizer; The nature of the legal certainty of the decision of the Election Organizing Honor Board (DKPP) after the Constitutional Court decision Number 32/PUU-XIX/2021 is not recognized and confirms that the DKPP is not a judicial institution, so the DKPP decision is a decision of a State Administration official who can be the object of a lawsuit at the State Administrative Court; and it is necessary to establish an ethical court through law, not only limited to DKPP. where enforcement is carried out through an independent, impartial, and open judicial process, namely the Court of Law for legal matters, and the Court of Ethics for ethical issues.

Abstract

This research discusses the review of siyasah dauliyah on the role of the Republic of Indonesia in responding and providing policies on the war between Israel and Palestine, one of which is when the war heats up again in 2023. The occurrence of the war has caused enormous destruction in the Palestinian territories ranging from the economic, social, educational sectors, even public facilities, and infrastructures. The research method used the content analysis method with the technique of interpreting textual material and evaluating texts systematically from primary and secondary document data sources. The results showed that Indonesia and Palestine have established diplomatic relations for a long time, starting with educational relations conducted by Indonesian students while studying in the middle east, until Indonesia became one of the countries that recognised the independence of Palestine on 15 November 1988 in Algeria. The relationship continues until now as seen from Indonesia's policies that are always on the Palestine side in the midst of the Palestine-Israel conflict. Many policies and assistance provided by Indonesia for Palestine in the fight for Palestine rights and independence ranging from political, socio-cultural, humanitarian assistance, as well as education. In fact, Indonesia also voiced peace efforts for Palestine in various forums, one of which was in the UN forum.

Abstract

This study discusses the review of siyasah dusturiyah on the implementation of the principle of balance of rights and obligations, as well as the professionalism of public services based on Article 4 of Cianjur Regency Regional Regulation Number 6 of 2013 concerning Public Services. The purpose of this study is to determine the implementation of the principle of balance of rights and obligations, as well as the principle of professionalism of public services in Integrated Administrative Services in Naringgul District, to determine government policies in overcoming obstacles to Integrated Administrative Services in Naringgul District, and to determine the review of Siyasah Dusturiyah on the implementation of the principle of balance of rights and obligations, as well as the principle of professionalism of public services in Integrated Administrative Services in Naringgul District based on Article 4 of Cianjur Regency Regional Regulation Number 6 of 2013 concerning Public Services. The method used is qualitative research method with descriptive type. As for the results of this study, the implementation of Integrated Administrative Services in Naringgul District is in accordance with the concept of siyasah dusturiyah, which is to regulate the interests of the people for the achievement of benefits.
