Abstract

Bali is a tourist destination that is favored by many domestic and foreign tourists. However, the high consumption activity of local people and tourists in the province produces quite a lot of waste generation. Based on data from the Ministry of Environment and Forestry (KLHK), the city of Denpasar produces 915.5 thousand tons of waste generation throughout 2021. This makes Bali the 8th largest waste-producing province in Indonesia. legal research that uses empirical facts taken from human behavior, both verbal behavior obtained from interviews and real behavior carried out through direct observation. Conclusion of the Effectiveness of Bali Province Regional Regulation Number 1 of 2017 Concerning Environmental Protection and Management in Preventing Groundwater Pollution in the Legal Area of ​​the Denpasar City Environment Service has not been effectively implemented, because based on data on public complaints and data on prosecution of violations there is still an increase from year to year, starting from 2019 to 2022, so it is proven that the enforcement that has been carried out so far has not provided a deterrent effect, because the authorized apparatus related to this Regional Regulation, especially the Civil Service Police Unit, has not been maximal in carrying out enforcement of Constraints and Efforts from the Denpasar City Environment Service in Preventing Groundwater Pollution in the City of Denpasar, namely the obstacle is the participation and supporting capacity of the community in protecting the environment, especially in the application of this Regional Regulation which has not been maximized, and because of the lack of facilities and infrastructure owned in carrying out investigations to detect sources of pollution

Abstract

Microenterprises are businesses run by people categorized as poor or near poor. They are family-owned, using local resources and simple technology. Micro-enterprises include unbanked people, a group that is difficult to get access to banking even though this group has the potential to develop business. Canang Sari is the simplest form of offerings in the form of janur made rectangular decorated with various types of flowers that are offered as an effort to get closer to God in prayer. Based on observations, there is a group of canang traders called the Canang Sari Wangi group located in Banjar Laplap Putih, Penatih Dangin Puri Village, East Denpasar who really need help to overcome the problems they face. This Canang Sari Wangi trader group has 5 members who have been established since 2020. The problems faced by this group of Canang Sari Wangi traders are difficult to get access to banking, lack of knowledge for business development due to fluctuations in demand, very fierce competition, high operational costs, lack of understanding of creative marketing and the absence of careful and thorough administration of financial reports. The approach taken is to further coordinate with members of the Canang Sari Wangi Group so as to obtain the main needs for increasing productivity, namely by providing assistance to facilitate access to banking, entrepreneurship assistance, improve creative marketing skills and make business bookkeeping. The output target to be achieved is an increase in the ability of partners to access banking, through creative marketing partners are able to increase group income by 30% and all members of the Canang Sari Wangi group are able to make simple group bookkeeping. The method of implementing this activity is preceded by collecting information from partner conditions, designing activities to be carried out, followed by program socialization, conducting training, mentoring and evaluation.

Abstract

Penelitian ini bertujuan untuk menganalisis efektivitas pelaksanaan pengawasan terhadap pengungsi mandiri oleh Rumah Detensi Imigrasi Denpasar. Dengan bertambahnya jumlah pencari suaka dan pengungsi mandiri setiap tahun, pengawasan terhadap mereka menjadi semakin sulit karena sifat nomaden dari pengungsi dan kurangnya transparansi dari organisasi internasional seperti UNHCR dan IOM. Berdasarkan data dari tahun 2021 hingga 2023, ditemukan bahwa pelaksanaan pengawasan belum efektif, dengan kurang dari 50% pengungsi yang dapat diawasi. Hal ini terjadi karena keterbatasan sumber daya manusia serta data yang tidak valid, di mana banyak pengungsi sering berpindah tempat tanpa melapor, sehingga menyulitkan proses pengawasan. Selain itu, ketidakefektifan koordinasi antara instansi terkait, terutama dengan pihak internasional, memperparah situasi. Hasil penelitian menunjukkan bahwa faktor penghambat utama dalam pengawasan adalah kurangnya fasilitas penampungan bagi pengungsi mandiri di wilayah Bali, sehingga banyak pengungsi yang hidup berpindah-pindah dan sulit dijangkau oleh petugas. Pengawasan administratif yang dilakukan bersifat terbatas dan hanya dapat mencakup pengawasan terhadap dokumen, namun belum menyentuh aspek sosial dan ekonomi pengungsi. Untuk meningkatkan efektivitas pengawasan, diperlukan pembaruan kebijakan serta peningkatan koordinasi antara Rumah Detensi Imigrasi dengan lembaga internasional dan pemerintah daerah.

Abstract

Each state government institution has the same interest in continuing to echo their respective visions and duties in order to achieve public trust. However, in an era like this, it is necessary to pay attention to legal products, is it based on Pancasila values? The problems raised from this article are: Integrity, Clean, and Trustworthy in redefining human values as the formation and enforcement of law in the era of disruption. This research includes doctrinal research using primary legal data/materials, secondary legal data/materials and tertiary legal data/materials. The technique of collecting data/legal materials is carried out with a card system and uses a legislative approach, a factual approach, and a conceptual analysis approach.mThe results of this study are: the principles of Integrity, Clean, and Trustworthy with the formation and enforcement of laws in the era of disruption are certainly very influential, because to ensure that the law always comes with good moral content for the community, it is necessary to have the availability of a collective basis that is agreed upon as a guideline for organizing laws for social life.

Abstract

The Indonesian Civil Code (KUHPerdata), a legacy of colonial law, has been in effect for over a century and is increasingly unable to address the normative challenges posed by the digital era and globalization. These include the lack of regulation concerning electronic transactions, personal data protection, digital assets, and cross-border dispute resolution. This study aims to assess the current capability of KUHPerdata to meet modern legal demands and to propose a renewal approach based on relevant legal principles and theories of legal formation. Using a normative juridical method with a statute approach, this research analyzes primary, secondary, and tertiary legal materials through descriptive analysis. The findings reveal significant normative limitations of KUHPerdata in responding to socio-economic and technological transformations. Legal reform is therefore urgently required, based on the principles of justice, legal certainty, freedom of contract, and consumer protection, and grounded in legal theories such as natural law, legal positivism, progressive law, and living law. The renewal must aim to create a responsive and globally integrative civil law system that can accommodate technological advancements and international legal standards. In conclusion, reforming KUHPerdata is not only a legal necessity but also a strategic effort to enhance Indonesia’s legal competitiveness in the global legal landscape.

Abstract

Purpose: This study aims to explore the implementation of spatial planning legal policies to protect rice fields and residential areas that are vital to supporting agritourism and the growth of MSMEs (Micro, Small, and Medium Enterprises) in Penatih Dangin Puri Village, Bali. Research Methodology: A community service approach was employed, consisting of legal socialization, participatory land use training, and advocacy directed at both village authorities and regional governments. Qualitative participatory observation and documentation techniques were used to measure awareness and stakeholder engagement. Results: The program increased community understanding of spatial planning regulations and their connection to agritourism and MSME development. Stakeholders began aligning land-use practices with environmentally friendly zoning principles. Notably, early synergy emerged between village leaders and residents in preserving rice fields as agritourism assets. Conclusions: Implementing spatial planning legal policies effectively enhances local capacity for sustainable land use and economic development. Protecting agricultural and residential zones contributes to the long-term viability of agritourism and MSMEs in Bali. Limitations: The study was localized to a single village and focused on short-term awareness-building. Broader regional engagement and long-term evaluation are required to generalize findings. Contribution:This study provides a practical model for community-based spatial planning that integrates legal frameworks with sustainable tourism and MSME growth, potentially applicable to other rural tourism areas in Indonesia.

Abstract

Debitur adalah sebutan bagi perusahaan atau individu yang berhutang uang kepadalembaga lain. Jika utang dalam bentuk pinjaman dari lembaga keuangan, maka debitur disebutsebagai peminjam. Lain halnya jika utang dalam bentuk sekuritas, maka debitur disebut sebagaipenerbit. Secara hukum, seseorang yang dengan sukarela menyatakan kebangkrutan juga dianggapsebagai debitur. Secara umum, debitur adalah pihak yang berhutang kepada orang lain ataupihak lain. Istilah lain dari debitur adalah peminjam. Mereka biasanya akan menerima sesuatudari kreditur atau pihak yang meminjamkan. Akan ada akad yang mana seorang peminjam harusberjanji untuk membayar atau mengganti sesuatu di masa yang akan datang sesuai ketentuan.Pinjaman yang nantinya bisa peminjam terima kadang memerlukan sebuah jaminan atau agunanuntuk bisa pihak kreditur terima. Jaminan ini akan menjadi penghubung dan bukti ikatankepercayaan dari kedua belah pihak. Jika nanti seorang debitur gagal membayar sesuai tenggatwaktu yang sudah peminjam sepakati bersama kreditur, maka jaminan itu bisa pindah tanganatau tersita oleh pihak yang memberikan pinjaman. Beda lagi ceritanya kalau seorang peminjambisa mengembalikan pinjaman ke kreditur sesuai dengan perjanjian, maka aset yang jadi jaminanakan kembali padanya. Jaminannya bisa dalam bentuk benda bergerak atau aset berharga sepertisertifikat tanah sampai deposito di bank. Dalam hal ini orang dikatakan sebagai debitur adalahorang atau perorangan yaitu dalam hal ini baik laki-laki maupun perempuan dapat dinyatakanpailit oleh pengadilan jika tidak mampu membayar hutang kepada satu atau lebih kreditur.Perserikatan-perserikatan atau perkumpulan-perkumpulan yang bukan badan hukum sepertimaatschap, firma dan perkumpulan komanditer, perseroan atau perkumpulan-perkumpulan yangberbadan hukum seperti Perseroan Terbatas (PT), Koperasi dan Yayasan

Abstract

From a juridical perspective, the weakness of the State Administrative Law (SAL) system can be regarded as one of the factors that facilitates the occurrence of corruption in Indonesia. The ambiguity of legal norms and the inadequacy of supervisory instruments within the framework of SAL create loopholes for the abuse of power by state officials, which ultimately harms the public interest. Corruption—essentially the misuse of public authority for personal or group gain—often thrives within an administrative system that lacks sufficient principles of efficiency, transparency, and accountability. Based on this premise, the focus of this study is directed toward two main legal issues related to investment governance in Bali Province: (1) How can a juridical perspective help in understanding the weakness of State Administrative Law as a trigger for corruption in Indonesia? and (2) What solutions can be proposed to address the weaknesses in State Administrative Law in order to prevent corruption in Indonesia? This study is doctrinal in nature and utilizes primary, secondary, and tertiary legal materials. The data collection technique involves the card system and employs a statutory approach, factual approach, and conceptual analysis approach. The findings of this research indicate that juridical approaches to combating corruption should not be limited to repressive measures or sanctions but must also include preventive and corrective strategies. This includes reforming the structure of administrative law, optimizing oversight mechanisms, and integrating administrative law principles into all aspects of government administration. Systemic efforts to strengthen State Administrative Law as part of an anti-corruption strategy must be implemented collaboratively and sustainably. These efforts include regulatory reform, institutional restructuring, and the reinforcement of integrity values and transparency principles in the execution of governmental functions.
