Abstract

The state of intoxication is one of the factors in an accident, namely because someone who is drunk is trying to bring the vehicle in a state of unconsciousness so that the probability of harming others is higher. La Fani is an example of a perpetrator who drove drunk and hit the victim's motorcycle La Jasi. This study examines the decision No. 61/Pid.Sus/2020/Fr.The Wgw deals with the legal consequences of the criminal act of drunk driving to the point of causing the death of another person and links it to the 16th goal of the SDGs . In this study used legal research methods according to the law. Normative law research studies library law by looking at library materials or secondary materials. This method also analyzes various sources of legal information, which are then neatly arranged to make it easier to draw conclusions related to these problems. For the sake of enabling positive regulations and other relevant provisions to be adapted to current problems, legislation is used in this study. After an in-depth study, it was found that La Fani was guilty of operating a motor vehicle while intoxicated and resulting in the taking of the lives of others in accordance with law no. 22 of 2009 on traffic and Road Transport, Article 311 paragraph (5). To meet the 16th Sustainable Development Goal (SDGs), there is a need for strict enforcement of the Law Against Drunk Driving and increased public awareness of the issue of drunk housing in general through educational and social campaigns.

Abstract

Amid the wave of digitalization, the judicial system is required to adapt and innovate to provide faster, easier, and more efficient access to justice for the public. One rapidly evolving innovation is the implementation of Online Mediation (Online Dispute Resolution/ODR). According to Article 1 of the Supreme Court Regulation (PERMA) No. 1 of 2016, mediation is defined as a dispute resolution process conducted through negotiations between the disputing parties, assisted by a mediator to reach a mutual agreement. In the context of divorce cases, mediation is considered crucial as it may help reduce the high rate of divorce. The issuance of Supreme Court Regulation No. 3 of 2022 concerning Electronic Mediation further solidifies the status of online mediation as an official part of the dispute resolution mechanism within the court system. This research adopts a normative juridical approach and employs qualitative analysis through a case study of Divorce Petition No. 440/Pdt.G/2024/PA.Pct, relying primarily on secondary data sources.

Abstract

The phenomenon of the rapid development of social media has an impact on the notary profession as a public official. Notaries often use digital platforms such as Instagram to include their names and positions, which is categorized as covert promotion. In fact, based on the Notary Position Law and the Notary Code of Ethics, acts of self-promotion are prohibited because they can degrade the dignity of the profession. This research uses normative juridical method and case approach to examine the prohibition of promotion and the sanctions that can be imposed. The results show that supervision of ethical violations in the digital space has not been optimal, and existing sanctions have not provided a deterrent effect. Therefore, it is necessary to strengthen the supervision system and enforcement of sanctions to maintain the integrity of notaries. This research is expected to contribute to the renewal of notary professional ethics in the digital era.
