Abstract

Many rape cases occur in environments that should provide a sense of security, but actually do the opposite. The term sexual violence is an unreasonable sexual act or act that can harm the victim. This research uses qualitative research methods involving analysis of legal documents and legal literature (Decision Number 139/Pid.B/2017 /PN Jap). This research uses library research to collect data. This research uses secondary data sources such as books, journals, articles and the decision of the Jayapura District Court Number 139/Pid.B/2017/PN Jap. Normative legal research is the type of research used. The results of this research show that the crime of sexual crime or rape is to satisfy the perpetrator's desires by force or not with the consent of both parties. Based on the juridical side, the criminal act of rape is seen based on existing elements, one of which is the occurrence of violence. If seen based on the decision in case Number 139 / Pid.B / 2017 / PN Jap, it is clear that this is a criminal act of rape. However, based on criminology, the benchmark is consent, not violence. These factors determine and classify the act as rape.

Abstract

Amid the wave of digitalization, the judicial system is required to adapt and innovate to provide faster, easier, and more efficient access to justice for the public. One rapidly evolving innovation is the implementation of Online Mediation (Online Dispute Resolution/ODR). According to Article 1 of the Supreme Court Regulation (PERMA) No. 1 of 2016, mediation is defined as a dispute resolution process conducted through negotiations between the disputing parties, assisted by a mediator to reach a mutual agreement. In the context of divorce cases, mediation is considered crucial as it may help reduce the high rate of divorce. The issuance of Supreme Court Regulation No. 3 of 2022 concerning Electronic Mediation further solidifies the status of online mediation as an official part of the dispute resolution mechanism within the court system. This research adopts a normative juridical approach and employs qualitative analysis through a case study of Divorce Petition No. 440/Pdt.G/2024/PA.Pct, relying primarily on secondary data sources.

Abstract

The phenomenon of alcohol and drug abuse among teenagers and young people in Indonesia continues to show a worrying trend, both in terms of the level of occurrence and the consequences caused. This article aims to reveal the main factors driving the occurrence of drinking parties that lead to drug abuse among young people and relevant prevention and handling strategies, in order to reduce the risk of similar incidents in the future. This study uses a qualitative approach with content analysis obtained from news broadcasts and media documentation. The results of this study indicate that adolescent involvement in drinking parties is driven by internal factors such as curiosity and the search for identity, as well as external factors such as peer pressure and permissive social norms, and the transition to drug abuse occurs gradually and is reinforced by interactions in the community. In terms of handling, the legal approach is now starting to prioritize rehabilitation over criminalization, although challenges such as lack of facilities and community stigma are still obstacles in the process of social reintegration. Therefore, a collaborative approach is needed involving families, schools, communities, and law enforcement.

Abstract

This study examines Non-Consensual AI-Generated Sexual Content as a form of digital voyeurism under Indonesian criminal law. Using a normative juridical method, the research analyzes the application of the Electronic Information and Transactions Law, Pornography Law, Sexual Violence Law, and Personal Data Protection Law in addressing deepfake pornography that manipulates a victim’s image without consent. The findings show that such acts constitute layered criminal offenses, including electronic data manipulation, obscenity violations, electronic-based sexual violence, and personal data misuse. However, law enforcement faces significant challenges, including technical detection issues, lack of AI-specific regulations, perpetrator anonymity, and cross-border jurisdiction barriers. This study highlights the need for dedicated AI regulation and strengthened law-enforcement capacity to ensure effective victim protection.
