One of the problems that occurs in developing countries like Indonesia is social inequality, or the increasingly widening gap in income distribution between groups, between urban and rural areas. This high poverty rate has a direct impact on the poor standard of living of people who choose to live on the streets as beggars (sprawl). As stated in regional regulations that seek to provide a deterrent effect, the Badung Regency Government continues to strive to improve supervision and control of sprawl. The government is fighting against sprawl in areas that commonly occur and disrupt public permits by carrying out efforts to prevent sprawl in Badung Regency through the Civil Service Police Unit. Based on the findings of this research, it can be said that Regional Regulation Number 7 of 2016 concerning Public Order and Community Peace is the basis for eradicating sprawl in the Badung Regency area which is very difficult to implement and is not yet functioning well. This requires support from various related parties, all levels of society in Badung Regency, as well as tourists who come to the Badung area itself.

The objectives of this study include the regulation of foreigners' residence permits in Indonesia based on the Law on Immigration and how sanctions for foreigners who violate residence permits in Indonesia or what is commonly called Overstay. This research uses descriptive normative method. The results of this study are “Immigration is a matter of traffic in people entering or leaving the territory of the Republic of Indonesia and Supervision of foreigners in Indonesia.” Referring to the Immigration Law, there are two important regulatory elements, namely 1) regulations regarding all matters relating to the traffic of people leaving and entering and staying in the territory of the Republic of Indonesia, 2) regulations relating to all matters concerning the supervision of foreigners in the territory of Indonesia. Sanctions that can be implemented for cases of foreign nationals (WNA) who violate the abuse of residence permits are in the form of administrative immigration sanctions (TAK) or criminal sanctions. Administrative sanctions are sanctions given by immigration officials to foreigners outside of the judicial mechanism. While criminal sanctions are a mechanism that runs on a network where there is involvement from law enforcement.ABSTRAKTujuan penelitian ini meliputi pengaturan izin tinggal WNA di Indonesia berdasarkan Undang-Undang tentang Keimigrasian dan bagaimana sanksi bagi WNA yang melanggar izin tinggal di Indonesia atau yang biasa di sebut dengan Overstay. Penelitian ini menggunakan metode deskriptif normative. Hasil dari penelitian ini yaitu “Keimigrasian adalah hal ihwal lalu lintas orang yang masuk atau keluar wilayah Negara Republik Indonesia dan Pengawasan orang asing di Indonesia.” Mengacu pada UU Keimgirasian ada dua unsur aturan penting yaitu 1) aturan mengenai semua hal yang bekaitan dengan lalu lintas dari orang yang pergi dan masuk serta tinggal di wilayah Republik Indonesia, 2) peraturan yang berkaitan dengan segala hal tentang pengawasan untuk orang asing di wilayah Indonesia. Sanksi yang bisa diimplementasikan untuk kasus Warga Negara Asing (WNA) yang melanggar penyalahgunaan izin tinggal yaitu dalam bentuk sanksi administrative keimigrasian (TAK) atau sanksi pidana. Mengenai sanksi administrative yaitu sanksi yang diberikan Pejabat Imigrasi untuk WNA di luar dari mekanisme peradilan. Sedangkan sanksi pidana yaitu sebuah mekanisme yang berjalan pada sebuah jaringan dimana ada keterlibatan dari penegak hukum.

This research aims to investigate the extent of the duties and functions of correctional officers and what strategies are carried out by correctional institutions in natural disaster mitigation efforts. Mitigation of natural disasters, namely earthquakes, is one of the security and order disturbances in certain circumstances mentioned in Article 24 of the Minister of Law and Human Rights Regulation Number 33 of 2015. This research must continue to be carried out because as an evaluation material for natural disaster mitigation, namely earthquakes by officers in correctional institutions and as a preventive measure as well. This research uses empirical research methods. Data sources are primary data and secondary data. Data collection techniques through observation, interviews, and document studies. The results showed that the duties and functions of Correctional Officers have been divided into pre-disaster, disaster and post-disaster stages to minimize victims and potential security disturbances. Earthquake disaster mitigation strategies by this penitentiary as a vulnerable group, most have implemented disaster risk management based on the policies of the Directorate General of Corrections.ABSTRAKPenelitian ini bertujuan untuk menyelidiki sejauh mana tugas dan fungsi petugas pemasyarakatan beserta strategi apa saja yang dilakukan oleh lembaga pemasyarakatan dalam upaya mitigasi bencana alam. Mitigasi bencana alam yakni gempa bumi merupakan salah satu gangguan keamanan dan ketertiban dalam keadaan tertentu yang disebutkan pada Pasal 24 Peraturan Menteri Hukum dan Hak Asasi Manusia Nomor 33 Tahun 2015. Penelitian ini harus terus dilakukan karena sebagai bahan evaluasi terhadap mitigasi bencana alam yaitu gempa bumi oleh petugas di Lembaga Pemasyarakatan dan sebagai langkah preventif pula. Penelitian ini menggunakan metode penelitian empiris. Sumber data berupa data primer dan data sekunder. Teknik pengumpulan data melalui observasi, wawancara, dan studi dokumen. Hasil penelitian menunjukkan bahwa tugas dan fungsi Petugas Pemasyarakatan telah terbagi dalam tahap pra bencana, saat bencana dan pasca bencana untuk meminimalisir korban dan potensi gangguan keamanan. Strategi mitigasi bencana gempa bumi oleh Lembaga Pemasyarakatan ini sebagai kelompok rentan, sebagian besar telah mengimplementasikan manajemen risiko bencana berdasarkan kebijakan Direktorat Jenderal Pemasyarakatan.

The purpose of this paper is to find out how international law views immigration actions, namely deportation and what efforts are made by immigration in maintaining national security through the deportation of foreigners. The type of research used in this research plan is normative legal research which is legal research conducted by studying, reviewing legislation and literature as well as legal materials related to the regulation of residence permits. A country has the right to deport foreign nationals who are in its territory. However, although deportation is a forced action, its implementation must not exceed humanitarian values and human rights. Article 9 of Law Number 6 Year 2011 on Immigration also emphasizes that every person who enters or exits the territory of Indonesia must go through an examination conducted by an Immigration Officer at an Immigration Checkpoint. To realize this, Immigration cooperates with the ranks of the Indonesian National Police (Polri), the Indonesian National Army (TNI) to be embraced in the framework of law enforcement.ABSTRAKTujuan dari penulisan ini adalah untuk mengetahui bagaimana hukum internasional memandang tindakan keimigrasian yaitu deportasi dan upaya apa yang dilakukan imigrasi dalam menjaga keamanan nasional melalui tindakan pendeportasian Orang Asing. Jenis penelitian yang digunakan dalam rencana penelitian ini adalah penelitian hukum normatif adalah penelitian hukum yang dilakukan dengan cara mempelajari, mengkaji peraturan perundang-undangan dan literatur serta bahan-bahan hukum yang berhubungan dengan pengaturan ijin tinggal. Suatu negara berhak untuk melakukan tindakan deportasi kepada Warga Negara Asing yang berada di wilayah negaranya. Namun, walaupun deportasi merupakan suatu tindakan paksa, tetapi implementasinya tidak boleh melewati nilai-nilai kemanusiaan dan hak asasi manusia. Pada Pasal 9 Undang – Undang Nomor 6 Tahun 2011 tentang Keimigrasian juga menegaskan bahwa setiap orang yang masuk atau keluar wilayah Indonesia wajib melalui pemeriksaan yang dilakukan oleh Pejabat Imigrasi di Tempat Pemeriksaan Imigrasi. Untuk mewujudkan hal tersebut, Keimigrasian melakukan kerjasama dengan jajaran Polisi Republik Indonesia (Polri), Tentara Negara Indonesia (TNI) untuk dirangkul dalam rangka penegakan hukum.

Health is a basic need that involves physical, mental, and social conditions. Health is recognized as a human right obtained by an individual regardless of background even a prisoner in a Correctional Institution. According to Law Number 22 Year 2022 concerning correction, health services, the right food based on nutrition needs was one of the rights for the prisoners. This research aimed to examine the deeper problems regarding rights fulfillment to obtain healthy services from the role of Class IIA Correctional Institution Kerobokan. Primer data and seconder data source were used in this study. The research method was descriptive qualitative. The result showed that the absence of maximum rights fulfillment to the prisoners in Class IIA Correctional Institution Kerobokan since the barriers including overcapacity, lacking of health workers and facilities as well as infrastructures. So that, must be build cooperation between relevant institution, as well as giving education and training to the correctional officer.ABSTRAKKesehatan merupakan suatu kebutuhan dasar yang melibatkan kondisi fisik, mental serta sosial. Kesehatan diakui sebagai suatu hak asasi manusia yang didapatkan oleh seorang individu tanpa memandang latar belakang termasuk seorang narapidana di Lembaga Pemasyarakatan. Berdasarkan Undang-undang No. 22 Tahun 2022 tentang pemasyarakatan, pelayanan kesehatan dan, makanan yang layak sesuai kebutuhan gizi adalah salah satu hak yang didapatkan oleh narapidana. Tujuan penelitian ini adalah untuk mengkaji permasalahan secara lebih mendalam dalam pemenuhan hak mendapatkan pelayanan kesehatan dari peran Lembaga Pemasyarakatan Kelas IIA Kerobokan. Sumber data primer dan data sekunder digunakan dalam penelitian ini. Metode penelitian ini adalah deskriptif kualitatif. Hasil penelitian menunjukkan bahwa belum adanya pemenuhan hak narapidana yang maksimal di Lapas Perempuan Kelas IIA Kerobokan karena hambatan-hambatan berikut meliputi, over kapasitas, kurangnya tenaga kesehatan serta sarana dan prasarana yang kurang memadai. Sehingga perlu dibentuk kerjasama antara lembaga terkait, serta memberikan edukasi dan pelatihan terhadap petugas pemasyarakatan.

Legal certainty in property ownership is crucial for protecting the rights and interests of property owners. This study examines the legal certainty provided by ownership certificates for flats under Indonesia's "Law No. 20 of 2011" (UURS). It also explores the legal implications of constructing flats on land with building use rights, a status that differs from full ownership rights. Using a normative research method, the study analyzes relevant laws, regulations, and academic literature to understand how legal frameworks govern flat ownership and ensure the legitimacy of ownership certificates. The findings reveal that ownership certificates for flats confer private ownership of specific units and related common areas, but legal challenges arise when flats are constructed on land with building use rights, especially concerning the renewal of these rights. The study underscores the importance of continuous legal oversight and clear legislative guidelines to maintain and strengthen legal certainty over ownership certificates. Additionally, it highlights the potential legal risks and uncertainties that flat owners may face if the underlying land rights are not properly managed or renewed. The study concludes that while ownership certificates offer significant legal protection, the dependence on building use rights for the underlying land introduces potential vulnerabilities. Future research should explore the legal and practical implications of the expiration and renewal of building use rights, the impact on flat ownership, and alternative legal frameworks that could provide greater security for property owners.

The use of organic firearms by the Indonesian National Police (Polri) in securing National Vital Objects (Obvitnas) and Certain Objects within the jurisdiction of Bali Regional Police (Polda Bali) is conducted in a strict and structured manner. Authorization must follow an official hierarchical process, beginning with the officer’s request and requiring approval by the Regional Police Chief (Kapolda) through the Director of Intelligence and Security (Intelkam). Requirements include a written request, assignment letter, firearm control card, and firearm passbook, along with field verification of the applicant and the condition of the weapon. Firearms may only be used in situations involving an actual threat to life, preceded by mandatory warnings and with full accountability for every action taken. Misuse of firearms is considered a serious offense, subject to administrative sanctions such as demotion or dismissal, and criminal penalties under Law No. 12 of 1951 on Unauthorized Firearm Possession and the Indonesian Penal Code (KUHP), including Articles 351, 338, and 359. Legal proceedings are conducted in general courts without exception. Strict supervision and regular evaluations are carried out to prevent misuse. Firm and transparent law enforcement is essential to maintaining professionalism and public trust in Polri.

This research discusses the legal protection of protected animals under the Law on Conservation of Living Natural Resources and Ecosystems in Indonesia. The existence of protected animals is increasingly threatened, so an understanding of the applicable law is important to prevent violations. The objectives of this study are to (1) determine the legal protection of protected animals, and (2) evaluate the legal consequences of Decision Number 809/PID.SUS/2024/PN DPS on the protection of protected animals. The research method used is normative legal research with a statutory approach, case approach, and conceptual approach. Data collection was conducted through a literature study that involved reading, reviewing, and recording relevant legal sources. The results showed that the legislative framework in Indonesia for the protection of protected animals is regulated in Law No. 5 of 1990, which has been amended into Law No. 32 of 2024. Decision number 809/PID.SUS/2024/PN DPS shows that there are positive and negative impacts on animal protection, where although there are considerations of justice, there is potential for future law violations. This research concludes that the legal protection of protected animals in Indonesia requires strengthening in law enforcement and increasing public awareness. Recommendations are proposed to increase socialization on the types of protected animals and the sanctions that apply to violations.

The integration of electronic systems into the judicial process represents a significant advancement in legal practice. The advent of e-Court and electronic mediation represent a broader trend towards integrating technology to improve the efficiency and reach of judicial processes. This study aims to find out the stages of implementation of Supreme Court Regulation Number 3 of 2022 concerning Electronic Mediation in the jurisdiction of the Denpasar District Court, and the inhibiting factors of the implementation of the regulation in this jurisdiction. The study provides valuable insights into the practical application of electronic mediation, highlights challenges faced in the field, and offers recommendations for improving the regulatory process and overcoming obstacles. This research could evaluate how legal representatives support parties in fulfilling their rights and obligations during electronic mediation. Additionally, investigating the specific obstacles related to software and human resources could provide insights into how these challenges impact the mediation process.

The implementation of electronic trials (e-Litigation) at the Denpasar District Court is a significant step forward in the modernization of the judicial system. This study aims to find out the implementation of the electronic trial and the obstacles encountered during its implementation. The research contributes by providing insights into the practical challenges of adopting electronic trials in a specific judicial context, potentially offering recommendations for overcoming these obstacles. The findings could be valuable for policymakers, legal practitioners, and other courts looking to optimize their own implementation of e-Court.
