Abstract

This study aims to identify and understand in depth the factors that cause development in the green open space zone and agricultural zone in Mengwi District, Badung Regency, as well as analyze the legal certainty for building owners in these zones. The research was carried out in a qualitative descriptive manner with legal interpretation and legal communication methods, which systematically prepared legal materials to be presented in the thesis entitled "Legal Certainty Against the Distribution of Buildings and Conformity with Detailed Spatial Plans in the Mengwan District Area (RDTR WP), Especially in the Green Open Space Zone and Agricultural Zone." The results show that social factors such as population growth, inheritance rights distribution system, and low interest of the younger generation in agriculture are the most important factors that affect the development and conversion of green open spaces (RTH) in this area. However, there are challenges in law enforcement such as the effectiveness of long-standing regulations and the lack of public awareness of the importance of preserving green lanes. The government and related agencies need to be more decisive in sanctioning buildings in the area to maintain green areas and agriculture as a mitigation effort in preventing land conversion. This research is expected to be a guideline for the community in using land in accordance with spatial planning, providing input for the government on the legal impact of land use transitions, and providing guidance for all stakeholders related to land use.

Abstract

The advancement of information technology has significantly impacted society, transforming conventional crimes into cybercrimes using computers and the internet. One such example is exhibitionism via video call-based social media. This act is not yet specifically addressed in the Information and Electronic Transactions (IET) Law. Applying Article 27 Paragraph (1) of the IET Law, which deals with indecent acts, does not cover this scenario as it lacks the "known to the public" element, creating a legal gap. Consequently, two issues arise: the legal regulation of exhibitionism in Indonesia and the legal policy considerations for exhibitionism through video call-based social media under the IET Law. This normative research employs legislative, conceptual, and historical approaches, drawing from primary, secondary, and tertiary legal materials collected through library research. The materials are analyzed using descriptive, systematization, construction, argumentation, and evaluation techniques. To address this legal gap, policy reforms in criminal law are necessary. Amending Article 27 Paragraph (1) of the IET Law to include "to another person without the consent or desire of that person" is essential. This amendment would allow the prosecution of exhibitionism via video call-based social media, ensuring legal certainty and protection for victims, particularly women and children.

Abstract

Land registration is an important step in the land administration system to reduce disputes, increase transparency, and ensure compliance with applicable laws and regulations. However, in practice, there are many cases where individuals or groups try to control or claim rights to land that do not belong to them personally, through various unlawful means, including unauthorized certification. This study aims to know and analyze in depth the conditions that must be met in the registration of inherited land and the legal consequences for cultivators/appointees who wrongfully certify land that does not belongs to them. Specifically, this study focuses on the specific legal requirements for registering inherited property and the implications for individuals who attempt to register land illegitimately, highlighting the potential legal repercussions and the need for enforcement of property rights. The findings of this study can be used as a reference for policymakers and legal practitioners.

Abstract

Witness testimony holds a central position as a valid means of evidence under Article 184 of the Indonesian Criminal Procedure Code (KUHAP). However, the legitimacy of unsworn witness statements remains a contentious legal issue, particularly in cases involving victims of sexual violence, children, or individuals who refuse to take an oath due to psychological, religious, or personal reasons. Articles 160 and 185 of KUHAP mandate an oath as a formal requirement, with limited exceptions under Article 171. The absence of an operational definition for “legitimate reasons” for refusing to swear leads to inconsistent court decisions and legal uncertainty. This research adopts normative, case, and conceptual approaches using secondary data analyzed qualitatively. Findings reveal that most judges strictly interpret the validity of evidence, yet some adopt a progressive stance by accepting unsworn statements as supporting evidence when corroborated by other legal proofs. Reform of criminal procedure law is urgently needed to create a more adaptive system that accommodates substantive justice and the protection of vulnerable witnesses, while ensuring legal certainty and safeguarding human rights in the evidentiary process.

Abstract

The use of organic firearms by the Indonesian National Police (Polri) in securing National Vital Objects (Obvitnas) and Certain Objects within the jurisdiction of Bali Regional Police (Polda Bali) is conducted in a strict and structured manner. Authorization must follow an official hierarchical process, beginning with the officer’s request and requiring approval by the Regional Police Chief (Kapolda) through the Director of Intelligence and Security (Intelkam). Requirements include a written request, assignment letter, firearm control card, and firearm passbook, along with field verification of the applicant and the condition of the weapon. Firearms may only be used in situations involving an actual threat to life, preceded by mandatory warnings and with full accountability for every action taken. Misuse of firearms is considered a serious offense, subject to administrative sanctions such as demotion or dismissal, and criminal penalties under Law No. 12 of 1951 on Unauthorized Firearm Possession and the Indonesian Penal Code (KUHP), including Articles 351, 338, and 359. Legal proceedings are conducted in general courts without exception. Strict supervision and regular evaluations are carried out to prevent misuse. Firm and transparent law enforcement is essential to maintaining professionalism and public trust in Polri.

Abstract

The objectives of this thesis are to analyze the implementation of the submission of summons reports through the village head in the verstek decision and to analyze the obstacles to the implementation of the submission of summons reports through the village head in the verstek decision. The type of research used in this study is empirical juridical legal research. In empirical juridical research, law, as law in action, is described as an empirical social phenomenon. Empirical legal research, also known as sociological legal research, is legal research that examines law by conceptualizing it as actual behavior, an unwritten social phenomenon experienced by everyone in social relationships. The results of this study found that the implementation of the submission of summons reports through the village head in the verstek decision is related to the implementation of summons in civil cases at the Bangli District Court. Since the issuance of PERMA Number 7 of 2022, there has been a change in the implementation of the submission of summons reports, from the conventional summons issued through a bailiff to now using registered mail. There are no sanctions or penalties for the sub-district or village if they do not directly convey the summons given, and the requirement for postal officers to convey the village head also faces time constraints and the busyness of the postal officers themselves, who must adjust the workload of postal delivery, which of course has a postal delivery target aligned with the opening or service hours of the post office or sub-district office.

Abstract

Police officers as law enforcers have a central role in law enforcement. Problems arise when police officers actually break the law or commit crimes. The crimes committed not only violate criminal law, but also violate the ethics and code of the police profession. Based on this description, the problem can be formulated as follows: How is the responsibility of police officers who commit crimes in the Bali Regional Police (Polda) and What are the obstacles to imposing sanctions for police officers who commit crimes in the Bali Regional Police (Polda). The responsibility of police officers who commit crimes includes accountability for the code of ethics and criminal accountability through general justice and its resolution internally within the institution, namely through a disciplinary hearing by the Indonesian National Police Code of Ethics Commission (KKEP). Obstacles to the application of sanctions for police officers who commit crimes in the Bali Regional Police are in the form of internal problems within the Polri structure, such as limited facilities and infrastructure, information networks, number of personnel, and budget support. In addition, there are also external obstacles that come from the community, such as lack of evidence and witnesses, community apathy, and lack of supporting facilities
