Abstract

Keabsahan politikus sebagai saksi nikah dalam perspektif hukum Islam merupakan topik yang menarik dan penting untuk dieksplorasi. Saksi nikah memiliki peran krusial dalam validasi pernikahan menurut hukum Islam. Penelitian ini bertujuan untuk menganalisis keabsahan politikus sebagai saksi nikah dengan menelaah literatur hukum Islam dan pandangan ulama terkait. Penelitian ini menggunakan metode kualitatif analisis dengan kajian pustaka yang melibatkan Al-Qur'an, hadis, serta pendapat para ulama dan hukum Islam kontemporer. Hasil penelitian menunjukkan bahwa syarat sahnya saksi nikah menurut hukum Islam meliputi: harus beragama Islam, berjenis kelamin laki-laki (atau dalam beberapa pandangan, satu laki-laki dan dua perempuan), dewasa (baligh), berakal, adil, dapat mendengar dan melihat, bersih dari tuduhan, dan memahami bahasa ijab qabul. Dari perspektif ini, politikus yang memenuhi syarat-syarat tersebut dapat dianggap sah sebagai saksi nikah. Penelitian ini berkontribusi pada pemahaman yang lebih mendalam tentang peran politikus dalam institusi pernikahan menurut hukum Islam dan memperkuat pandangan bahwa setiap individu, termasuk politikus, harus memenuhi syarat-syarat tertentu untuk menjadi saksi yang sah dalam pernikahan.

Abstract

Online stores have become one of the most important aspects in the world of e-commerce, with increasing attention to factors that affect customer confidence in online transactions. The study aims to investigate the impact of service quality and customer satisfaction on customer confidence in the TikTok online store. The method used involves the use of online surveys using data filling forms (Google Forms) to users of the online shop. The data collected is analyzed using regression analysis to evaluate the relationship between independent variables (service quality and client satisfaction) and dependent variables. (customer trust). The results show that good service quality and customer satisfaction levels positively affect the level of customer confidence in TikTok online stores. These findings show the importance of providing high-quality service and paying attention to customers’ satisfaction to build trust in an e-commerce environment. The uniqueness of the study is the use of online surveys with data filling forms, which enables efficient data collection that can reach respondents from a variety of geographical backgrounds, as well as focusing on TikTok's still relatively new online shopping platform in the e-commerce market, adding insight into factors affecting customer confidence.

Abstract

This research is motivated by human rights issues that often occur in carrying out work to meet economic needs. However, this is regulated in the Job Creation Law which was passed in 2020 considering the protection of Human Rights (HAM) for workers. This study aims to determine and analyze the Protection of Human Rights for Workers in the Job Creation Law from an Islamic Law Perspective. The research methodology used is literature research (library research) involving analysis of primary and secondary legal materials. The results of the study show that although the Job Creation Law includes elements of protection such as PKWT compensation and social security, its implementation still faces several problems, such as limited supervision and bias towards employers. The Islamic law perspective emphasizes fair treatment and justice for workers, which can be used as a reference to improve the protection of human rights in employment. Strict supervision and strengthening of regulations in line with the principles of social justice and human rights must be used to improve the protection of workers' rights.
