Abstract

The Supreme Court of Indonesia is pivotal as a representative of judicial power. However, evaluations and reports indicate suboptimal performance outcomes, necessitating the implementation of a structured performance tiering framework. This research employs an empirical juridical approach involving surveys, court visits, and focus group discussions, supplemented by a literature review. The study highlights the Supreme Court's need to operationalize its vision of "Realizing Indonesia's Supreme Judicial Body" through clear, measurable performance indicators. Adopting Logical Models, Logical Frameworks, and Critical Success Factors can streamline accountability, enhance judicial efficiency, and ensure alignment across organizational tiers. This paper outlines the steps and benefits of performance tiering in improving Indonesia's judicial system. Performance tiering will become a thinking summary of institutions' functions, use of authority, performance and organization achievements, organization direction, and even paradigm of every process in the Supreme Court and judicial entities under them. The performance tiering of the Supreme Court should ideally adopt the Logical Model, Logical Framework, and Critical Success Factors.

Abstract

Barriers to realizing accessibility for women and children in religious courts are still quite significant. Even after five years have passed since Supreme Court Regulation Number 3 of 2017 on Guidelines for Trying Women’s Cases in Conflict with the Law was published. The initial suspicion is that this is still an unresolved problem because law enforcement’s sensitivity to the needs of women and children has yet to be developed. Gender mainstreaming is then encouraged to overcome this. The problem that is the focus of discussion in this research is how to increase the accessibility of justice for women and children in religious courts. The aim is to elaborate and analyze the problem of how to increase the accessibility of justice for women and children in religious courts. The research method used is normative juridical, the research specification is descriptive analysis, and the data collection technique is library research. The research results show that most of the existing obstacles in access to justice and law for women and children after divorce still exist and still need to be resolved. The Supreme Court, as the supervisor of religious courts, has issued several regulations to overcome this problem. In fact, after several of these regulations were issued, difficulties with access to justice continued to occur, primarily related to the implementation of decisions/ executions. Gender mainstreaming by judges and religious court officials is needed to narrow the gap in access to justice and law for women and children after divorce. The urgency is because women and children are vulnerable parties, have limitations, and have extensive obstacles in accessing justice in court. Hence, they require support for convenience, priority access, simplification of business processes, and additional authority for judges in their positions (e.g., officio) when handling cases of women and children.

Abstract

Pasca terbitnya Undang-Undang Nomor 3 Tahun 2006 tentang Perubahan atas Undang-Undang Nomor 7 Tahun 1989 tentang Peradilan Agama yang menegaskan kompetensi dan kewenangan Peradilan Agama dalam memeriksa, mengadili, dan menyelesaikan perkara ekonomi syariah. Namun adanya payung hukum tersebut belum diimbangi oleh keberadaan hakim yang tersertifikasi ekonomi syariah yang merata di pengadilan agama seluruh Indonesia. Muncul gagasan untuk membentuk pengadilan niaga syariah yang dikuatkan oleh tinjauan sosiologis-historis, tinjauan yuridis, dan tinjauan faktual mendukung dibentuknya Pengadilan Niaga Syariah. Terlebih lagi pembentukan pengadilan niaga syariah akan menyelesaikan sebagian permasalahan ekonomi syariah yang berupa kesenjangan kelembagaan peradilan umum dan peradilan agama, penguatan konsep one roof system antar peradilan, efisiensi penempatan hakim agama yang telah tersertifikasi, mewujudkan pengadilan di lingkungan peradilan agama yang memiliki kompetensi dan profesionalisme dalam penyelesaian perkara ekonomi syariah, serta juga menjalankan amanat Penjelasan Pasal I Angka 2 Pasal 3A Ayat (1) Undang-Undang Nomor 50 Tahun 2009 tentang Perubahan Kedua atas Undang-Undang Nomor 7 Tahun 1989 tentang Peradilan Agama.

Abstract

Law plays a crucial role in regulating social behavior and enforcing rules in society. Indonesia is a nation based on the rule of law and expects its citizens to comply with it for the sake of harmony and collective prosperity. However, there are specific concerns regarding the juvenile justice system in Indonesia which is yet to be optimized. Social environmental factors, such as family dynamics and economic conditions, can influence the involvement of children in criminal acts. This research aims to explore the impact of the social environment on juvenile delinquency and seek preventive solutions. The methodology employed is a qualitative approach, gathering data through literature study observations. The results indicate that the quality of communication within families, peer associations, school culture, and economic factors influence juvenile delinquency. To prevent such behavior, there is a need to enhance communication and support within families, as well as other interventions that improve a child's social environment.
