Abstract

According to Islamic law, marriage is considered a very strong form of bond or mitsaqon ghalidhan to obey Allah's commands, and carrying it out is an act of worship. Siri marriage can be defined as "a form of marriage that is carried out according to law or religious customs, is not announced in public and is not officially recorded in the marriage registry." marriage of 'public officials'. This article aims to examine the level of understanding of positive law regarding unregistered marriages. This research method is descriptive qualitative with documentary data collection techniques and descriptive analysis as a data analysis technique. Active legal research on unregistered marriages is carried out primarily based on the legal nature of the Republic of Indonesia and government regulations. The study of Islamic law regarding unregistered marriages is carried out based on the Al-Quran and Hadith. From the perspective of Indonesian positive law, law, unregistered marriage is a marriage that has no legal principles or in other words has no legal consequences.

Abstract

Penelitian ini mengkaji secara kritis pembekuan berita acara sumpah advokat Firdaus Oiwobo, S.H., dan Razman Arif Nasution oleh Pengadilan Tinggi Ambon dan Banten dalam kerangka dialektika hukum yang mempertemukan ketegangan antara independensi advokat, supremasi yudisial, dan batasan konsep contempt of court. Problem akademis utama yang diangkat adalah bagaimana kewenangan pengadilan dalam menegakkan disiplin persidangan dapat berbenturan dengan prinsip due process of law serta doktrin officium nobile yang menjadi basis fundamental independensi advokat. Karena itu, penelitian ini bertujuan untuk menganalisis legitimasi dan implikasi yuridis dari pembekuan sumpah advokat sebagai instrumen pengendalian profesi hukum, sekaligus mengidentifikasi potensi penyalahgunaan kewenangan yudisial dalam konstruksi hukum Indonesia. Dengan menggunakan metode normatif yuridis melalui pendekatan perundang-undangan, kasus, dan konseptual yang dianalisis secara hermeneutik-kritis. Hasil penelitian menunjukkan bahwa pembekuan sumpah advokat oleh pengadilan tinggi tidak sekadar tindakan administratif, tetapi merupakan wujud intervensi yudisial yang berimplikasi pada pelemahan independensi profesi hukum. Meskipun bertujuan menjaga marwah peradilan, tindakan tersebut melampaui batas kewenangan yang sah dan bertentangan dengan prinsip fair trial serta due process of law. Selain itu, contempt of court dalam sistem hukum Indonesia masih memiliki ambiguitas regulasi, sehingga dapat menjadi instrumen represif terhadap advokat yang bersikap kritis dalam ruang persidangan. Penelitian ini merekomendasikan revisi regulasi contempt of court agar tidak membatasi kebebasan advokat serta mendorong pedoman yang menyeimbangkan kewenangan yudisial dan independensi profesi hukum, demi mencegah distorsi supremasi hukum dan delegitimasi institusional.

Abstract

This research This study examines the suspension of the oath of advocates Firdaus Oiwobo, S.H., and Razman Arif Nasution by the Ambon and Banten High Courts, in the context of the legal dialectic between the independence of the advocate profession, judicial supremacy, and contempt of court. The main issue raised is the potential conflict between the court's authority in enforcing trial discipline with the principle of due process of law and the doctrine of officium nobile which underlies the independence of advocates. This study aims to analyze the legitimacy and legal implications of the suspension of the advocate's oath and identify the potential for abuse of judicial authority. The method used is normative legal with a statutory, case, and conceptual approach, which is analyzed hermeneutically-critically. The results of the study indicate that the suspension of the advocate's oath by the high court is more than just an administrative action, but is a judicial intervention that weakens the independence of the legal profession. This action is contrary to the principles of fair trial and due process of law. This study recommends a revision of the contempt of court regulation to protect the freedom of advocates and create a balance between judicial authority and the independence of the legal profession.
