Abstract

The activity of distributing Al-Quran to 9 villages in Karo Regency is part of efforts to increase understanding and appreciation of Islamic teachings in the region. The main aim of this activity is to provide wider access for village communities to obtain and understand the Al-Quran. The methods used in this activity include identifying villages that need distribution of the Al-Quran, contact with local community leaders, establishing Al-Quran study classes, and distributing the Al-Quran directly to village communities. Apart from that, monitoring and evaluation was also carried out on the development of the village community's understanding of the Al-Quran after receiving the Al-Quran. The results of this activity show an increase in village community interest in understanding and practicing the teachings of the Koran. Village communities also appear to be more open to discussing and asking questions about the contents of the Koran, so that interactions between village communities and their understanding of the Koran become better. Thus, it is hoped that the activity of distributing the Al-Quran to 9 villages in Karo Regency will provide great benefits to the village community in deepening their understanding of the Islamic religion, so that it can have a positive impact on their spiritual and social progress.

Abstract

Di antara ulama kontemporer yang membahas permasalahan ikhtilaf adalah ‘Abdullah bin ‘Abdurra?m?n al-Bass?m dalam kitab Taw??? al-A?k?m. Berbagai macam persoalan ikhtilaf dikemukakan oleh al-al-Bass?m dalam kitab ini. Permasalahan dalam penelitian ini adalah apa yang dimaksud dengan persoalan ikhtil?f dan apa metode yang digunakan oleh al-Bass?m dalam menyelesaikan persoalan ikhtil?f dalam kitab Taw??? al-A?k?m?. Penelitian ini bertujuan untuk meneliti apa yang dimaksud dengan persoalan ikhtil?f dan bagaimana metode al-Bass?m dalam menyelesaikan persoalan-persoalan ikhtil?f dalam kitab Taw??? al-A?k?m. Penelitian ini merupakan penelitian kualitatf deskriptif dengan melibatkan metode dokumentasi. Data-data dalam penelitian ini dianalisis dengan menggunakan metode content alysis (analisis isi). Hasil penelitian ini menunjukkan bahwa yang dimaksud dengan persoalan ikhtilaf adalah perbedaan pandangan yang terjadi di kalangan para ulama atau mujtahid dalam memahami sebuah teks al-Qur’an dan hadis. Terdapat tiga metode yang digunakan al-Bass?m dalam menyelesaikan persoalan ikhtil?f dalam kitab Taw??? al-A?k?m, yaitu ‘ar? al-aqw?l, mun?qsyah al-adillah dan al-tarj??.

Abstract

This study aims to: (1) assess the legality of nikah siri—unregistered marriages—under classical Islamic jurisprudence (fiqh) and Indonesian statutory law; (2) determine the extent to which women’s rights are protected or neglected; and (3) analyze the practice’s impact on the social order, particularly children’s legal status, family structure, and public perceptions of legal authority. The research adopts a qualitative design with a normative-empirical legal approach. Primary data were gathered through a literature review (covering the four Sunni schools of fiqh, fatwas of the Indonesian Council of Ulama, the Indonesian Marriage Law No. 1/1974 as amended by Law 16/2019, the Compilation of Islamic Law, and Supreme Court decisions) and in-depth interviews with 20 women who had experienced nikah siri in the provinces of Riau, West Java, and West Nusa Tenggara. Data were analyzed using the maqāṣid al-sharīʿah framework to evaluate public welfare (maṣlaḥah) and feminist-legal theory to map gender vulnerabilities. Source and method triangulation ensured data validity. Findings indicate that, although nikah siri is deemed valid in fiqh when all pillars and conditions of marriage are met, the lack of official registration creates legal uncertainty for wives and children in matters of inheritance, maintenance, and civil administration. Field evidence confirms significant social risks, including stigmatization, restricted access to public services, and the economic marginalization of women. The study recommends harmonizing state and Islamic law by mandating marriage registration—grounded in the protective principles of ḥifẓ al-nafs (safeguarding life) and ḥifẓ al-nasl (safeguarding lineage)—and strengthening community education to realize the objectives of Sharia and substantive justice.

Abstract

One of the conditions for the legality of marriage according to the law in Indonesia is the consent of the two prospective brides. Forced marriage is a form of deviation from this principle and can be categorized as a form of violence against children, one of which is through the practice of forced matchmaking. This study aims to analyze the understanding of parental authority in the selection of children's life partners in the community of Simpang Padang Village, Bathin Solapan District, and to examine its conformity with the provisions of Islamic law and positive law. This type of research is an empirical legal research with a qualitative approach conducted on natural conditions through in-depth interviews with parents, children, community leaders, and village officials, and supported by documentation studies of relevant laws and regulations. The results of the study show that based on Article 6 of Law Number 1 of 1974 concerning Marriage, parents do not have the authority to force their children to determine their life partner, but only play a role in providing advice and consent for the benefit of the child. However, empirically, most parents in Simpang Padang Village do not fully understand the legal basis and purpose of the authority, because they view parental consent in child marriage as more of a customary and traditional obligation than a legal mechanism to protect immature children physically and psychologically. From the perspective of Islamic law, the practice of forced marriage is contrary to the principles of willingness (ridha), justice, and protection of the welfare of children, so it is necessary to increase legal understanding and public awareness so that the implementation of marriage is in line with sharia values and the provisions of laws and regulations.
