Abstract

This research aims to explore and analyze the implementation of informed consent in the context of genomic research in Indonesia, and provide recommendations for future improvements. Through a legal analysis and case study approach, this research identifies factors that influence the effectiveness of informed consent and its impact on the protection of research subjects. The methods used in this research include literature analysis and case studies to gain a comprehensive understanding of the issue. The results show that in the development of genomic research, there has been encouraging progress but there is still a lack of adequate understanding and implementation of IC. A legal review of the implementation of informed consent in genomic research in Indonesia is an increasingly relevant topic as health biotechnology technology develops.

Abstract

Visum and repertum are two very important documents in the legal process, especially in cases of maltreatment. The medical data contained in these documents can be used as evidence that cannot be doubted in court. In addition, the visum and repertum can also assist the authorities in determining the next steps in handling the case. From the results of the research conducted, it can be concluded that the visum and repertum have a very important role in the investigation and law enforcement process. This document can be key in prosecuting perpetrators of abuse and providing justice for victims. Therefore, it is very important for the authorities to always examine the information contained in the visum and repertum carefully and thoroughly so that the legal decisions taken can be more fair and in favor of the victims of persecution.

Abstract

This research aims to analyze the implementation of legal protection for patients in the processing of drugs based on doctor's prescriptions by pharmacies, focusing on the case study of Decision Number 2258/PID.SUS/2020/PN MDN. Through a qualitative approach, this research explores the legal aspects that protect patients as well as the challenges faced in the practice of implementing drug prescriptions. The results show that despite clear regulations, there are still loopholes in their implementation that can harm patients. Greater efforts are needed to improve supervision of the drug processing process, including through regular inspections and training related to health law. This research shows that legal protection for patients in the context of drug processing by pharmacies is still a complex issue that requires greater attention from various relevant parties.

Abstract

ZnO finds widespread applications such as in photocatalysis, sensors, medicine, and other optoelectronic devices. The characteristics of ZnO can be influenced by several parameters, one of which is morphology. Fiber structures are attractive for research among various shapes and sizes due to their large effective surface area. ZnO fibers can be produced using electrospinning. However, the fiber morphology strongly depends on several important parameters, one of them is the characteristics of the polymer as a matrix. The molecular weight and concentration of the polymer and precursor material influence the solution viscosity, which is one of the crucial parameters in the electrospinning method. In this study, ZnO fibers were fabricated using three different polymers as matrices: PVP (polyvinyl pyrrolidone), PVAc (polyvinyl acetate), and PVA (polyvinyl alcohol). This research investigates the influence of polymer type on the morphology of ZnO fibers and crystallization behavior based on thermal characteristics. Based on SEM results, ZnO fibers were successfully fabricated with diameters ranging from 20–90 nm. The different characteristics are related to the type of polymer matrices and heating treatment. Only the PVA polymer could produce fibers before and after calcination, whereas the PVAc polymer-based fiber vanished after calcination. The disappearance of the fiber morphology is probably caused by the relatively high precursor (ZnAc) concentration, which leads to damage to the fibers formed during the calcination process. PVP failed to produce fibers, possibly due to its low polymer molecular weight, necessitating adjustment of other parameters. The removal of organic compounds through calcination continued until a temperature of 450ºC was reached. However, organic compounds were still identified in the samples based on FTIR characteristics. The ZnO/PVA fibers have hydrophobic surfaces, with the contact angle of water droplets being 117.75º. This characteristic is ideal for several applications such as antibacterial compounds or self-cleaning materials. Considering the inherent properties of ZnO, it can function as both an antibacterial and a photocatalytic agents simultaneously.

Abstract

Delegation of authority in health services in Indonesia is regulated in Article 290 of Law Number 17 Year 2023 on Health, which allows medical personnel (such as doctors) to delegate some of their authority to other health personnel (such as nurses), provided that the recipient has sufficient competence. The purpose of this delegation is to improve the efficiency and effectiveness of services, especially in emergency situations. However, its implementation must be accompanied by accountability, where the doctor as the person in charge of the service (Article 66) can be held legally responsible if malpractice occurs due to supervision or instructions that are not in accordance with standards. This research uses a normative analysis method of the Health Law and its implications in practice. The results show that mediation is the first step in dispute resolution, while compliance with SOPs and good medical documentation are key to preventing legal conflicts. Recommendations include improving the competence of health workers, socialising regulations, strengthening SOPs, and inter-professional collaboration to minimise the risk of malpractice.

Abstract

Human trafficking for the purpose of organ trafficking has become a serious global problem that violates human rights and threatens global health. International law has an important role in efforts to combat this phenomenon by providing a legal framework that regulates and prohibits the practice of human trafficking and organ trafficking. In this paper, we explore the role of international law in addressing human trafficking for the purpose of organ trafficking and its implications for global health. We analyze various relevant international legal instruments, evaluate their implementation, and identify factors influencing the effectiveness of international law in combating human trafficking for the purpose of organ trafficking. We also provide suggestions to improve implementation of international law and protect global health from this harmful practice

Abstract

The resolution of simultaneous regional elections through a political-legal process in parliament is the subject of complex and crucial debate in the context of local democracy in Indonesia. This article describes the dynamics of legal politics and a portrait of the debate between political parties in parliament regarding regulations for simultaneous regional elections. Through in-depth analysis, this article explains the factors that influence the position and strategy of political parties in influencing regulations, as well as their impact on the results of debates in parliament. Conclusions and suggestions are offered to increase the effectiveness of the simultaneous regional election resolution process and strengthen local democracy in Indonesia

Abstract

This study examines the alleged violation of Article 17 of Law Number 5 of 1999 related to the transportation management services for the delivery (export) of clear lobster seeds, based on the Decision of the Business Competition Supervisory Commission (KPPU) Number 04/KPPU-I/2021 dated June 9, 2022. In this case, there are strong indications that several business actors have carried out unhealthy market control practices, which have a negative impact on business competition in the transportation management sector for clear lobster seeds in Indonesia. This study analyzes the impact of the alleged violations on business actors, service quality, innovation, and the development of the national fisheries sector. The conclusions drawn emphasize the importance of law enforcement and regulatory reform to maintain healthy competition in this sector. Recommendations provided include stricter law enforcement, regulatory reform, increased innovation, and protection for small business actors and fishermen affected
