Abstract

Sengketa sertifikat ganda masih menjadi persoalan dalam hukum agraria karena sertifikat yang seharusnya memberikan kepastian hukum justru dapat menimbulkan ketidakpastian bagi pemilik tanah. Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap pemilik tanah dalam sengketa sertifikat ganda, khususnya berkaitan dengan kedudukan sertifikat sebagai alat bukti dan tanggung jawab administrasi pertanahan. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum dianalisis secara kualitatif melalui studi kepustakaan terhadap UUPA, PP Nomor 24 Tahun 1997 tentang Pendaftaran Tanah, Permen ATR/Kepala BPN Nomor 21 Tahun 2020, serta literatur hukum agraria. Hasil penelitian menunjukan bahwa sertifikat tanah memiliki kedudukan sebagai alat pembuktian yang kuat, tetapi tidak bersifat mutlak apabila terdapat cacat administrasi, kesalahan data fisik atau yuridis, serta klaim hak dari pihak lain. Sengketa sertifikat ganda juga memperlihatkan lemahnya verifikasi data, pemetaan bidang tanah, dan kehati-hatian pejabat pertanahan. Perlindungan hukum terhadap pemilik tanah perlu diberikan secara preventif melalui perbaikan administrasi pertanahan dan secara represif melalui penyelesaian sengketa di BPN, peradilan, maupun mediasi. Penelitian ini menyimpulkan bahwa perlindungan pemilik tanah tidak cukup hanya melalui sertifikat, tetapi harus didukung oleh validasi data, tanggung jawab lembaga pertanahan, dan pemulihan hak bagi pihak yang dirugikan

Abstract

Regulasi pertambangan nikel di Indonesia belum mengakomodasi prinsip keadilan ekologis secara substansial. Penelitian ini mengkaji kerangka regulasi pertambangan nikel melalui perspektif filsafat hukum dengan menggunakan konsep keadilan ekologis sebagai alat evaluasi. Metode yang digunakan adalah yuridis-normatif melalui pendekatan perundang-undangan, konseptual, dan komparatif. Bahan hukum terdiri atas peraturan perundang-undangan, putusan Mahkamah Konstitusi, instrumen hukum internasional, dan doktrin filsafat hukum lingkungan. Penelitian menemukan tiga hal: pertama, UU Minerba 2020 mengandung antinomi dengan rezim perlindungan lingkungan yang belum diselesaikan melalui aturan konflik yang jelas; kedua, paradigma antroposentris dalam regulasi pertambangan bertentangan dengan prinsip keadilan ekologis yang diakui hukum internasional; ketiga, mekanisme perizinan yang ada tidak memenuhi standar Free, Prior, and Informed Consent (FPIC) sebagaimana diatur dalam UNDRIP 2007 dan Putusan MK Nomor 35/PUU-X/2012. Penelitian ini merumuskan model rekonstruksi normatif tiga lapis paradigmatik, substantif, dan kelembagaan sebagai jalan keluar dari pendekatan legalistik-formal yang selama ini dominan.

Abstract

Hutan lindung menjadi kawasan yang dilindungi oleh pemerintah seperti dalam Undang-Undang Nomor 41 Tahun 1999 tentang Kehutanan, Problematika yang terjadi saat ini, terjadi alih fungsi lahan oleh masyarakat. Hutan lindung yang sebelumnya pepohonan kemudian diubah menjadi pertanian, seperti kentang. Di Kecamatan Cilongok, Kabupaten Banyumas seluas 5.000 hektare hutan lindung telah beralih fungsi menjadi lahan pertanian. Dampak yang terjadi adalah terjadinya banjir saat hujan deras di daerah bawahnya. Tujuan tulisan ini untuk mengetahui kewajiban Perhutani, pemerintah daerah, termasuk masyarakat atas kejadian tersebut. Metode yang digunakan dengan pendekatan normatif. Temuan dari tulisan ini terjadi pembiaran akan kerusakan hutan lindung dan belum ada ketegasan pemerintah serta kesadaran masyarakat.

Abstract

Artikel ini membahas problematika Bank Tanah dalam reforma agraria, khususnya dalam hubungan antara penyediaan tanah untuk kepentingan umum dan risiko konsentrasi penguasaan lahan. Kehadiran Bank Tanah melalui Peraturan Pemerintah Nomor 64 Tahun 2021 pada dasarnya dimaksudkan untuk menjamin ketersediaan tanah bagi pembangunan, kepentingan sosial, pemerataan ekonomi, konsolidasi lahan, dan reforma agraria. Akan tetapi, kewenangan Bank Tanah dalam memperoleh, mengelola, memanfaatkan, dan mendistribusikan tanah melalui skema Hak Pengelolaan menimbulkan persoalan hukum agraria. Tanah yang dihimpun negara dapat diberikan hak turunan kepada pihak lain, seperti HGU, HGB, atau Hak Pakai, sehingga membuka ruang bagi penguasaan lahan oleh aktor tertentu. Penelitian ini menggunakan metode hukum normatif dengan pendekatan perundang-undangan, konseptual, dan analitis. Hasil kajian menunjukkan bahwa Bank Tanah memiliki kedudukan sebagai instrumen pelaksanaan hak menguasai negara, sepanjang pengelolaannya diarahkan untuk kemakmuran rakyat dan keadilan agraria. Meski demikian, Bank Tanah berisiko bergeser menjadi mekanisme legal konsentrasi penguasaan lahan apabila orientasi pemanfaatannya lebih dominan pada investasi dan proyek ekonomi dibanding redistribusi tanah kepada masyarakat. Karena itu, pengelolaan Bank Tanah harus dikendalikan melalui prinsip fungsi sosial tanah, transparansi, partisipasi masyarakat, serta keberpihakan kepada subjek reforma agraria.

Abstract

Forest governance remains a significant legal and environmental challenge in Indonesia due to the widespread occurrence of illegal logging, unauthorized oil palm plantations, and unlicensed mining activities within forest areas. These practices have caused environmental degradation, reduced state revenues, and generated conflicts involving indigenous peoples and local communities. In response, the Indonesian government enacted Presidential Regulation Number 5 of 2025 concerning Forest Area Enforcement as a legal instrument to restore state control over forest areas and strengthen forest governance. However, concerns remain regarding the extent to which the regulation reflects environmental justice principles. This research aims to analyze the legal policy underlying state re-control of forest areas through Presidential Regulation Number 5 of 2025 and to evaluate its conformity with the principles of environmental justice. The study employs normative legal research using statutory and conceptual approaches. The study concludes that while Presidential Regulation Number 5 of 2025 strengthens state authority over forest governance and contributes to legal certainty, its implementation requires further legal reform to ensure the fulfillment of distributive, procedural, and social justice principles. Integrating environmental justice into forest area enforcement is essential for achieving sustainable and equitable forest governance in Indonesia.

Abstract

The capital market serves as a strategic instrument in national economic development, acting as a vehicle for fund mobilization and investment. However, the complexity of transactions within the capital market sector also creates opportunities for financial crimes that result in state financial losses and diminished investor confidence. One of the most significant cases involves corruption at PT. Asuransi Jiwasraya (Persero), characterized by the misuse of investments through capital market instruments. This study aims to analyze the authority and role of the Indonesian Attorney General's Office (Kejaksaan RI) in capital market law enforcement and to examine its implementation in handling the PT. Asuransi Jiwasraya case. The study employs a normative legal research method, utilizing statutory, conceptual, and case-based approaches. Legal materials were gathered through a literature review comprising primary, secondary, and tertiary sources and analyzed qualitatively using a descriptive-prescriptive method and deductive reasoning. The findings indicate that the Indonesian Attorney General's Office possesses strategic authority as  “dominus litis” within the criminal justice system to investigate and prosecute corruption crimes related to the capital market sector, provided the element of state financial loss is established. In the PT. Asuransi Jiwasraya case, the Office successfully proved the abuse of authority, investment manipulation, and state financial losses amounting to IDR 16.81 trillion; it also applied corporate criminal liability and utilized "follow the money" and "follow the asset" approaches in its efforts to recover state assets. The study concludes that the role of the Indonesian Attorney General's Office is not only vital for repressive law enforcement but also contributes to strengthening capital market governance, enhancing legal certainty and investor protection, and fostering the integrity of the national financial system.

Abstract

Abstract: As a state governed by the rule of law, Indonesia establishes law as the primary foundation for achieving legal certainty (*rechtszekerheid*) within the criminal justice system. However, the post-reform era has witnessed a fragmentation of prosecutorial authority resulting from the enactment of various special laws (*lex specialis*) outside the codified Criminal Procedure Code (KUHAP). Prosecutorial authority is now distributed among autonomous institutions such as the Attorney General's Office, the Corruption Eradication Commission (KPK), and the Military Prosecution Service (*Oditurat Militer*). This institutional fragmentation severs the single chain of command, fosters sectoral ego, and creates jurisdictional overlaps, particularly in cases involving joint military-civilian jurisdiction (*koneksitas*). This study aims to analyze the urgency of implementing a "Single Prosecution System" within Indonesia's criminal justice system as a means to address institutional fragmentation and achieve genuine legal certainty. The study employs a normative legal research method (*doctrinal legal research*) utilizing statutory, conceptual, and limited comparative approaches. Data collection relies on library research—encompassing primary and secondary legal sources—followed by qualitative analysis using deductive legal reasoning (syllogism). The findings indicate that the dualistic and trialistic nature of prosecution undermines the principles of substantive and procedural legal certainty and violates the principle of equality before the law. The absence of uniform national prosecution guidelines leads to sharp disparities in sentencing demands and eliminates the predictability of verdicts. Furthermore, the lack of unification creates chronic procedural obstacles, such as the "ping-pong" effect of case files being repeatedly returned between agencies, thereby prolonging the detention of defendants. Consequently, there is an urgent need to revitalize the pure "Single Prosecution System" principle and strengthen the *dominus litis* doctrine. All prosecutorial functions within specialized institutions must be integrated under a unified authority, coordinated and supervised by the Attorney General as the state's highest public prosecutor. The establishment of the Junior Attorney General for Military Criminal Affairs (Jampidmil) should serve as a blueprint—with its scope expanded through revisions to the Criminal Procedure Code (KUHAP) and the Prosecution Service Law—to cut red tape, restore public trust, and ensure equal justice. Keywords: Single Prosecution System; Dominus Litis; Legal Certainty; Integrated Criminal Justice System; Prosecution Service   Abstrak: Indonesia sebagai negara hukum meletakkan hukum sebagai landasan utama guna mewujudkan kepastian hukum (rechtszekerheid) dalam sistem peradilan pidana. Namun, pasca-reformasi terjadi fragmentasi otoritas penuntutan akibat lahirnya berbagai undang-undang khusus (lex specialis) di luar kodifikasi KUHAP. Kewenangan penuntutan kini terbagi secara atributif kepada lembaga-lembaga otonom seperti Kejaksaan Agung, Komisi Pemberantasan Korupsi (KPK), dan Oditurat Militer. Fragmentasi kelembagaan ini memutus rantai komando penuntutan tunggal (single command), memicu ego sektoral, dan menimbulkan tumpang tindih yurisdiksi, terutama dalam perkara koneksitas. Penelitian ini bertujuan untuk menganalisis urgensi penerapan asas Single Prosecution System (sistem penuntutan tunggal) dalam sistem peradilan pidana Indonesia sebagai upaya mengatasi fragmentasi kelembagaan dan mewujudkan kepastian hukum yang hakiki. Penelitian ini menggunakan metode penelitian hukum normatif (doctrinal legal research) dengan pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), dan pendekatan perbandingan (comparative approach) secara terbatas. Sumber data bertumpu pada studi kepustakaan (library research) yang meliputi bahan hukum primer dan sekunder, yang kemudian dianalisis secara kualitatif dengan penalaran hukum berbasis logika deduktif (silogisme). Hasil penelitian menunjukkan bahwa dualisme dan trialisme penuntutan berimplikasi pada degradasi asas kepastian hukum substantif maupun prosedural, serta mencederai asas kesamaan di hadapan hukum (equality before the law). Ketiadaan standar pedoman penuntutan nasional yang seragam memicu disparitas tuntutan yang tajam dan menghilangkan aspek prediktabilitas putusan. Selain itu, ketiadaan unifikasi menimbulkan hambatan prosedural kronis, seperti fenomena bolak-balik berkas perkara yang memperpanjang masa penahanan terdakwa. Oleh karena itu, reaktualisasi asas single prosecution system yang murni dan penguatan doktrin dominus litis mendesak untuk diimplementasikan. Seluruh fungsi penuntutan pada lembaga khusus harus diintegrasikan di bawah satu pintu, koordinasi, dan supervisi Jaksa Agung selaku penuntut umum tertinggi negara. Pembentukan Jaksa Agung Muda Bidang Pidana Militer (Jampidmil) harus dijadikan cetak biru (blueprint) yang diperluas jangkauannya melalui pembaruan RUU KUHAP dan UU Kejaksaan demi memotong birokrasi, memulihkan kepercayaan publik (public trust), serta menjamin keadilan yang setara. Abstract

This study aims to analyze the implementation of the Community-Based Comprehensive Systematic Land Registration (PTSL+PM) policy and to evaluate the level of community participation in rural Indonesia.This study employs a mixed-methods approach with a socio-legal perspective integrating qualitative and quantitative analyses. Data were collected through field observations, in-depth interviews, Focus Group Discussions (FGDs), and questionnaires administered to 97 respondents in Samudra Kulon Village.Analysis was conducted using a theoretical framework of community participation and legal implementation to assess participation levels and policy effectiveness.The findings indicate that the implementation of the PTSL+PM program has proceeded in accordance with established procedures during the planning stage but has not been optimal during the physical and legal data collection stages due to technical and social constraints.The level of community participation falls into the high category, with an index of 2.81, reflecting a collaborative pattern between the government and the community.Nevertheless, this participation remains largely procedural and is not yet fully substantive, indicating the presence of a participation gap. This study concludes that the success of land registration policy implementation is determined not only by the regulatory framework but also by the quality of community participation and the associated social dynamics. Therefore, strengthening participatory mechanisms, enhancing the capacity of local institutions, and improving policy communication are necessary to increase the effectiveness of the PTSL program.

Abstract

The paradigm of natural resource utilization in Indonesia refers to the principle of retributive justice that provides equal opportunities for communities to manage and utilize natural resources. However, corporations often engage in acts of environmental exploitation that lead to pollution and environmental damage. This study aims to analyze the postponement of prosecution against corporations committing environmental crimes from the perspective of legal philosophy and justice. The study was conducted using normative research and a legislative and conceptual approach. Secondary data will be collected through a literature study method and will be analyzed qualitatively descriptively. The results show that the postponement of prosecution agreement is a concrete implementation of the paradigm shift of justice from retributive to restorative because law enforcement efforts are carried out as much as possible outside the courts. However, this paradigm shift creates problems because the absence of criminal sanctions against corporations will risk the repetition of criminal acts in the future. Therefore, a balance is needed in the process of corporate law enforcement so that environmental restoration efforts can still provide an optimal deterrent effect.
