Abstract

Pada kasus kopi sianida dengan terdakwa Jessica Kumala Wongso dalam hal ini Jessica adalah pihak yang mengundang teman lamanya yaitu Mirna dan Hani untuk bertemu di kafe olivier yang berada di salah satu tempat perbelanjaan di Jakarta. Sebagai seorang tamu Mirna dan Hani menghadiri undangan dari Jessica di kafe olivier. Selaku tuan rumah mengundang orang lain sebagai tamunya dengan maksud untuk mencelakai tamu tersebut merupakan perbuatan yang salah dan jelas menyalahi etika kesopanan dalam pergaulan. Hal ini berarti Jessica sudah menyalahi norma atau nilai-nilai yang berlaku dimasyarakat yaitu tidak memuliakan tamunya. Perbuatannya tersebut Jessica dijatuhi hukum penjara selama 20 tahun. Berdasarkan dengan status bukti yang masih abu-abu ditambah lagi dengan muncul film dokumenter yang berjudul “Ice Cold” mulai menimbulkan suatu pandangan baru bahwa Jessica Kumalawongso bukan sebagai pembunuhnya hal itu didasarkan kepada tidak adanya autopsi jenazah secara keseluruhan dan menurut salah satu dokter ahli forensik di Indonesia tidak ditemukannya zat sianida didalam tubuh Mirna Salihin diatas 1%. Oleh karena itu dengan hadirnya sistem hukum peradilan Indonesia yang masif ternilai kurang lugas maka dari itu kami menawarkan sebuah inovasi berupa Internet of Things (IoT) Law, sistem ini berupa website yang bertujuan untuk menscreening suatu permasalahan dengan cepat dan disertai dengan hukumannya.

Abstract

Employment relations in Indonesia are regulated in the 1945 Constitution and the Manpower Law, which guarantee workers' rights to employment and fair treatment. However, in practice, there has been a shift in terminology and work patterns, especially with the implementation of partnership patterns by companies to avoid employment obligations. This study highlights the implementation of partnership patterns at PT ABC which changes the status of warehouse workers to partners, thereby eliminating normative rights such as minimum wages, social security, and other benefits. Changes in terminology such as "wages" to "service fees" and "working hours" to "service hours" blur the boundaries between employment and partnership relationships. This leads to labor exploitation. This study analyzes the principles of employment agreements in partnership patterns and their impact on the protection of warehouse workers at PT ABC. The results of the study indicate that partnership patterns can be a legal loophole for companies to avoid employment obligations, so stricter regulations are needed to protect workers' rights.

Abstract

The escalation of the Israeli-Palestinian conflict on October 7, 2023, led to a large-scale attack by Hamas, triggering a refugee crisis in Gaza and subsequent rejections by neighboring countries, including Jordan. This rejection, although in conflict with the principle of non-refoulement as a norm of international law, is viewed as a measure to protect state sovereignty. This research employs a normative juridical method, emphasizing legislative, case-based, historical, and conceptual approaches to analyze the interaction between state sovereignty and refugee protection. The main discussion includes the threats to sovereignty posed by refugees, the perspective of the non-refoulement principle as a jus cogens norm, and the implications of the resulting normative conflict. The conclusion indicates that while state sovereignty is crucial, humanitarian considerations and the rights of refugees must also be taken into account to achieve a fair and harmonious solution.

Abstract

This study explores establishing a legal entity as a representative body for participants in Islamic insurance, in light of current Indonesian regulations and the fatwas and guidelines issued by the National Sharia Board of the Indonesian Council of Ulama (DSN-MUI). Using a normative juridical method with statutory, comparative, and conceptual approaches, this research draws on primary legal materials—including statutory laws and DSN-MUI fatwas—and secondary sources such as scholarly literature and credible legal documents. The proposed legal entity aims to represent the collective ownership of Islamic insurance participants. It suggests forming an internal body comprised of participant representatives from various regions, modeled after the Badan Perwakilan Anggota (Member Representative Body) in mutual insurance. This initiative is intended to enhance participant rights and address conflicts of interest arising from Islamic insurance companies' dual role as both fund managers and supervisors. Despite its potential, forming such an internal legal body faces practical and legal obstacles, including financing issues, representative selection criteria, operational efficiency, and the absence of specific regulatory support. Furthermore, the existing authority of the Sharia Supervisory Board (DPS) is limited to Sharia compliance oversight. As a viable alternative, appointing an Independent Commissioner to represent participants is recommended. This solution is grounded in existing laws, such as the Company Law, Insurance Law, UUP2SK, and relevant OJK regulations. It can be enhanced by establishing a Dana Tabarru’ Funds committee under Article 121(1) of the Company Law to ensure stronger accountability and protection of participants’ interests.

Abstract

In order to improve the investment ecosystem and business activities to create jobs, the Government has enacted Law Number 11 of 2020 concerning Job Creation, regulating the simplification of business licensing through the implementation of Risk-Based Business Licensing using standard methods based on risk levels as stated in Government Regulation Number 5 of 2021 concerning the Implementation of Risk-Based Business Licensing, the licensing transformation aims to provide legal certainty for foreign investors in investing in Indonesia. This study will examine the implementation of risk-based business licensing based on Government Regulation Number 5 of 2021 using Normative Legal Research or library research, with a statute approach, conceptual approach and historical approach to examine existing legal problems. The results of this study show that the change in business licensing to risk-based business licensing that integrates the authority and licensing issuance process in the OSS system still has problems starting from the implementation of authority and the issuance process of basic requirements, business licensing, supporting business licensing and risk classification based on sector. With these problems still existing, it can create legal certainty for investors to invest in Indonesia so that it is necessary to amend Government Regulation Number 5 of 2021 concerning the Implementation of Risk-Based Business Licensing.
