Abstract

Implementation of Reform Policy: Bureaucracy in Strengthening Resource Shuman Resources in Ternate City. Objective: This study aims to determine the process, identify and analyze aspects that are obstacles in the Implementation of Bureaucratic Reform Policy in Strengthening Human Resources in the Ternate City Inspectorate based on the determining factors for success in the implementation of decentralized policies by G. Shabbir Cheema and Dennis A. Rondinelli. Method: This study was conducted using a qualitative descriptive method to help interpret the phenomena that occur. The theory used is the policy implementation theory according to G. Shabbir Cheema and Dennis A. Rondinelli which consists of environmental conditions, inter-organizational relationships, and characteristics and capabilities of implementing agencies. Results: The results of the study generally indicate that the Implementation of Bureaucratic Reform Policy in Strengthening Human Resources in the Ternate City Inspectorate is running well, but if you look at the impact and performance resulting from bureaucratic reform, it is still slow and not optimal. This is because the overall support for the determining factors for success in policy implementation has not been met, both from environmental conditions, inter-organizational relationships, organizational resources, and characteristics and capabilities of implementing agencies. Conclusion: The suggestion from the research is the need for improvement in work culture commitment, communication, and creating a sense of ongoing involvement, as well as fulfilling the still lacking resources to support effectiveness and smoothness.

Abstract

The government needs to ensure that the management of HGB in the IKN is carried out by paying attention to the rights of local communities and indigenous peoples. The application of the principle of social justice as taught by John Rawls by paying special attention to more vulnerable groups. In every policy related to the procurement of building use rights to accelerate the development of the IKN, the principle of social justice must be maintained. This means that policies must provide protection for vulnerable groups and ensure that this development benefits all levels of society. This study aims to provide an understanding of the Ratio legis regulation of Building Use Rights for investors in Law Number 5 of 1960 and in Law Number 6 of 2023 and to find out, understand and explain the perspective of John Rawls' Theory of Justice in the regulation of building use rights in order to accelerate the development of the IKN. This research is normative in nature using a statutory regulatory approach, an approach and a conceptual approach. Research data were collected by means of document/literature studies.

Abstract

This research explores the sustainable legal control and protection of Angus Stone (Batu Angus) utilization in Ternate City. Angus Stone is a unique geological formation with significant historical, cultural, and scientific value, recognized as part of the Geopark Protected Area and categorized as a national strategic asset. The study aims to analyze the legal mechanisms governing its management, covering planning, implementation, supervision, and monitoring, within the framework of sustainable development. Employing an empirical legal research method, this study focuses on Ternate City through purposive sampling interviews, field observations, documentation, and review of relevant legislation, supported by secondary data from scholarly sources. The findings indicate that current management is regulated by national legal provisions but lacks systematic implementation aligned with sustainable principles. Drawing from Gustav Radbruch’s theory of legal objectives, the research emphasizes the necessity for regulatory structures that are just, orderly, and transparent. These structures must prevent exploitative practices while respecting local wisdom and maximizing community benefits. The study recommends that a successful legal protection framework must incorporate sustainable planning, enforce management practices that align with sustainability standards, and ensure ongoing and effective supervision. Such a framework would not only preserve Angus Stone as a natural heritage but also contribute to the economic, social, and cultural development of Ternate City .

Abstract

The Constitutional Court's Honorary Council's decision was deemed wrong in imposing sanctions on the Chief Justice of the Constitutional Court, Anwar Usman. This study aims to determine how the implementation of the Constitutional Court Regulation of the Republic of Indonesia Number 1 of 2023 concerning the Honorary Council of the Constitutional Court is carried out against the Decision of the Honorary Council of the Constitutional Court Number 2/MKMK/L/11/2023 and to find out and understand what is the basis for consideration for the judges of the Honorary Council of the Constitutional Court in the decision Number 2/MKMK/L/11/2023. The type of research used in this study is normative legal research, using a research approach by examining and reviewing the object of research through laws and regulations by sharpening research data that aims to find out the problems being discussed, while the type of research is qualitative using descriptive analysis. The results of the study indicate that the Honorary Council of the Constitutional Court did not apply the Constitutional Court Regulation Number 1 of 2023 concerning the Honorary Council of the Constitutional Court as it should so that in the decision of the MKMK Number 2/MKMK/L/11/2023 it cannot provide legal certainty. Therefore, the provisions governing the types of sanctions for reported judges who are proven to have committed ethical violations are not explained properly. However, the decision is final and binding internally on the Constitutional Court.

Abstract

Penelitian ini bertujuan menganalis Kepastian Hukum Terhadap Proses Pencatatan Kelahiran Anak dari Seorang Ibu di Direktorat Jenderal Kependudukan dan Pencatatan Sipil (Dukcapil), serta mengkaji implikasi hukum terkait PencatatanKelahiran Anak Tanpa Ayah Biologis dalam Kartu Keluarga di Direktorat Jenderal Kependudukan dan Pencatatan Sipil (Dukcapil). Metode penelitian yang digunakan dalam penelitian ini yakni jenis penelitian hukum normatif, karena dalam analisisnya menggunakan bahan bahan kepustakaan sebagai sumber data penelitian. Penelitian normatif disini tentang perbandingan hukum Islam dan hukum positif tentang status kewarisan anak hasil sewa rahim. Penelitian ini tergolong penelitain pustaka atau literatur. Hasil penelitian ini menunjukan bahwa Dalam rangka mewujudkan kepastian hukum, maka semua akta-akta didaftar dan dikeluarkan oleh Catatan Sipil mempunyai kekuatan pasti dan tidak dibantah oleh pihak ketiga. Karena akta-akta yang dibuat oleh Lembaga Catatan Sipil adalah mengikat terhadap mereka yang berkepentingan, dapat diketahui pula suatu negara yang merupakan negara hukum, maka akan menghendaki pula adanya masyarakat yang teratur, tertib, aman, dan tenteram. Bahwa pencatatan secara administratif yang dilakukan oleh negara dimaksudkan agar perkawinan, sebagai perbuatan hukum penting dalam kehidupan yang dilakukan oleh yang bersangkutan, yang berimplikasi terjadinya akibat hukum yang sangat luas, di kemudian hari dapat dibuktikan dengan bukti yang sempurna dengan suatu akta otentik, sehingga perlindungan dan pelayanan oleh negara terkait dengan hak-hak yang timbul dari suatu perkawinan yang bersangkutan dapat terselenggara secara efektif dan efisien.

Abstract

Gurabunga Village, located in Tidore District, Tidore Islands City, has a long history as part of the Tidore Sultanate and is an area with customary law communities that still preserve their traditions. This study aims to examine the process of changing the status of Gurabunga Village to a Customary Village, as well as its implications for the recognition and legal protection for the Gurabunga customary law community. The method used is empirical legal research with a sociolegal approach, collecting data through interviews, observations, and studies of related legal documents. The results of the study show that the Gurabunga community has appropriate characteristics to be recognized as a customary law community based on Permendagri No. 52 of 2014, with customary wealth in the form of customary land that is managed communally and protected by local customary law. The process of changing this status involves community initiatives through village deliberations, fulfillment of administrative requirements, and local government approval. Meanwhile, the biggest challenge in the implementation of legal protection of customary rights is the lack of understanding from local governments regarding the importance of recognizing the rights of customary law communities. Therefore, this study suggests the importance of strengthening regulations and empowering customary law communities through more inclusive policies. The recommendation of this study is to accelerate the recognition of indigenous peoples in Indonesia, by providing space for communities to fight for their indigenous rights within a national legal framework that is responsive and adaptive to local social and cultural needs

Abstract

This study aims to analyze the legal protection of community rights to land due to land conversion for National Strategic Projects (PSN) and mining in East Halmahera Regency, North Maluku, from the perspective of agrarian reform. The method used is empirical law (non-doctrinal legal research) qualitative-descriptive approach. Data through interviews with communities, traditional leaders, local governments, and literature studies on primary, secondary, and tertiary legal materials. Research shows that land conversion for PSN and mining causes agrarian conflicts, inequality in land distribution, and threats to local food security. Although spatial planning policies include the principles of justice and ecological sustainability, their implementation has not optimally protected people's rights. Agrarian reform as an instrument of land redistribution and legal protection has not been fully implemented, as can be seen from the low level of land certification and the lack of community participation in decision-making. This research underlines the need for preventive and repressive legal protection, policy synchronization, and increasing the role of the state in ensuring agrarian justice

Abstract

Penelitian ini bertujuan mengetahui pelaksanaan kewenangan pemerintah daerah dalam pengembangan pariwisata maritim memenuhi prinsip perlindungan hak masyarakat pesisir dan mengidentifikasi serta memahami arah kebijakan hukum yang responsif terhadap hak masyarakat pesisir dalam pengembangan pariwisata maritim yang berkelanjutan di Kabupaten Halmahera Selatan. Penelitian ini yang menggunakan pendekatan hukum sosio-legal, pendekatan perundang-undangan (statute approach) dan pendekatan konseptual. Penelitian menunjukkan peran dan tanggung jawab negara dalam sistem negara hukum kesejahteraan sangat luas. Negara tidak hanya berfungsi sebagai pelindung hak-hak individu, tetapi juga sebagai agen aktif menciptakan masyarakat yang adil, sejahtera, dan merata. Tiga aspek negara hukum untuk kesejahteraan melalui tiga aspek penting yaitu aspek politik, hukum, dan sosial ekonomi serta perlindungan hukum terhadap masyarakat pesisir dalam kerangka negara hukum kesejahteraan diatur berbagai peraturan perundang-undangan di Indonesia. Sebagaimana UUD NRI 1945 jelas memberi jaminan hak-hak dasar yang relevan bagi masyarakat pesisir.

Abstract

This study examines the legal certainty of regulating defects of will in real estate sales agreements, focusing on fraud as stipulated under Article 1328 of the Indonesian Civil Code. The research is motivated by inconsistencies in judicial practice when resolving real estate disputes arising from pre-contractual fraud, particularly the overlap between breach of contract and tort. The purpose of this study is to analyze the juridical position of defects of will in contractual relationships and to assess the appropriateness of judicial reasoning in adjudicating such disputes. This study uses normative legal research with statutory, conceptual, and case approaches, drawing on the Indonesian Civil Code and Decision Number 54/PDT.G/2024/PN.TTE. The findings show that pre-contractual fraud occurred through unfulfilled promises of building quality not included in the contract, resulting in a defective and uninhabitable house and limiting the buyer’s ability to claim compensation. Juridically, this study concludes that defects of will caused by fraud constitute a breach of contract and should form the legal basis for contract annulment rather than tort liability, given the contractual nature of the relationship. The court’s reliance solely on tort is therefore a misapplication of law that undermines legal certainty. This study contributes to Indonesian contract law by clarifying the relationship between defects of will and breach of contract and offering practical guidance for resolving real estate disputes consistently.
