Abstract

Mahkamah Konstitusi dalam Putusan Nomor 65/PUU-XXI/2023 telah mengatur tentang pelaksanaan kampanye di lembaga pendidikan. Penelitian ini bertujuan untuk menganalisis Ratio Decidendi  Putusan Mahkamah Konstitusi Nomor 65/PUU-XXI/2023. Metode penelitian yang digunakan adalah penelitian normatif dengan tipe penelitian kualititaf serta menggunakan pendekatan perundang-undangan dan pendekatan kasus. Mahkamah Konstitusi dalam putusannya menilai bahwa larangan mutlak lembaga pendidikan menjadi tempat kampanye bertentangan dengan Pasal 28E ayat (3) Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 tentang kebebasan berserikat, berkumpul, dan mengeluarkan pendapat. Hasil analisis menyebutkan putusan tersebut merupakan sebuah terobosan penting dalam upaya menegakkan hak konstitusional warga negara untuk mengemukakan pendapat di muka umum, namun ketiadaan norma-norma yang lebih rinci dan operasional dalam putusan Mahkamah Konstitusi ini dapat menimbulkan berbagai interpretasi dan penafsiran yang berbeda di kalangan masyarakat luas yang mana putusan ini tidak memberikan batasan dan kriteria yang jelas tentang bentuk-bentuk kegiatan kampanye yang diperbolehkan atau dilarang di lingkungan lembaga pendidikan. Untuk mengimplementasikan Putusan ini secara efektif diharapkan KPU dan Bawaslu perlu merumuskan mekanisme pengawasan dan penegakan hukum yang kuat serta tindakan korektif cepat terhadap pelanggaran untuk memastikan pelaksanaan kampanye yang adil dan tertib.

Abstract

Abstract

Background: Keraya Village is a coastal area with significant ecotourism potential and mangrove forest resources, yet public awareness—especially among students—of environmental conservation remains low. Objective: This community service program aimed to establish conservation cadres at Madrasah Tsanawiyah (MTs) Miftahul Huda by enhancing students’ knowledge, awareness, and practical skills in environmental preservation. Method: The program employed several stages, including observation, socialization, basic leadership training, cadre inauguration, and the weekly implementation of the Environmental Care (PLH) extracurricular program. The activity involved school administrators, village officials, local community members, and the Indonesian Orangutan Foundation (YAYORIN) as a conservation partner. Evaluation was conducted through observation of student participation and assessment of increased environmental awareness. Results: The results demonstrated the successful establishment of the Greenact Mifda Keraya PLH organization, which actively promotes conservation initiatives within the school and surrounding areas. Furthermore, students’ knowledge increased by an average of 46.0% based on pre-test and post-test results, indicating the program’s effectiveness in strengthening students’ understanding and commitment to environmental conservation. The program also significantly enhanced students’ ecological awareness, leadership abilities, and collaboration between the school and conservation partners. Conclusion: Overall, the program successfully achieved its objective of developing conservation cadres at MTs Miftahul Huda, fostering a generation of environmentally responsible students capable of leading conservation initiatives in their community.

Abstract

Peatlands play a crucial role in maintaining the balance of the global ecosystem and the sustainability of local communities. However, various development policies, such as the One Million Hectare Peatland Development Project (PLG) and the Food Estate program, have demonstrated failure in sustainably managing peatlands, leading to environmental degradation, social conflict, and economic inequality. This article proposes an alternative approach based on Islamic Ecological Justice, integrating sharia principles—such as tawḥīd, khalīfah, mīzān, and maṣlaḥah—into a Khilafah-based peatland governance system. This research employs a qualitative approach through a thematic literature review covering five focuses: peatland ecological characteristics and challenges, national policies and their failures, sensor-based environmental monitoring technology, Islamic ethical principles in natural resource governance, and community-based adaptive cultivation strategies. The findings indicate that technocratic approaches have not been able to address the ecological and social complexities of peatlands. In contrast, the application of monitoring technology developed by researchers, combined with a public funding system through the Baitul Mal (Islamic Baitul Mal), and adaptive cultivation based on Islamic bioeconomics, offers a holistic solution framework. This approach is not only technically and socially relevant but also confirms that Islam provides a paradigm for natural resource governance that is just, preventative, and sustainable.
