Abstract

This study's goal is to look into the legal provisions concerning severance pay (uang pisah) in employment relationships in Indonesia, particularly in the context of Collective Labor Agreements (PKB), and to review the legal implications from the absence of severance pay clauses in such agreements on the protection of workers’ rights and employers’ obligations. Furthermore, this study presents a legal analysis of the judicial considerations of the Industrial Relations Court in Yogyakarta in Decision No. 19/Pdt.Sus-PHI/2022/PN Yyk. Using a normative juridical approach and qualitative analysis, the findings reveal that Indonesian labor regulations do not explicitly determine the amount of severance pay, instead delegating such provisions to be negotiated in the PKB. The absence of such provisions creates a legal vacuum that leads to uncertainty in the safeguarding of labor rights. In its decision, the court interpreted the right to severance pay based on principles of justice and the worker's length of service, despite its absence in the PKB. This highlights the urgency of establishing clear and explicit regulations on severance pay within collective labor agreements to ensure balanced and equitable legal protection for both parties.

Abstract

This study aims to examine the form and implementation of outreach activities conducted by the Serang Regency General Elections Commission (KPU) in preparation for the 2024 Legislative Elections. The study uses a normative method combined with an empirical approach, including interviews with KPU officials and field data collection. The study focuses on the effectiveness of outreach strategies, both directly through the "KPU Goes to School" program and indirectly through social media and digital content. Research findings indicate that the outreach strategy implemented by the Serang Regency General Elections Commission (KPU) has adapted to technological developments and the communication patterns of the younger generation. The use of digital platforms such as Instagram, TikTok, and YouTube has proven effective in engaging first-time voters. However, several challenges remain, including budget constraints, lack of support from some schools, and unequal access to digital infrastructure across the region. Factors supporting the effectiveness of the outreach program include regulations from the central government, the active involvement of democracy volunteers, and established collaborations with several schools. The tangible impact of this outreach strategy is evident in the increased participation rate of first-time voters, which reached 71% of the total number of first-time voters on the Serang Regency Permanent Voter List (DPT). This achievement demonstrates that an approach tailored to the characteristics of the younger generation can encourage their more active involvement in the democratic process. Based on the research findings, it is recommended that the General Elections Commission (KPU) conduct regular evaluations of its outreach methods, increase the capacity of democracy volunteers, and strengthen collaboration with educational institutions and digital communities. Furthermore, increasing budget allocation and providing adequate technological infrastructure are also important considerations to ensure more inclusive and high-quality political participation among first-time voters in the future.

Abstract

The eviction of land along the riverbank in Sukadana Village, Kasemen District, Serang City, has raised legal and social issues, particularly regarding the legality of government actions and the mechanism of providing civil compensation to affected residents. Communities that had occupied the land for decades lost their homes without transparent procedures or adequate compensation. This study aims to analyze the legal basis for eviction and civil compensation, as well as identify the obstacles encountered in its implementation. The research method employed is normative juridical, supported by empirical data analysis. Data were obtained through a literature review of legislation, legal literature, and court decisions, complemented by interviews with affected residents and relevant government officials. The findings indicate that the eviction process did not comply with the applicable legal provisions. Socialization, deliberation, and official notifications were not procedurally carried out. The promised compensation in the form of substitute land was not realized, and the government only offered relocation to public housing, which residents deemed inadequate. The main obstacles to policy implementation include limited regional budgets, regulatory changes from the central government, and political pressure with short-term development targets. In conclusion, a gap exists between legal norms and eviction practices in the field, resulting in violations of residents’ rights. Therefore, improvements are needed in the mechanisms of eviction and compensation to ensure they are more transparent, fair, and in line with the principles of a state based on the law.
