Abstract

This journal analyzes the legal aspects of default in a land title release agreement based on Court Decision Number 26/Pdt.G/2024/PN Sbr. The case involves the Plaintiff seeking compensation after Defendants PT Caruban Jaya Persada and two individuals failed to fulfill obligations in a land rights release agreement concerning parcels of land in Warugede Village, Depok Subdistrict, Cirebon Regency, valued at Rp3,311,182,000.00. The Defendants allegedly failed to make full payments and neglected other agreed terms, prompting the Plaintiff to file a claim under Article 1239 of the Indonesian Civil Code (KUH Perdata). This study employs a juridical analysis of legal documents, including the court decision and relevant legal provisions such as Article 1239 of the Indonesian Civil Code. Legal interpretation methods were used to assess the contractual dispute and its resolution. The court found the Defendants in default and ordered them to vacate the land and compensate the Plaintiff for financial losses incurred. The court's ruling emphasized the legal consequences of breaching contractual agreements, highlighting the enforceability of legally binding agreements under Indonesian civil law. The study concludes that Indonesian civil law provides robust protection for aggrieved parties in contractual disputes through Article 1239, ensuring that contract defaults lead to legally enforceable remedies. Adherence to contractual obligations is essential to avoid severe legal and financial consequences.

Abstract

Halal food and beverage products are important, and business actors must protect consumers following the mandate of the Consumer Protection Law and the Halal Product Assurance Law. The government has issued a free halal certification policy until October 17, 2024. MSME actors must have it, one of which is for MSME actors in food and beverage products. Suppose they do not have a halal certificate until that date. In that case, MSME actors will be sanctioned by Government Regulation Number 39 of 2021 concerning implementing the Halal Product Assurance Sector. The author uses an empirical juridical research method by identifying the law, seeing the effectiveness of law enforcement in the community, and reviewing the legal consequences of its implementation, especially in the Pekiringan Village area, the economic center of Cirebon City. From the results of this study, the author obtained data that more MSME actors in food and beverage products in Pekiringan Village do not have halal certificates in distributing their products. Therefore, there will be legal consequences in the form of sanctions for MSME actors if they do not have a halal certificate until the date determined by the current regulations.

Abstract

Abstract: Background: Community service is one aspect of the Tri Dharma of Higher Education that contributes to social, economic, and educational development. Aim: The Thematic Community Service Program (KKN-T) aims to build the independence of the Ciledug Wetan Village community through education-based, economic, and social empowerment. Methods: This activity uses the Participation Action Research (PAR) method, which emphasizes the community's active involvement at every stage of the program, from problem identification to planning, implementation, and evaluation. Results: The activities show increased children's literacy through interactive storytelling activities, encouraging their reading interest and critical thinking. In the economic aspect, MSME actors received training in branding, digital marketing, and promotional material creation to enhance the competitiveness of local products. In addition, public awareness of environmental cleanliness has increased through education on clean and healthy living behaviors (PHBS) and the management of organic and inorganic waste. Conclusions: This program has a direct impact on the community and students through knowledge application, leadership development, and the enhancement of communication and collaboration skills. Implication: These results affirm that student involvement in community-based empowerment programs can be an effective strategy for supporting sustainable development and innovation based on local wisdom.

Abstract

Pasangan calon presiden dan wakil presiden  wajib untuk diusulkan oleh partai politik atau gabungan partai politik peserta pemilihan umum yang memenuhi persyaratan minimum perolehan kursi 20% dari jumlah kursi DPR atau 25% dari suara sah nasional secara keseluruhan pada pemilu anggota DPR sebelum dilaksanakannya pemilu Presiden dan wakil presiden. Ketentuan ini telah termuat dalam Pasal 9 UU No. 42 Tahun 2008 Tentang Pemilihan Umum Presiden dan Wakil Presiden. Kebijakan presidential threshold (ambang batas pencalonan Presiden) dengan model pemilu serentak yang diterapkan di Indonesia masih menuai pro dan kontra di kalangan publik. Penerapan batas minimum ini membuat partai kecil yang ada seakan dibatasi untuk terlibat dalam pengajuan calon presiden dan wakil presiden dari partainya, dikarenakan tidak memenuhi syarat batas minimum yang ditentukan. Penelitian ini menghasilkan rumusan masalah berupa, Bagaimana konsep Presidential Threshold di Indonesia? dan Bagaimana Penerapan Konsep Presidential Threshold di Indonesia sesuai dengan Negara Hukum pancasila?. Dalam penelitian ini digunakan metode penelitian yuridis normatif dan menggunakan pendekatan undang-undang (state approach), pendekatan kasus (case approach), pendekatan komparatif (comparative approach), dan pendekatan konseptual (conceptual approach). Penelitian menunjukkan hasil bahwa tujuan dan penerapan ambang batas adalah sebagai jumlah suara atau dukungan minimal yang diperlukan untuk mendapatkan hak-hak tertentu dalam pemilihan umum. Penerapan Presidential threshold di Indonesia berkaitan dengan adanya kebijakan ambang batas parlemen atau parlementary threshold dan merupakan pengganti dari electoral threshold. Sebagai negara hukum yang menganut sistem presidensial, Presiden dan pemerintahan Indonesia harus melaksanakan tugas dan tanggung jawabnya dengan tanpa bergantung terhadap dukungan parlemen dan tetap dijalankan secara efektif.

Abstract

Mining is an activity that is one of the biggest sources of regional income, but on the other hand mining activities often cause bad symptoms in the community. The existence of excavation c which causes environmental damage and loss to the surrounding community is a problem that never subsides for discussion. This study aims to identify and describe IUP Excavation C and its Impact on Community Development. This study uses a descriptive qualitative approach. The concept of legislation and spatial planning that has not been ideally actualized has resulted in this phenomenon not being handled properly, especially in the Cirebon and surrounding areas, even though there is already a legal basis and concept of environmental management but it seems as if it already exists. not yet realized.

Abstract

Urban society is a complex and dynamic society, with various social identities that are formed and developed. In the midst of this complexity, law plays an important role in shaping and influencing the social identity of individuals and groups in urban society. This research aims to analyze the role of law in the formation of social identity in urban communities. This research uses a non-doctrinal research method. The data collection technique in this research is a literature study. The data that has been collected is then analyzed in three stages, namely data reduction, data presentation and conclusion drawing. The results showed that law has a complex and multidimensional role in the formation of social identity in urban communities. Law can act as a framework that regulates social interaction and maintains public order. Effective law enforcement contributes to creating a sense of justice and equality among urban citizens. It strengthens the social identity of individuals and groups by providing them with a sense of security and protection under the umbrella of the law. In addition, the law also influences the way individuals and groups interact with each other, shaping social norms that become an integral part of the social identity of urban communities.

Abstract

All aspects of community life, whether political, social, cultural, or economic, are regulated by law. Therefore, the existence of this law is universal. Development and reform give rise to social changes that give rise to social problems, which puts pressure on the law because the law must be able to overcome these problems. The aim of this research is to analyze social changes in the development of law in Indonesia. This research uses a statutory approach, also called a statutory approach. The results of this research show that law and social change have a close interaction in the context of social change. Both have an impact on each other. Changes in law are influenced by changes in society, and vice versa. Social transformation in society is influenced by legal changes as well. Based on the analysis that has been carried out, social changes in the development of law in Indonesia are: 1) Law Number 11 of 2008 was born, which regulates electronic information and transactions. Law plays two important roles in social change: law as a tool of social control and a technique of social engineering; 2) institutions have an important role in society; the existence of Rukun Warga (RW) and Rukun Tetangga (RT) officials as well as Village Government institutions is also crucial. The role of the village government and RT-RW can be utilized to empower the community effectively in carrying out prevention. 3) Providing legal understanding refers to awareness of the rules established by written law for behavior, namely what the community can and cannot do.

Abstract

The principle of good faith is a fundamental basis for establishing contractual relationships, including trade contracts in Indonesia. The application of this principle is important to create a conducive, fair and transparent business climate. The purpose of this study is to examine the application of the principle of good faith in trade contracts in Indonesia. This research uses qualitative research methods by collecting data using literature review techniques. then after the data is collected, it is analyzed using steps such as selecting data, presenting data and finally making conclusions. The research findings show that the implementation of  the principle of good faith in trade contracts in Indonesia is regulated in Article 1338 paragraph (3) of the Civil Code, which emphasizes the importance of the principle of good faith and fair dealing in the entire contract process, starting from negotiation, contract arrangement, contract implementation, to dissolution. contract. In Indonesian law, good faith is applied not only during contract implementation but also in the pre-contract stage, namely before the contract is signed. This is important to protect the parties involved in the transaction from losses. The use of the good faith principle in commercial contracts in Indonesia has also been applied in several judicial cases, such as in life insurance contracts, where the court ensured that the good faith principle was applied to protect the rights of the parties involved. Apart from that, the principle of good faith is also applied in the choice of law for foreign direct investment contracts Indonesia.

Abstract

Interfaith marriage raises legal issues that require special attention, even though they are considered sacred in religious communities in Indonesia. The study aims to determine how Indonesia's positive laws and religion view marriage between people of different religions. Normative juridical and descriptive-analytical were used to conduct this research. After being obtained from library materials and secondary data, the data is analyzed qualitatively to obtain deductive conclusions. The study found that Law No. 1 of 1974 on Marriage stipulates marriage rules in Indonesia. It states that each spouse's religious beliefs determine whether the marriage is valid or not. Furthermore, Law Number 16 of 2019, which amends Law Number 1 of 1974, sets the age limit at which a person can marry. However couples with different religious backgrounds often face problems. Religions have different views on marriage. These concepts affect the legal status of marriage. The law affects the status and position of children, marital status, and administration of residence. Therefore, a deep understanding of positive religious and legal perspectives is necessary to resolve these legal issues in a fair and balanced manner.

Abstract

Background. The development of illegal tourism infrastructure in residential areas has triggered ecosystem degradation, with a direct impact on the quality of the environment and the welfare of local communities, thereby contravening the principles of environmental protection stipulated in Law Number 32 of 2009 concerning Environmental Protection and Management. Weak supervision and implementation of environmental permits exacerbate the risk of ecological damage in residential areas. Aims. This research aims to analyze the compensation mechanism for residents affected by ecosystem damage and examine the effectiveness of environmental mitigation efforts within the applicable legal framework. Method. This research employs a normative juridical method, with a legislative approach, through an analysis of legal norms, environmental law principles, and relevant legal documents. Results. The results of the study show that the affected community has the right to file a civil lawsuit or class action based on the principle of strict liability to obtain material, immaterial, and environmental restoration damages. Mitigation efforts are carried out through the stages of prevention (EIA), pollution control, and restoration of ecosystem function.Conclusion. This study concludes that although the legal framework has comprehensively regulated protection and mitigation mechanisms, its effectiveness is still hampered by weak field supervision, so it is necessary to strengthen the licensing and environmental supervision system to realize sustainable and equitable tourism development.
