Abstract

The diversity of human life necessitates order to achieve social harmony. This study examines the significance of divine law (syari’ah ilahiyyah) as superior to tasyri’ wad’i (man-made law), focusing on the consistency of Islamic law and its relationship to the fiqh maxim “Laa Yunkaru Taghayyur al-Ahkam bi Taghayyur al-Azman” (legal rulings may change with changing times). Using a literature-based method, the analysis incorporates classical and contemporary scholarly perspectives alongside practical applications of the maxim. The findings reveal that rulings derived directly from textual evidence (nass) are immutable, whereas those based on custom (urf), public interest (maslahah), or independent reasoning (ijtihad) may adapt to changing contexts. The maxim is narrowly applied to rulings influenced by customs, leaving core scriptural rulings unchanged. Examples include theft punishments adjusted for customary definitions of safekeeping, evolving zakat policies, and contemporary regulations such as traffic laws. These findings affirm that Islamic law combines permanence in foundational principles with flexibility in contextual applications, ensuring its relevance across times and places. The study concludes that understanding the boundaries of this fiqh maxim is crucial for maintaining the balance between the timelessness of Islamic law and its adaptability to modern challenges, preserving both its authenticity and practical utility.--Keberagaman kehidupan manusia memerlukan keteraturan untuk mencapai harmoni sosial. Studi ini mengkaji pentingnya hukum ilahi (syari’ah ilahiyyah) yang dianggap lebih unggul dibandingkan dengan tasyri’ wad’i (hukum buatan manusia), dengan fokus pada konsistensi hukum Islam dan hubungannya dengan kaidah fiqih “Laa Yunkaru Taghayyur al-Ahkam bi Taghayyur al-Azman” (hukum dapat berubah sesuai dengan perubahan zaman). Dengan pendekatan berbasis literatur, analisis ini mencakup perspektif ulama klasik dan kontemporer serta aplikasi praktis dari kaidah tersebut. Temuan menunjukkan bahwa hukum yang bersumber langsung dari nash bersifat tetap, sementara hukum yang didasarkan pada adat (urf), kemaslahatan (maslahah), atau ijtihad dapat disesuaikan dengan konteks yang berubah. Kaidah ini diterapkan secara terbatas pada hukum yang dipengaruhi oleh adat kebiasaan, sementara hukum nash tetap tidak berubah. Contoh penerapan mencakup hukuman pencurian yang disesuaikan dengan definisi adat penyimpanan barang, kebijakan zakat yang berkembang, dan peraturan kontemporer seperti lalu lintas. Temuan ini menegaskan bahwa hukum Islam menggabungkan keabadian prinsip-prinsip dasar dengan fleksibilitas dalam aplikasi kontekstual, sehingga memastikan relevansinya di berbagai waktu dan tempat. Studi ini menyimpulkan bahwa pemahaman batasan penerapan kaidah fiqih ini sangat penting untuk menjaga keseimbangan antara keabadian hukum Islam dan kemampuannya beradaptasi dengan tantangan modern, sekaligus mempertahankan keaslian dan kegunaannya secara praktis.

Abstract

This study examines in depth various TikTok monetization strategies from an Islamic legal perspective. It analyzes methods such as live streaming with virtual gifts, brand endorsements, affiliate marketing, and direct sales through TikTok Shop to determine whether these methods are ethically and legally permissible under Sharia. The study is qualitative with a library research approach based on primary Islamic sources (the Qur’an and Hadith) and contemporary scholarly interpretations. The analysis is guided by classical Islamic contract frameworks like ju’ālah (reward-based contract) and ijārah (service-for-hire contract), as well as the higher objectives of Islamic law (maqāsid al-sharī’ah). Findings suggest that TikTok’s monetization features have the potential to align with Islamic principles, but only with proper ethical safeguards. Income from live streaming is considered halal if the shared content is beneficial, ethical, and non-manipulative. Endorsement and sponsorship agreements can be accepted under ijārah as long as they involve halal products and honest disclosure practices. Similarly, affiliate marketing aligns with ju’ālah principles if conducted transparently and truthfully. Transactions on TikTok Shop generally meet Sharia criteria as long as they adhere to the pillars (rukun) and conditions of a valid sale (bay’), including clear pricing and the sale of lawful goods. The study emphasizes the importance of clear ethical guidelines, public education, and platform policies that uphold Islamic values while fostering digital economic innovation. It also provides theoretical and practical contributions for content creators, regulators, and academics to build a responsible and Sharia-compliant online marketplace.

Abstract

This thesis discusses Mapparola in the marriage customs of the Bugis Wajo community. The main issue is the implementation of the Mapparola tradition in marriages for the community in Belawa Siattinge District, Wajo Regency, and its perspective according to Islamic law. This research is a field study using qualitative methods and employs two approaches: sociological and empirical. The data in this study were obtained from interviews with cultural leaders, religious leaders, and individuals considered knowledgeable in Islamic law, including the Head of the Religious Affairs Office (KUA) of Belawa District, Islamic Religious Counselors, and cultural leaders who understand the culture in Wajo Regency. The aim of this research is to understand the process of implementing the Mapparola tradition in marriage and to comprehend the views of the Belawa community, Wajo Regency, regarding this tradition in the context of marriage. The Mapparola tradition is one of the local cultural heritages that is still preserved by the community as part of the marriage customs. The method used in this research is qualitative with a descriptive approach. Data were collected through observation, in-depth interviews, and documentation involving cultural leaders, newlywed couples, and local communities. The results of the study indicate that the Mapparola tradition has specific stages that are rich in symbolic and cultural values, such as respect for the families of the bride and groom, mutual cooperation, and values of politeness. The Belawa community views this tradition as an important part of maintaining cultural identity and strengthening social ties between families. Although it has undergone some adjustments in its implementation, the Mapparola tradition remains a respected element in the traditional marriage process in the region.

Abstract

Penelitian ini menyelidiki pengaruh edukasi keuangan, faktor sosioekonomi, dan teknologi keuangan terhadap inklusi keuangan syariah di kalangan milenial di Indonesia melalui analisis kuantitatif. Sampel yang terdiri dari 250 partisipan memberikan wawasan tentang profil demografis, perilaku keuangan, dan tingkat keterlibatan mereka dengan keuangan syariah. Statistik deskriptif menunjukkan tingkat inklusi keuangan syariah yang moderat di kalangan milenial yang disurvei. Hasil model pengukuran menunjukkan keandalan dan validitas dari variabel-variabel yang diukur, termasuk pendidikan keuangan, faktor sosioekonomi, keterlibatan teknologi keuangan, dan inklusi keuangan syariah. Pemodelan Persamaan Struktural (SEM-PLS) menunjukkan jalur yang kuat yang menghubungkan pendidikan keuangan, faktor sosioekonomi, dan teknologi keuangan dengan inklusi keuangan syariah. Pengujian hipotesis mengkonfirmasi signifikansi dan kekuatan hubungan ini. Nilai R-Square dan Q2 menggarisbawahi kekuatan penjelas dan relevansi prediktif model. Analisis komparatif dengan tren global menunjukkan adanya pola yang konvergen dan unik. Implikasi praktis menyarankan intervensi yang ditargetkan untuk meningkatkan pendidikan keuangan, mengatasi kesenjangan sosial ekonomi, dan memanfaatkan teknologi keuangan untuk mempromosikan inklusi keuangan Islam. Penelitian ini diakhiri dengan keterbatasan, jalan untuk penelitian di masa depan, dan penekanan pada peran penting strategi yang disesuaikan dalam mendorong inklusi keuangan syariah di kalangan milenial Indonesia.
