Abstract

Indonesia’s participation in international treaties can not be avoided in global situation, but it does not mean to exclude the national interest especially with regard the protection of Indonesian workers. The government must necessarily put the national interest as the main objective, and if the country is in unfavorable conditions even harming national interests, it should be evaluated or if necessary aborted.

Abstract

AbstrakPengaturan pengupahan minimum terhadap tenaga kerja di Indonesia sebelumnya diatur melalui Peraturan Pemerintah Nomor 78 Tahun 2015 dimana pengaturan pengupahan terhadap hak penerima upah yang dirasakan oleh tenagakerja. Namun,yang terbaru pada Peraturan Pemerintah Nomor 36 Tahun 2021 tentang pengupahan bahwa “setiap Pekerja/Buruh berhak memperoleh Upah yang sama untuk pekerjaan yang sama nilainya”. Arti secara perkembangan pengaturan pengupahan terus dilakukan demi mampu menerima pembaruan baik aspek sosial maupun ekonomi. Indonesia hingga saat ini tidak meratifikasi ILO Convention Number 131, 1970 tentang Pengupahan minimum.  Standar penetapan upah sesuai konvensi 131 adalah kebutuhan dari pekerja dan keluarganya, dengan mempertimbangkan tingkah upah secara umum di negara bersangkutan, biaya hidup, jaminan perlindungan sosial, dan standar kehidupan relatif dari kelompok sosial lainnya. ancaman dari era revolusi industri 4.0 memiliki dampak yang cukup signifikan terhadap tenaga kerja minim kemampuan atau terkalahkan dengan tenaga automasi. Pemerintah Indonesia dengan momen ini di saat revolusi industri 4.0 terjadi untuk membuat suatu kebijakan cepat dalam memberikan pengupahan secara batas minimum untuk diratifikasi pada ILO Convention 131, 1970 tentang pengupahan minimum sehingga prinsip dari minimum wages mengalami perubahan menjadi living wages di sistem pengaturan pengupahan di Indonesia.Kata kunci: pengupahan; revolusi industri 4.0; tenaga kerjaAbstractMinimum wage arrangements Workers in Indonesia were previously regulated through Government Regulation No. 78 of 2015 where wages were set on the rights of wage recipients felt by workers. However, the latest in Government Regulation Number 36 of 2021 concerningstates that "Wagesevery Worker/Labourer has the right to receive the same Wage for work of the same value". In terms of development, wage arrangements continue to be made in order to be able to receive updates in both social and economic aspects. Indonesia has not yet ratified the ILO Convention Number 131, 1970 concerning Minimum Wages. The standard for setting wages according to Convention 131 is the needs of workers and their families, taking into account the general behavior of wages in the country concerned, the cost of living, social protection insurance, and the relative living standards of other social groups. The threat from the industrial revolution 4.0 era has a significant impact on a workforce with minimal capabilities or is defeated by automation. The Indonesian government at this moment when the industrial revolution 4.0 occurred to make a quick policy in providing minimum wages to be ratified at the ILO Convention 131, 1970 regarding minimum wages so that the principle of minimum wages changed to living wages in the wage regulation system in Indonesia.

Abstract

The use of language in international agreements is very important to establish international cooperation. It is also noteworthy that according to the Indonesian law, the international agreements related to several matters adopted by the government shall be translated to Bahasa Indonesia. However, the terms contained in Indonesian national law, in Bahasa Indonesia, often tend to be different from the meanings contained in international law, such as the 1969 Vienna Convention on the Law of Treaties. Thus, they often have multiple interpretations. As such, the use of language, especially relating to international agreements, can be a trigger for legal disputes. In this regard, using a legal research method by analyzing the international legal instruments and Indonesian national law, this paper digs into the use of language related to the adoption of an international agreement to an Indonesian Law, especially regarding the terms of “ratification,” “accession,”  and others. It is argued that there is a difference of perspective within the “adoption of an international agreement” regarding the terms of “ratification” and “accession” under the 1969 Vienna Convention.

Abstract

PTSL is a land registration activity for the first time that is carried out simultaneously for all land registration objects throughout the territory of the Republic of Indonesia in one village/kelurahan area or other name equivalent to that, which includes the collection of physical data and juridical data regarding one or several registration objects. Land for registration purposes. In this study, the data sources were obtained from library research and field research. Data collection techniques were carried out through structured interviews and document studies. The results of the research on PTSL constraints in Pekanbaru City are the high cost of having to pay the payable PPh and BPHTB taxes, the problem of rights used, human resources, the problem of absentee land/land that is far from the owner and the problem of announcing physical data and juridical data. While the efforts made by the Pekanbaru City Land Office in overcoming PTSL obstacles are strengthening quality control over each stage of PTSL, providing work maps (base maps, land registration maps, area maps, SPIPP maps, and Regional Government/BUMN/BUMD asset data) to officers in the field, providing punishment and a whistleblowing system mechanism, improving data validation procedures for KKP applications, reviewing and improving PTSL budget implementation guidelines and quality control.

Abstract

This research aims to examine and analyze the handover of housing and settlement infrastructure, facilities, and utilities from developers to local governments, as well as legal certainty in the management of the handed-over housing and settlement infrastructure, facilities, and utilities. This research uses empirical juridical methods with primary data collection or processing techniques and interviews with related sources. The results of the research found that the problem that often occurs in the handover of housing and settlement infrastructure, facilities, and utilities from developers to local governments is that regulations regarding the Handover of Housing and Settlement Infrastructure, Facilities, and Utilities have not been disseminated to developers so that to date there has been no handover of infrastructure, Housing and Settlement Facilities and Utilities from Developers to the Tanah Datar Regency Government.

Abstract

The main task of a notary is to create or record events authentically. For parties who make an agreement before a Notary, if a dispute arises related to the deed, then usually the first person to ask for advice is the Notary concerned. The main problem in this research is how the notary plays the role of the peace settlement agreement carried out by the parties before the notary regarding the dispute over the Deed of Jual Beili Peingikatan Agreement (PPJB). This legal research uses an empirical juridical method, namely a method of approaching problems by looking at applicable legal norms and then connecting them with legal facts found in the field. Meanwhile, this type of research is descriptive analytical, namely providing a clear and detailed description of an event that occurred. The results of the research, the role of a notary in the selection process of the Deed of Juial Beili Agreement (PPJB) made by the parties in front of him is that the notary can act by providing input regarding disputes between the parties in the deed made by the notary. This function is the role of the notary voluntarily as a party. who understands his duties and functions as a notary, and in this case the notary is also considered to really understand the essence of the ongoing problems and the peace litigation carried out by the parties before the notary regarding disputes over the Deed of Juial Beili Peining Agreement (PPJB), namely that the notary has the same ideals. Intuitive signatures provide legal guidance as well as providing information related to the execution of authentic deeds, as stipulated in Article 15 Paragraph (2) huiruif eiUiUiJN. In this case, the notary provides legal counseling to make the next deed after the parties have reconciled, namely in the form of a peace deed accompanied by a power of sale deed.

Abstract

Geographical Indication is the new black in the world of intellectual property because of their very high commercialization potential, although they have not received as much attention as other intellectual property rights. In Indonesia, the regulations for Geographical Indication have been updated through Law Number 20 of 2016 concerning Trademarks and Geographical Indication (UU 20/2016) to be more in line with the provisions in Trade-Related Aspects of Intellectual Property Rights . Through this arrangement, it is expected that Indonesia can maximize the monetization of Geographical Indication by taking advantage of opportunities and overcoming existing challenges to encourage regional and national economic revival. Therefore this study raises two problem formulations, namely: (1) How are Geographical Indication regulated in Indonesia?; and (2) What are the opportunities and challenges of managing Geographical Indication in Indonesia?. This is a normative research using statutory, historical, comparative, and conceptual approaches with several interviews with related parties to sharpen the problem analysis. The resulting findings indicate that regarding the regulation of Geographical Indication in Indonesia there are several opportunities that can be utilized by producers and the public in the regions, namely, registration of Geographical Indication other than Agricultural Products, use of the national logo of Geographical Indication, registration of Geographical Indication abroad, follow-up of violations of Geographical Indication. Apart from that, there are also several challenges, namely, the lack of understanding of the registration process of Geographical Indication, the use of the 'logo' in the registration of Geographical Indication, the term 'User of Geographical Indication' in Law 20/2016.

Abstract

Differences in legal systems between countries give rise to various basic rules regarding international trade contracts. Efforts made to harmonize this were by holding an international convention by The International Institute for the Unification of Private Law (UNIDROIT) which gave birth to The UNIDROIT Principles of International Commercial Contracts (UPICCs). UPICCs are actually used as a legal basis for implementing international trade contracts. The formulation of the research problem is how is the principle of freedom of contract, the principle of good faith and fair dealing regulated in international law and national law?, and what are the challenges of implementing the UNIDROIT principle in international trade contracts in Indonesia? ? This research is normative legal research and is analytical descriptive. The results of the research are that international law regulations regarding the principle of freedom of contract, the principle of good faith and fair dealing are regulated by UPICCs. Meanwhile, regulations in national law can be seen in the Civil Code and the ITE Law. S Because the UPICCs regulate many matters that are not detailed in Book III of the Civil Code, the challenge is the unification and codification of contract law to provide legal certainty, with uniform provisions that can be universally accepted by countries involved in international trade.

Abstract

Upaya penerapan pengurangan waktu tunggu (dwelling time) telah dilakukan di beberapa pelabuhan di Indonesia. Salah satu penyebab tingginya Dwelling Time di pelabuhan adalah tumpang tindih peraturan yang terjadi. Saat ini Pelabuhan Indonesia akan dikurangi dari 200 izin di pelabuhan menjadi hanya beberapa izin yang sangat penting. Pelabuhan Singapura yang relatif kecil dan sempit misalnya, telah menggunakan pola perizinan yang ringkas seperti ini. Pelabuhan Singapura rata-rata hanya mempunyai waktu tunggu 1 (satu) hari, sedangkan Pelabuhan Tanjung Priuk sampai dengan 6 (enam) hari. Penerapan serupa juga dilakukan di Pelabuhan Teluk Bayur, sebagai contoh lokasi percontohan. Uji coba ini dilakukan dengan pola mematuhi aturan hukum internasional dan nasional serta menetapkan aturan Pelabuhan yang mengurangi waktu tunggu tersebut. Pengaturan yang tumpang tindih selama ini berdampak signifikan terhadap penambahan waktu tunggu pelabuhan Indonesia. Padahal kedudukan tersebut dapat dikurangi dengan melakukan modifikasi pelaksanaan dan penyempurnaan aturan hukum yang ada. Hukum dapat menjadi sarana perbaikan pelabuhan melalui teori hukum pembangunan Mochtar Kusumatmadja bahwa hukum dapat menjadi sarana pembangunan. Hal ini tertuang dalam Pasal 1 ayat 7 Undang-Undang Nomor 7 Tahun 2009 tentang Pelayaran yang menyatakan bahwa pelabuhan adalah segala sesuatu yang berkaitan dengan pelaksanaan fungsi pelabuhan untuk menunjang dan mendorong perekonomian nasional dan daerah dengan tetap memperhatikan tata ruang. Pada tahun 2017 Indonesia telah memasuki era kerja sama Masyarakat Ekonomi ASEAN. Salah satu isu yang dapat dikedepankan Indonesia adalah penguatan pelabuhan anggota agar mampu meningkat daya saingnya setara dengan pelabuhan utama anggota. Negara-negara Anggota ASEAN seperti Singapura dan Malaysia dapat berbagi pengalamannya dalam mengelola pelabuhan sehingga dapat memicu pengurangan waktu tunggu (dwelling time) di pelabuhan-pelabuhan di Indonesia.

Abstract

Electronic trading (PMSE) facilitates transactions, both nationally and internationally. This study aims to examine PMSE regulations within the scope of the ASEAN Economic Community (AEC) and their impact on consumers in Indonesia. This study employs a normative legal method with a descriptive-prescriptive approach. Data collection was conducted through literature review, while data analysis was performed descriptively. The results of the study reveal that PMSE regulations in ASEAN are governed by the ASEAN Blueprint, the ASEAN Charter, and the ASEAN Agreement on E-Commerce (AAEC). The AAEC consists of 19 articles, covering various aspects such as cooperation mechanisms and scope, facilitation of cross-border electronic commerce, cybersecurity, digital payment systems, logistics, transparency, dispute resolution, and agreement implementation. These regulations aim to strengthen cross-border trade in ASEAN, create a business environment that supports Small and Medium Enterprises (SMEs), and strengthen cooperation among member countries to accelerate inclusive economic growth and reduce disparities in the region. Regarding the impact of the ASEAN trade agreement on Indonesian consumers following the implementation of Law No. 4 of 2021, it was found that there are still other national regulations governing e-commerce, including the Electronic Information and Transactions Law (EIT Law), the Trade Law, and Government Regulation No. 82 of 2012 on the Implementation of Electronic Systems and Transactions.
